An act relating to the Town of Horseshoe Beach, Dixie 2 
County; providing an exception to general law; 3 
requiring the Division of Alcoholic Beverages and 4 
Tobacco of the Department of Business and Professional 5 
Regulation to issue a special alcoholic beverage 6 
license to certain restaurants in the town which meet 7 
certain space, seating, and minimum gross revenue 8 
requirements; providing conditions for revocatio n of 9 
such license or denial of a pending application for 10 
such license; providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Notwithstanding s. 561.20(1), Florida Statutes, 15 
the Division of Alcoholic Bev erages and Tobacco of the 16 
Department of Business and Professional Regulation shall issue a 17 
special alcoholic beverage license to a bona fide restaurant 18 
located within the jurisdictional boundaries of the Town of 19 
Horseshoe Beach which is licensed by the Div ision of Hotels and 20 
Restaurants, occupies at least 1,700 square feet of contiguous 21 
space used as a part of the food service establishment, is 22 
equipped to serve meals to 50 persons at one time, and derives 23 
at least 51 percent of its gross food and beverage revenue from 24 
the sale of food and nonalcoholic beverages during the first 60 -25

day operating period and each 12 -month operating period 26 
thereafter. Failure of a licensee who is issued this special 27 
license to meet the required percentage of food and nonalcohol ic 28 
beverage gross revenues during the applicable operating period 29 
shall result in the revocation of the license or denial of the 30 
pending application for a permanent license of a licensee 31 
operating with a temporary license. A licensee whose license is 32 
revoked, or an applicant whose pending application for a 33 
permanent license is denied, or any person required to qualify 34 
on the special food service alcohol license application, is 35 
ineligible to have any interest in a subsequent application for 36 
such license for 120 days after the date of the final denial or 37 
revocation. 38 
 Section 2.  This act shall take effect upon becoming a law. 39
