2424 Be It Enacted by the Legislature of the State of Florida: 13

2626 Section 1. Notwithstanding s. 561.20(1), Florida Statutes, 15
2727 the Division of Alcoholic Bev erages and Tobacco of the 16
2828 Department of Business and Professional Regulation shall issue a 17
2929 special alcoholic beverage license to a bona fide restaurant 18
3030 located within the jurisdictional boundaries of the Town of 19
3131 Horseshoe Beach which is licensed by the Div ision of Hotels and 20
3232 Restaurants, occupies at least 1,700 square feet of contiguous 21
3333 space used as a part of the food service establishment, is 22
3434 equipped to serve meals to 50 persons at one time, and derives 23
3535 at least 51 percent of its gross food and beverage revenue from 24
3636 the sale of food and nonalcoholic beverages during the first 60 -25

4747 day operating period and each 12 -month operating period 26
4848 thereafter. Failure of a licensee who is issued this special 27
4949 license to meet the required percentage of food and nonalcohol ic 28
5050 beverage gross revenues during the applicable operating period 29
5151 shall result in the revocation of the license or denial of the 30
5252 pending application for a permanent license of a licensee 31
5353 operating with a temporary license. A licensee whose license is 32
5454 revoked, or an applicant whose pending application for a 33
5555 permanent license is denied, or any person required to qualify 34
5656 on the special food service alcohol license application, is 35
5757 ineligible to have any interest in a subsequent application for 36
5858 such license for 120 days after the date of the final denial or 37
5959 revocation. 38
6060 Section 2. This act shall take effect upon becoming a law. 39
