26- Section 1. Section 843.22, Florida Statutes, is amended to 13

29-certain offenses a burglary.— 16
30- (1) As used in this section, the term : 17
31- (a) "county of residence" means the county within this 18
32-state in which a person resides. Evidence of a person's county 19
33-of residence includes, but is not limited to: 20
34- (a)1. The address on a person's driver license or state 21
35-identification card.; 22
36- (b)2. Records of real prop erty or mobile home ownership .; 23
37- (c)3. Records of a lease agreement for residential 24
38-property.; 25

25+ Section 1. Section 843.22, Florida Statutes, is amended to 12

51- (d)4. The county in which a person's motor vehicle is 26
52-registered.; 27
53- (e)5. The county in which a person is enrolled in an 28
54-educational institution .; and 29

56- (b) "Burglary" means burglary as defined in s. 810.02, 31
57-including an attempt, solicitation, or conspiracy to commit such 32
58-offense. 33
59- (2) If a person who commits a grand theft or a forcible 34
60-felony, as defined in s . 776.08, burglary travels any distance 35
61-with the intent to commit the offense burglary in a county in 36
62-this state other than the person's county of residence, the 37
63-degree of the offense burglary shall be reclassified to the next 38
64-higher degree. For purposes o f sentencing under chapter 921 and 39
65-determining incentive gain -time eligibility under chapter 944, 40
66-an offense a burglary that is reclassified under this section is 41
67-ranked one level above the ranking specified in s. 921.0022 or 42
68-s. 921.0023 for the offense burglary committed. 43
69-(3) This section does not apply to a first -time offender 44
70-or to a person previously convicted of not more than one 45
71-nonviolent misdemeanor when he or she is charged with a felony 46
72-of the third degree unless he or she is also charged with 47
73-conspiracy as defined in s. 777.04(3). 48
74- Section 2. This act shall take effect upon becoming a law. 49
