2525 Be It Enacted by the Legislature of the State of Florida: 14

2727 Section 1. Subsection (3) is added to section 6 of section 16
2828 2 of chapter 2001-333, Laws of Florida, as amended by chapter 17
2929 2007-311, Laws of Florida, to read: 18
3030 Section 6. Financial matters. — 19
3131 (3) IMPACT FEES.—If the general purpose local government 20
3232 has not adopted an impact fee for fire services which is 21
3333 distributed to the dist rict for construction within its 22
3434 jurisdictional boundaries, the board may establish a schedule of 23
3535 impact fees for new construction to pay for the cost of new 24
3636 facilities and equipment, the need for which is in whole or in 25

4747 part the result of new construction . The impact fees collected 26
4848 by the district under this subsection shall be kept separate 27
4949 from other revenues of the district and must be used exclusively 28
5050 to acquire, purchase, or construct new facilities or portions 29
5151 thereof needed to provide fire protectio n and emergency services 30
5252 to new construction. As used in this subsection, the term "new 31
5353 facilities" means land, buildings, and capital equipment, 32
5454 including, but not limited to, fire and emergency vehicles, 33
5555 radio telemetry equipment, and other firefighting or rescue 34
5656 equipment. The board shall maintain adequate records to ensure 35
5757 that impact fees are expended only for permissible new 36
5858 facilities or equipment. The board may enter into agreements 37
5959 with general purpose local governments to share in the revenues 38
6060 from fire protection impact fees imposed by such governments. 39
6161 Section 2. This act shall take effect upon becoming a law. 40
