Section 115.09, Florida Sta tutes, is amended to 11 read: 12 115.09 Leave to public officials for military service. —All 13 officials of the state, the several counties of the state, and 14 the municipalities or political subdivisions of the state, 15 including district school and community colleg e officers, which 16 officials are also servicemembers in the National Guard or a 17 reserve component of the Armed Forces of the United States, 18 shall be granted leave of absence from their respective offices 19 and duties to perform active military service, the fi rst 30 days 20 of any such leave of absence to be with full pay for active 21 federal military service that is 90 consecutive days or more . 22 Section 2. Section 115.14, Florida Statutes, is amended to 23 read: 24 115.14 Employees.—All employees of the state, the s everal 25 HB 765 2024 CODING: Words stricken are deletions; words underlined are additions. hb0765-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S counties of the state, and the municipalities or political 26 subdivisions of the state shall be granted leave of absence 27 under the terms of this law; upon such leave of absence being 28 granted said employee shall enjoy the same rights and privileges 29 as are hereby granted to officials under this law, insofar as 30 may be, including, without limitation, receiving full pay for 31 the first 30 days for active federal military service that is 90 32 consecutive days or more . Notwithstanding the provisions of s. 33 115.09, the employing authority may supplement the military pay 34 of its officials and employees who are reservists called to 35 active military service after the first 30 days in an amount 36 necessary to bring their total salary, inclusive of their base 37 military pay, to the level earned at the time they were called 38 to active military duty. The employing authority shall continue 39 to provide all health insurance and other existing benefits to 40 such officials and employees as required by the Uniformed 41 Services Employment and Reemployment Rights Act, chapter 43 of 42 Title 38 U.S.C. 43 Section 3. This act shall take effect July 1, 2024. 44
