CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 1 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to specialty license plates; amending 2 s. 320.08056, F.S.; exempting collegiate license 3 plates from certain discontinuation requirements for 4 specialty license plates; amending s. 320.08058, F.S.; 5 exempting collegiate license plates from certain 6 presale voucher requirements for specialty license 7 plates; requiring the Department of Highway Safety and 8 Motor Vehicles to reauthorize previously disco ntinued 9 collegiate license plates under certain circumstances; 10 revising the words appearing on the American Eagle 11 license plate; renaming the Give Kids The World 12 license plate as the Universal Orlando Resort license 13 plate; revising the words appearing on t he license 14 plate; directing the department to develop specified 15 specialty license plates; providing for distribution 16 and use of fees collected from the sale of the plates; 17 providing an effective date. 18 19 Be It Enacted by the Legislature of the State of F lorida: 20 21 Section 1. Paragraph (f) of subsection (8) of section 22 320.08056, Florida Statutes, is amended to read: 23 320.08056 Specialty license plates. — 24 (8) 25 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 2 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (f) Notwithstanding paragraph (a), on January 1 of each 26 year, the department shall discontinue the specialty license 27 plate with the fewest number of plates in circulation, including 28 license plates exempt from a statutory sales requirement. The 29 department shall mail a warning letter to the sponsoring 30 organizations of the 10 percent of specialty lice nse plates with 31 the lowest number of valid, active registrations as of December 32 1 of each year. This paragraph does not apply to collegiate 33 license plates established under s. 320.08058(3). 34 Section 2. Subsections (3) and (107) and paragraph (a) of 35 subsection (95) of section 320.08058, Florida Statutes, are 36 amended, and subsections (127) through (135) are added to that 37 section, to read: 38 320.08058 Specialty license plates. — 39 (3) COLLEGIATE LICENSE PLATES. — 40 (a) The department shall develop a collegiat e license 41 plate as provided in this section for state and independent 42 universities domiciled in this state. However, any collegiate 43 license plate created or established after October 1, 2002, must 44 comply with the requirements of s. 320.08053 , other than the 45 presale voucher requirements in s. 320.08053(2)(b), and be 46 specifically authorized by an act of the Legislature. Collegiate 47 license plates must bear the colors and design approved by the 48 department as appropriate for each state and independent 49 university. The Board 54 of Governors of the State University System shall require each 55 state university to submit a plan for approval of the 56 expenditure of all funds so designated. These funds may be used 57 only for academic enhancement, including scholarships an d 58 private fundraising activities. 59 (c) If a collegiate license plate has previously been 60 discontinued pursuant to s. 320.08056(8)(f), the department must 61 reauthorize the collegiate license plate if the state or 62 independent university resubmits the colleg iate license plate 63 for authorization. 64 (95) AMERICAN EAGLE LICENSE PLATES. — 65 (a) The department shall develop an American Eagle license 66 plate as provided in this section and s. 320.08053. The plate 67 must bear the colors and design approved by the departme nt. The 68 word "Florida" must appear at the top of the plate, and the 69 words "Protect the Eagle In God We Trust" must appear at the 70 bottom of the plate. 71 (107) UNIVERSAL ORLANDO RESORT GIVE KIDS THE WORLD LICENSE 72 PLATES.— 73 (a) The department shall develop a Universal Orlando 74 Resort Give Kids The World license plate as provided in this 75 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 4 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S section and s. 320.08053. The plate must bear the colors and 76 design approved by the department. The word "Florida" must 77 appear at the top of the plate, and the words " Universal Orlando 78 Resort Give Kids The World" must appear at the bottom of the 79 plate. 80 (b) The annual use fees from the sale of the plate shall 81 be distributed to Give Kids The World, Inc., a nonprofit 82 organization under s. 501(c) (3) of the Internal Revenue Code. Up 83 to 10 percent of the proceeds may be used for the promotion and 84 marketing of the plate. The remainder of the proceeds shall be 85 used by Give Kids The World, Inc., to support their mission of 86 providing week-long, cost-free vacations to children with 87 critical illnesses and their families. 88 (127) MARGARITAVILLE LICENSE PLATES. — 89 (a) The department shall develop a Margaritaville license 90 plate as provided in this section and s. 320.08053. The plate 91 must bear the colors and d esign approved by the department. The 92 word "Florida" must appear at the top of the plate, and the word 93 "Margaritaville" must appear at the bottom of the plate. 94 (b) The annual use fees from the sale of the plate must be 95 distributed to the SFC Charitable F oundation, Inc., also known 96 as Singing for Change, which may use up to 10 percent of such 97 fees for administrative costs and marketing of the plate. The 98 balance of the fees must be used by the SFC Charitable 99 Foundation, Inc., and must be distributed with th e approval of 100 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 5 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S and accountability to the board of directors of the SFC 101 Charitable Foundation, Inc., to provide grants to nonprofit 102 organizations in communities impacted by natural or manmade 103 disasters for recovery, rebuilding, and future sustainability in 104 those communities and to promote and inspire local grassroots 105 leadership that will work to improve the quality of life in 106 those communities and others in this state. 107 (128) CLEARWATER MARINE AQUARIUM LICENSE PLATES. — 108 (a) The department shall develop a Cl earwater Marine 109 Aquarium license plate as provided in this section and s. 110 320.08053. The plate must bear the colors and design approved by 111 the department. The word "Florida" must appear at the top of the 112 plate, and the words "Clearwater Marine Aquarium" mu st appear at 113 the bottom of the plate. 114 (b) The annual use fees from the sale of the plate must be 115 distributed to Clearwater Marine Aquarium, Inc., a Florida 116 nonprofit corporation under s. 501(c)(3) of the Internal Revenue 117 Code, which may use up to 10 perc ent of the fees for the 118 administration, promotion, and marketing of the plate. The 119 remaining fees must be used by Clearwater Marine Aquarium, Inc., 120 to fund its efforts to rescue, rehabilitate, and release marine 121 life; provide environmental education; condu ct research; and 122 promote conservation strategies. 123 (129) GENERAL AVIATION LICENSE PLATES. — 124 (a) The department shall develop a General Aviation 125 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 6 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S license plate as provided in this section and s. 320.08053. The 126 plate must bear the colors and design approved by the 127 department. The word "Florida" must appear at the top of the 128 plate, and the words "Support General Aviation" must appear at 129 the bottom of the plate. 130 (b) The annual use fees from the sale of the plate must be 131 distributed to the Aerospace Center fo r Excellence located in 132 Lakeland. The Aerospace Center for Excellence may use up to 10 133 percent of such fees for administrative costs and marketing of 134 the plate. The balance of the fees must be used by the Aerospace 135 Center for Excellence to fund scholarship s for students in this 136 state who are pursuing careers in the field of aviation. 137 (130) THE VILLAGES: MAY ALL YOUR DREAMS COME TRUE LICENSE 138 PLATES.— 139 (a) The department shall develop a The Villages: May All 140 Your Dreams Come True license plate as provided in this section 141 and s. 320.08053. The plate must bear the colors and design 142 approved by the department. The word "Florida" must appear at 143 the top of the plate, and the words "The Villages: May All Your 144 Dreams Come True" must appear at the bottom of the pla te. 145 (b) The annual use fees from the sale of the plate must be 146 distributed to The Villages Charter School, Inc., a Florida 147 nonprofit corporation. Up to 10 percent of the fees may be used 148 for administrative costs and marketing of the plate. The 149 remaining funds must be distributed with the approval of, and 150 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 7 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S accountability to, the board of directors of The Villages 151 Charter School, Inc., and must be used to provide support to The 152 Villages Charter School as it provides K -12 education. 153 (131) CURE DIABETES LICE NSE PLATES.— 154 (a) The department shall develop a Cure Diabetes license 155 plate as provided in this section and s. 320.08053. The plate 156 must bear the colors and design approved by the department. The 157 word "Florida" must appear at the top of the plate, and th e 158 words "Cure Diabetes" must appear at the bottom of the plate. 159 (b) The annual use fees from the sale of the plate must be 160 distributed equally to the following organizations: 161 1. The Diabetes Research Institute Foundation, which 162 supports the Diabetes Re search Institute at the University of 163 Miami Miller School of Medicine; 164 2. The JDRF International Incorporated, which supports the 165 JDRF Northern Florida Chapter; and 166 3. The University of Florida Foundation, Inc., which 167 supports the University of Florida Diabetes Institute. 168 (c) Each organization may use up to 10 percent of the 169 proceeds received by the organization to promote and market the 170 plate. All remaining proceeds must be used for the purpose of 171 funding research to cure Type 1 diabetes. 172 (132) RECYCLE FLORIDA LICENSE PLATES. — 173 (a) The department shall develop a Recycle Florida license 174 plate as provided in this section and s. 320.08053. The 176 word "Florida" must appear at the top o f the plate, and the 177 words "Recycle Florida" must appear at the bottom of the plate. 178 (b) The annual use fees from the sale of the plate must be 179 distributed to the Recycle Florida Today Foundation, Inc., which 180 may use up to 10 percent of such fees for adm inistrative costs 181 and marketing of the plate. The balance of the fees must be used 182 by the Recycle Florida Today Foundation, Inc., to increase 183 public awareness about the importance of recycling, resource 184 conservation, and environmental stewardship; to promo te robust, 185 comprehensive, and sustainable recycling programs; and to 186 support the professional development of persons employed in 187 fields relating to recycling, conservation, and sustainability. 188 (133) BOATING CAPITAL OF THE WORLD LICENSE PLATES. — 189 (a) The department shall develop a Boating Capital of the 190 World license plate as provided in this section and s. 191 320.08053. The plate must bear the colors and design approved by 192 the department. The word "Florida" must appear at the top of the 193 plate, and the words "Boating Capital of the World" must appear 194 at the bottom of the plate. 195 (b) The annual use fees from the sale of the plate must be 196 distributed to Captain Sandy Yawn, Inc., which may use up to 10 197 percent of such fees for administrative costs and marketing of 198 the plate. The balance of the fees must be used by Captain Sandy 199 Yawn, Inc., to increase public awareness of employment 200 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 9 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S opportunities in the maritime industry; to fund maritime 201 workforce instruction and training; to promote professional 202 development and job placement in all sectors of maritime 203 employment; and to support the advancement of education of 204 trainees in the maritime industry, both at sea and on land. 205 (134) PROJECT ADDICTION: REVERSING THE STIGMA LICENSE 206 PLATES.— 207 (a) The department shall dev elop a Project Addiction: 208 Reversing the Stigma license plate as provided in this section 209 and s. 320.08053. The plate must bear the colors and design 210 approved by the department. The word "Florida" must appear at 211 the top of the plate, and the words " Overdose Awareness" must 212 appear at the bottom of the plate. 213 (b) The annual use fees from the sale of the plate must be 214 distributed to Project Addiction: Reversing the Stigma, Inc., a 215 Florida nonprofit corporation, as follows: 216 1. Up to 10 percent of the annual use fees may be used for 217 the promotion and marketing costs of the license plate. 218 2. The remaining funds must be distributed with the 219 approval of and accountability to the board of directors of 220 Project Addiction: Reversing the Stigma, Inc., and must be us ed 221 to promote and support awareness of and education about 222 substance use disorder and mental illness. 223 (135) UNITED SERVICE ORGANIZATIONS (USO) LICENSE PLATES. — 224 (a) The department shall develop a United Service 225 CS/CS/HB 403 2024 CODING: Words stricken are deletions; words underlined are additions. hb0403-02-c2 Page 10 of 10 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Organizations (USO) license plate as provi ded in this section 226 and s. 320.08053. The plate must bear the colors and design 227 approved by the department. The word "Florida" must appear at 228 the top of the plate, and the acronym "USO" must appear at the 229 bottom of the plate. 230 (b) The annual use fees from the sale of the plate must be 231 distributed to United Service Organizations, Inc., a nonprofit 232 corporation under s. 501(c)(3) of the Internal Revenue Code, 233 which may use up to 10 percent of the fees for administrative 234 costs and marketing of the plate. Unite d Service Organizations, 235 Inc., must distribute the remainder of the fees equally among 236 its ten locations in this state to be used to promote its 237 mission of supporting members of the United States Armed Forces 238 and their families through its various programs , services, and 239 events. 240 Section 3. This act shall take effect October 1, 2024. 241
