2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Section 564.05, Florida Statutes, is amended to 10
2424 read: 11
2525 564.05 Limitation of size of individual wine containers; 12
2626 penalty.—It is unlawful for a person to sell within this state 13
2727 wine in an individual container holding more than 1 gallon of 14
2828 such wine, unless such wine is in a reusable container holding 15
2929 5.16 gallons or a glass container holding 4.5 liters, 6 liters, 16
3030 9 liters, 12 liters, or 15 liters. However, qualified 17
3131 distributors and manufacturers may sell wine to other qualified 18
3232 distributors or manufacturers in any size container. Except as 19
3333 provided in s. 564.09, wine sold or offered for sale by a 20
3434 licensed vendor to be consumed off the premises shall be in the 21
3535 unopened original container. A person convicted of a violation 22
3636 of this section commits a misdemeanor of the second degree, 23
3737 punishable as provided in s. 775.082 or s. 775.083. 24
3838 Section 2. This act shall take effect July 1, 2024. 25
