24	24		Be It Enacted by the Legislature of the State of F lorida: 11

26	26		Section 1. Subsection (1) of section 35.051, Florida 13
27	27		Statutes, is amended to read: 14
28	28		35.051 Subsistence and travel reimbursement for judges 15
29	29		with alternate headquarters. — 16
30	30		(1)(a) A district court of appeal judge is eligible for 17
31	31		the designation of a county courthouse or another appropriate 18
32	32		facility in his or her county of residence , or an adjacent 19
33	33		county within the district, as his or her official headquarters 20
34	34		for purposes of s. 112.061 if the judge permanently resides more 21
35	35		than 50 miles from: 22
36	36		1. The appellate district's headquarters as prescribed 23
37	37		under s. 35.05(1), if the judge is assigned to such 24
38	38		headquarters; or 25

52	52		established under s. 35.05(2), if the judge is assigned to such 27
53	53		branch headquarters. 28

55	55		The official headquarters may serve only as the judge's private 30
56	56		chambers. 31
57	57		(b)1. A district court of appeal judge for whom an 32
58	58		official headquarters is designated under paragraph (a) in his 33
59	59		or her county of residence under this subsection is eligible for 34
60	60		subsistence at a rate to be established by the Chief Justice for 35
61	61		each day or partial day that the judge is at the headquarters or 36
62	62		branch headquarters of his or her appellate district to conduct 37
63	63		court business, as authorized by the chief judge of that 38
64	64		district court of appeal. The Chief Justice may authorize a 39
65	65		judge to choose between subsistence based on lodging at a 40
66	66		single-occupancy rate and meal reimbursement as provided in s. 41
67	67		112.061 and subsistence at a fixed rate prescribed by the Chief 42
68	68		Justice. 43
69	69		2. In addition to subsistence, a district court of appeal 44
70	70		judge is eligible for reimbursement for travel expenses as 45
71	71		provided in s. 112.061(7) and (8) for travel between the judge's 46
72	72		official headquarters and the headquarters or branch 47
73	73		headquarters of the ap pellate district to conduct court 48
74	74		business. If the judge's official headquarters designated under 49
75	75		paragraph (a) is located in a county adjacent to the judge's 50

88	88		county of residence, such reimbursement is limited to the lesser 51
89	89		of: 52
90	90		a. The amount for travel b etween the judge's official 53
91	91		headquarters and the headquarters or branch headquarters of the 54
92	92		appellate district; or 55
93	93		b. The amount that would be authorized for travel between 56
94	94		an official headquarters maintained in the judge's county of 57
95	95		residence and the he adquarters or branch headquarters of the 58
96	96		appellate district. 59
97	97		(c) Payment of subsistence and reimbursement for travel 60
98	98		expenses between the judge's official headquarters and the 61
99	99		headquarters or branch headquarters of his or her appellate 62
100	100		district shall be made to the extent that appropriated funds are 63
101	101		available, as determined by the Chief Justice. 64
102	102		Section 2. This act shall take effect July 1, 2024. 65
