Paragraph (f) of subsection (8) of section 26 320.08056, Florida Statutes, is amended to read: 27 320.08056 Specialty license plates. — 28 (8) 29 (f) Notwithstanding paragraph (a), on January 1 of each 30 year, the department shall discontinue the specialty license 31 plate with the fewest number of plates in circulati on, including 32 license plates exempt from a statutory sales requirement. The 33 department shall mail a warning letter to the sponsoring 34 organizations of the 10 percent of specialty license plates with 35 the lowest number of valid, active registrations as of Dec ember 36 1 of each year. This paragraph does not apply to collegiate 37 license plates established under s. 320.08058(3). 38 Section 2. Subsection (3), paragraph (b) of subsection 39 (47), paragraph (a) of subsection (95), paragraph (c) of 40 subsection (101), and su bsection (107) of section 320.08058, 41 Florida Statutes, are amended, and subsections (127) through 42 (135) are added to that section, to read: 43 320.08058 Specialty license plates. — 44 (3) COLLEGIATE LICENSE PLATES. — 45 (a) The department shall develop a colleg iate license 46 plate as provided in this section for state and independent 47 universities domiciled in this state. However, any collegiate 48 license plate created or established after October 1, 2002, must 49 comply with the requirements of s. 320.08053 , other than the 50 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 3 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S presale voucher requirements in s. 320.08053(2)(b), and be 51 specifically authorized by an act of the Legislature. Collegiate 52 license plates must bear the colors and design approved by the 53 department as appropriate for each state and independent 54 university. The word "Florida" must be stamped across the bottom 55 of the plate in small letters. 56 (b) A collegiate plate annual use fee is to be distributed 57 to the state or independent university foundation designated by 58 the purchaser for deposit in an unrestrict ed account. The Board 59 of Governors of the State University System shall require each 60 state university to submit a plan for approval of the 61 expenditure of all funds so designated. These funds may be used 62 only for academic enhancement, including scholarships and 63 private fundraising activities. 64 (c) If a collegiate license plate has previously been 65 discontinued pursuant to s. 320.08056(8)(f), the department must 66 reauthorize the collegiate license plate if the state or 67 independent university resubmits the col legiate license plate 68 for authorization. 69 (47) LIVE THE DREAM LICENSE PLATES. — 70 (a) The department shall develop a Live the Dream license 71 plate as provided in this section. Live the Dream license plates 72 must bear the colors and design approved by the dep artment. Up to 5 percent may be distributed by the department to 79 the Martin Luther King, Jr. Center for Nonviolent Social Change, 80 Inc., also known as the King Center, as a royalty for the use of 81 the image of Dr. Martin Luther King, Jr used to administer, 82 promote, and market the license plate . 83 2. All remaining annual proceeds from the sale of the 84 plate shall be deposited into a separate account within the 85 Historical Resources Operating Trust Fund and must be used to 86 support the Historic Cemet eries Program established in s. 87 267.21. Such funds must be used to research, identify, and 88 record abandoned African -American cemeteries and provide grants 89 to eligible entities pursuant to s. 267.21(2) At least 25 90 percent shall be distributed equally among the sickle cell 91 organizations that are Florida members of the Sickle Cell 92 Disease Association of America, Inc., for programs that provide 93 research, care, and treatment for sickle cell disease . 94 3. At least 8 percent shall be used for programs and 95 services provided directly by the Dream Foundation, Inc., which 96 assist inmates released from the custody of a county jail in 97 this state or a Department of Corrections facility in 98 successfully reentering the community. 99 4. At least 20 percent shall be dist ributed as 105 scholarships to graduating high school seniors in this state who 106 have at least one parent or legal guardian who is incarcerated, 107 for the purpose of attending a state university, a Florida 108 College System institution, a career center operated by a school 109 district under s. 1001.44, or a charter technical career center 110 under s. 1002.34. Scholarships shall be awarded through a 111 competitive application process. Fiscal oversight of the 112 scholarship program shall be performed by a certified public 113 accounting firm. 114 6. At least 22 percent shall be distributed to Chapman 115 Partnership, Inc., for programs that provide relief from 116 poverty, hunger, and homelessness. 117 7. Up to 5 percent may be distributed by the department on 118 behalf of the Dream Foundation, Inc., to The Martin Luther King, 119 Jr. Center for Nonviolent Social Change, Inc., as a royalty for 120 the use of the image of Dr. Martin Luther King, Jr. 121 (95) AMERICAN EAGLE LICENSE PLATES. — 122 (a) The department shall develop an American Eagle license 123 plate as provided in this section and s. 320.08053. The plate 124 must bear the colors and design approved by the department. As used in this paragraph, the term "immediate 130 relative" means a spouse, domestic partner, or child. 131 2. To be eligible for issuance of a Divine Nine license 132 plate representing an organization listed in sub -subparagraphs 133 (b)3.a.-i., a person must be a resident of this state who is the 134 registered owner or lessee of a motor vehicle and who is either 135 a member or an immediate relative of a member of the applicable 136 organization. The person must also present the following: 137 a. Proof of membership in the organization, which may be 138 established by: 139 (I)a. A card distributed by the organization indicating 140 the person's membership in the organization; or 141 (II)b. A written letter on the organization's letterhead 142 which is signed by the organization's national president or his 143 or her designated official and which states that the person was 144 inducted into the organization. 145 b. If the person is a lessee of a motor vehicle, a lease 146 agreement and the vehicle identification number for the motor 147 vehicle being leased. 148 c. Proof of membership in an organization listed in sub -154 subparagraphs (b)3.a. -i. is required only for initial issuance 155 of a Divine Nine license plate. A person need not present such 156 proof for renewal of the license plate. 157 158 License plates created pursuant to this subsection shall have 159 their plate sales combined for the purpose of meeting the 160 minimum license plate sales threshold in s. 320.08056(8)(a) and 161 for determining the license plate limit in s. 3 20.08053(3)(b). 162 License plates created pursuant to this subsection must be 163 ordered directly from the department. 164 (107) UNIVERSAL ORLANDO RESORT GIVE KIDS THE WORLD LICENSE 165 PLATES.— 166 (a) The department shall develop a Universal Orlando 167 Resort Give Kids The World license plate as provided in this 168 section and s. 320.08053. The plate must bear the colors and 169 design approved by the department. The word "Florida" must 170 appear at the top of the plate, and the words " Universal Orlando 171 Resort Give Kids The World" must appear at the bottom of the 172 plate. 173 (b) The annual use fees from the sale of the plate shall 174 be distributed to Give Kids The World, Inc., a nonprofit 175 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 8 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S organization under s. 501(c)(3) of the Internal Revenue Code. Up 176 to 10 percent of the proceeds may be used for the promotion and 177 marketing of the plate. The remainder of the proceeds shall be 178 used by Give Kids The World, Inc., to support their mission of 179 providing week-long, cost-free vacations to children with 180 critical illnesses and their families. 181 (127) MARGARITAVILLE LICENSE PLATES. — 182 (a) The department shall develop a Margaritaville license 183 plate as provided in this section and s. 320.08053. The plate 184 must bear the colors and design approved by the department. The 185 word "Florida" must appear at the top of the plate, and the word 186 "Margaritaville" must appear at the bottom of the plate. 187 (b) The annual use fees from the sale of the plate must be 188 distributed to the SFC Charitable Foundation, Inc., also known 189 as Singing for Change, which may use up to 10 percent of such 190 fees for administrative costs and marketing of the plate. The 191 balance of the fees must be used by the SFC Charitable 192 Foundation, Inc., and must be distributed with the approval of 193 and accountability to the board of directors of the SFC 194 Charitable Foundation, Inc., to provide grants to nonprofit 195 organizations in communities impacted by natural or manmade 196 disasters for recovery, rebuilding, and future sustainability in 197 those communities and to promote and inspire local grassroots 198 leadership that will work to improve the quality of life in 199 those communities and others in this state. 200 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 9 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (128) CLEARWATER MARINE AQUARIUM LICENSE PLATES. — 201 (a) The department shall develop a Clearwater Marine 202 Aquarium license plate as provided in this section and s. 203 320.08053. The plate must bear the colors and design approved by 204 the department. The word "Florida" must appear at the top of the 205 plate, and the words "Clearwater Marine Aquarium" must appear at 206 the bottom of the plate. 207 (b) The annual use fees from the sale of the plate must be 208 distributed to Clearwater Marine Aquarium, Inc., a Florida 209 nonprofit corporation under s. 501(c)(3) of the Internal Revenue 210 Code, which may use up to 10 percent of the fees for the 211 administration, promotion, and marketing of the plate. The 212 remaining fees must be used by Clearwater Marine Aquarium, Inc., 213 to fund its efforts to rescue, rehabilitate, and release marine 214 life; provide environmental education; conduct research; and 215 promote conservation s trategies. 216 (129) GENERAL AVIATION LICENSE PLATES. — 217 (a) The department shall develop a General Aviation 218 license plate as provided in this section and s. 320.08053. The 219 plate must bear the colors and design approved by the 220 department. The word "Florida" must appear at the top of the 221 plate, and the words "Support General Aviation" must appear at 222 the bottom of the plate. 223 (b) The annual use fees from the sale of the plate must be 224 distributed to the Aerospace Center for Excellence located in 225 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 10 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Lakeland. The Aerospace Center for Excellence may use up to 10 226 percent of such fees for administrative costs and marketing of 227 the plate. The balance of the fees must be used by the Aerospace 228 Center for Excellence to fund scholarships for students in this 229 state who are pursuing careers in the field of aviation. 230 (130) THE VILLAGES: MAY ALL YOUR DREAMS COME TRUE LICENSE 231 PLATES.— 232 (a) The department shall develop a The Villages: May All 233 Your Dreams Come True license plate as provided in this section 234 and s. 320.08053. The p late must bear the colors and design 235 approved by the department. The word "Florida" must appear at 236 the top of the plate, and the words "The Villages: May All Your 237 Dreams Come True" must appear at the bottom of the plate. 238 (b) The annual use fees from the sale of the plate must be 239 distributed to The Villages Charter School, Inc., a Florida 240 nonprofit corporation. Up to 10 percent of the fees may be used 241 for administrative costs and marketing of the plate. The 242 remaining funds must be distributed with the appr oval of, and 243 accountability to, the board of directors of The Villages 244 Charter School, Inc., and must be used to provide support to The 245 Villages Charter School as it provides K -12 education. 246 (131) CURE DIABETES LICENSE PLATES. — 247 (a) The department shall develop a Cure Diabetes license 248 plate as provided in this section and s. 320.08053. The plate 249 must bear the colors and design approved by the department. The Diabetes Research Institute Foundation, which 255 supports the Diabetes Research Institute at the University of 256 Miami Miller School of Medicine; 257 2. The JDRF International Incorporated, which supports the 258 JDRF Northern Florida Chapter; and 259 3. The University of Florida Foundation, Inc., which 260 supports the University of Florida Diabetes Institute. 261 (c) Each organization may use up to 10 percent of the 262 proceeds received by the organization to promote and market the 263 plate. All remaining proceeds must be used for the purpose of 264 funding research to cure Type 1 diabetes. 265 (132) RECYCLE FLORIDA LICENSE PLATES. — 266 (a) The department shall develop a Recycle Florida license 267 plate as provided in this section and s. 320.08053. The plate 268 must bear the colors and design approved by the department. The 269 word "Florida" must appear at the top of the plate, and the 270 words "Recycle Florida" must appear at the bottom of the plate. 271 (b) The annual use fees from the sale of the plate must be 272 distributed to the Recycle Florida Today Foundation, Inc., which 273 may use up to 10 percent of such fees for administrative costs 274 and marketing of the plate. The balance of the fees must be used 275 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 12 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S by the Recycle Florida Today Foundation, Inc., to increase 276 public awareness about the importance of recycling, resource 277 conservation, and environmental stewardship; to promote robust, 278 comprehensive, and sustainab le recycling programs; and to 279 support the professional development of persons employed in 280 fields relating to recycling, conservation, and sustainability. 281 (133) BOATING CAPITAL OF THE WORLD LICENSE PLATES. — 282 (a) The department shall develop a Boating Cap ital of the 283 World license plate as provided in this section and s. 284 320.08053. The plate must bear the colors and design approved by 285 the department. The word "Florida" must appear at the top of the 286 plate, and the words "Boating Capital of the World" must ap pear 287 at the bottom of the plate. 288 (b) The annual use fees from the sale of the plate must be 289 distributed to Captain Sandy Yawn, Inc., which may use up to 10 290 percent of such fees for administrative costs and marketing of 291 the plate. The balance of the fees must be used by Captain Sandy 292 Yawn, Inc., to increase public awareness of employment 293 opportunities in the maritime industry; to fund maritime 294 workforce instruction and training; to promote professional 295 development and job placement in all sectors of mariti me 296 employment; and to support the advancement of education of 297 trainees in the maritime industry, both at sea and on land. 298 (134) PROJECT ADDICTION: REVERSING THE STIGMA LICENSE 299 PLATES.— 300 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 13 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (a) The department shall develop a Project Addiction: 301 Reversing the Stigma license plate as provided in this section 302 and s. 320.08053. The plate must bear the colors and design 303 approved by the department. The word "Florida" must appear at 304 the top of the plate, and the words " Overdose Awareness" must 305 appear at the bottom o f the plate. 306 (b) The annual use fees from the sale of the plate must be 307 distributed to Project Addiction: Reversing the Stigma, Inc., a 308 Florida nonprofit corporation, as follows: 309 1. Up to 10 percent of the annual use fees may be used for 310 the promotion and marketing costs of the license plate. 311 2. The remaining funds must be distributed with the 312 approval of and accountability to the board of directors of 313 Project Addiction: Reversing the Stigma, Inc., and must be used 314 to promote and support awareness of and education about 315 substance use disorder and mental illness. 316 (135) UNITED SERVICE ORGANIZATIONS (USO) LICENSE PLATES. — 317 (a) The department shall develop a United Service 318 Organizations (USO) license plate as provided in this section 319 and s. 320.08053. The plate must bear the colors and design 320 approved by the department. The word "Florida" must appear at 321 the top of the plate, and the acronym "USO" must appear at the 322 bottom of the plate. 323 (b) The annual use fees from the sale of the plate must be 324 distributed to United Service Organizations, Inc., a nonprofit 325 ENROLLED CS/CS/HB 403, Engrossed 1 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0403-04-er Page 14 of 14 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S corporation under s. 501(c)(3) of the Internal Revenue Code, 326 which may use up to 10 percent of the fees for administrative 327 costs and marketing of the plate. United Service Organizations, 328 Inc., must distribute the remainder of the fees equally among 329 its ten locations in this state to be used to promote its 330 mission of supporting members of the United States Armed Forces 331 and their families through its various programs, services, and 332 events. 333 Section 3. This act shall take effect October 1, 2024. 334
