eligible telecommunications carriers for a specified 7
purpose; providing legislative intent; providing an 8
effective date. 9

Be It Enacted by the Leg islature of the State of Florida: 11

Section 1. Present paragraph (i) of subsection (2) of 13
section 364.10, Florida Statutes, is redesignated as subsection 14
(4) of that section, subsection (3) is added to that section, 15
and paragraph (a) of subsection (1) o f that section is amended, 16
to read: 17
364.10 Lifeline service. — 18
(1)(a) An eligible telecommunications carrier shall 19
provide a Lifeline Assistance Plan to qualified residential 20
subscribers, as defined in the eligible telecommunications 21
carrier's published schedules. For the purposes of this section, 22
the term "eligible telecommunications carrier" means an entity a 23
telecommunications company, as defined by s. 364.02, which is 24
designated as an eligible telecommunications carrier by the 25

commission pursuant to 47 C.F.R. s. 54.201 and this section. 26
(3)(a) The commission has the power and authority to 27
designate an entity, upon petition and in accordance with 47 28
C.F.R. s. 54.201, as an eligible telecommunications carrier, 29
provided that such entity is: 30
1. A telecommunications company; or 31
2. A commercial mobile radio service provider. 32
(b) This legislative authority is intended to be 33
sufficient to enable the commission, for the limited purpose of 34
providing Lifeline service under this section, to approve any of 35
the types of entities specified in paragraph (a) as an eligible 36
telecommunications carrier. 37
Section 2. This act shall take effect upon becoming a law. 38
