24	24		Be It Enacted by the Legislature of the State of Florida: 11

26	26		Section 1. Present paragraph (i) of subsection (2) of 13
27	27		section 364.10, Florida Statutes, is redesignated as subsection 14
28	28		(4) of that section, subsection (3) is added to that section, 15
29	29		and paragraph (a) of subsection (1) of that section is amended, 16
30	30		to read: 17
31	31		364.10 Lifeline service. — 18
32	32		(1)(a) An eligible telecommunications carrier shall 19
33	33		provide a Lifeline Assistance Plan to qualified residential 20
34	34		subscribers, as defined in the eligible telecommunicat ions 21
35	35		carrier's published schedules. For the purposes of this section, 22
36	36		the term "eligible telecommunications carrier" means an entity a 23
37	37		telecommunications company, as defined by s. 364.02, which is 24
38	38		designated as an eligible telecommunications carrier by the 25

51	51		commission pursuant to 47 C.F.R. s. 54.201 and this section. 26
52	52		(3)(a) The commission has the power and authority to 27
53	53		designate an entity, upon petition and in accordance with 47 28
54	54		C.F.R. s. 54.201, as an eligible telecommunications carrier, 29
55	55		provided that such entity is: 30
56	56		1. A telecommunications company; or 31
57	57		2. A commercial mobile radio service provider. 32
58	58		(b) This legislative authority is intended to be 33
59	59		sufficient to enable the commission, for the limited purpose of 34
60	60		providing Lifeline service under this sec tion, to approve any of 35
61	61		the types of entities specified in paragraph (a) as an eligible 36
62		-	telecommunications carrier. 37
63		-	Section 2. This act shall take effect upon becoming a law. 38
	62	+	telecommunications carrier. The commission may exercise such 37
	63	+	authority in addition to the commission jurisdiction otherwise 38
	64	+	specified in this chapter. 39
	65	+	(c) This subsection does not confer upon the commission 40
	66	+	any regulatory jurisdiction over commercial mobile radio service 41
	67	+	providers that were previously designated as eligible 42
	68	+	telecommunications carriers before the enactment of this 43
	69	+	subsection. 44
	70	+	Section 2. This act sha ll take effect upon becoming a law. 45
