2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Present subsections (4) and (5) of section 12
2626 316.081, Florida Statutes, are redesignated as subsections (5) 13
2727 and (6), respectively, a new subsection (4) is added to that 14
2828 section, and present subsection (5) of that section is 15
2929 republished, to read: 16
3030 316.081 Driving on right side of roadway; exceptions. — 17
3131 (4)(a) As used in this subsection, the term "furthermost 18
3232 left-hand lane" means the farthest, most left -hand lane, except 19
3333 that, if such left-hand lane is a high-occupancy-vehicle lane as 20
3434 defined in s. 316.0741, or is a designated left -turn lane, the 21
3535 furthermost left-hand lane is the lane immediately to the right 22
3636 of that high-occupancy-vehicle lane or left -turn lane. 23
3737 (b) On a road, street, or highway with two or more lanes 24
3838 allowing movement in the same dir ection and a posted speed limit 25

5151 of at least 65 miles per hour, a driver may not operate a motor 26
5252 vehicle in the furthermost left -hand lane, except when 27
5353 overtaking and passing another vehicle; when preparing to exit 28
5454 the road, street, or highway; or when othe rwise directed by an 29
5555 official traffic control device. This subsection does not apply 30
5656 to authorized emergency vehicles and vehicles engaged in highway 31
5757 maintenance or construction operations. 32
5858 (6)(5) A violation of this section is a noncriminal 33
5959 traffic infraction, punishable as a moving violation as provided 34
6060 in chapter 318. 35
6161 Section 2. This act shall take effect January 1, 2025. 36
