24 | 24 | | Be It Enacted by the Legislature of the State of Florida: 13 |

26 | 26 | | Section 1. Notwithstanding s. 561.20(1), Florida Statutes, 15 |
---|
27 | 27 | | the Division of Alcoholic Bev erages and Tobacco of the 16 |
---|
28 | 28 | | Department of Business and Professional Regulation shall issue a 17 |
---|
29 | 29 | | special alcoholic beverage license to a bona fide restaurant 18 |
---|
30 | 30 | | located within the jurisdictional boundaries of the Town of 19 |
---|
31 | 31 | | Horseshoe Beach which is licensed by the Div ision of Hotels and 20 |
---|
32 | 32 | | Restaurants, occupies at least 1,700 square feet of contiguous 21 |
---|
33 | 33 | | space used as a part of the food service establishment, is 22 |
---|
34 | 34 | | equipped to serve meals to 50 persons at one time, and derives 23 |
---|
35 | 35 | | at least 51 percent of its gross food and beverage revenue from 24 |
---|
36 | 36 | | the sale of food and nonalcoholic beverages during the first 60 -25 |

48 | 48 | | thereafter. Failure of a licensee who is issued this special 27 |

49 | 49 | | license to meet the required percentage of food and nonalcohol ic 28 |

50 | 50 | | beverage gross revenues during the applicable operating period 29 |

51 | 51 | | shall result in the revocation of the license or denial of the 30 |
---|
52 | 52 | | pending application for a permanent license of a licensee 31 |
---|
53 | 53 | | operating with a temporary license. A licensee whose license is 32 |
---|
54 | 54 | | revoked, or an applicant whose pending application for a 33 |
---|
55 | 55 | | permanent license is denied, or any person required to qualify 34 |
---|
56 | 56 | | on the special food service alcohol license application, is 35 |
---|
57 | 57 | | ineligible to have any interest in a subsequent application for 36 |
---|
58 | 58 | | such license for 120 days after the date of the final denial or 37 |
---|
59 | 59 | | revocation. 38 |

60 | 60 | | Section 2. This act shall take effect upon becoming a law. 39 |
