Subsection (3) is added to section 6 of section 16 2 of chapter 2001-333, Laws of Florida, as amended by chapter 17 2007-311, Laws of Florida, to read: 18 Section 6. Financial matters. — 19 (3) IMPACT FEES.—If the general purpose local government 20 has not adopted an impact fee for fire services which is 21 distributed to the dist rict for construction within its 22 jurisdictional boundaries, the board may establish a schedule of 23 impact fees for new construction to pay for the cost of new 24 facilities and equipment, the need for which is in whole or in 25 ENROLLED HB 823 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0823-01-er Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S part the result of new construction . The impact fees collected 26 by the district under this subsection shall be kept separate 27 from other revenues of the district and must be used exclusively 28 to acquire, purchase, or construct new facilities or portions 29 thereof needed to provide fire protectio n and emergency services 30 to new construction. As used in this subsection, the term "new 31 facilities" means land, buildings, and capital equipment, 32 including, but not limited to, fire and emergency vehicles, 33 radio telemetry equipment, and other firefighting or rescue 34 equipment. The board shall maintain adequate records to ensure 35 that impact fees are expended only for permissible new 36 facilities or equipment. The board may enter into agreements 37 with general purpose local governments to share in the revenues 38 from fire protection impact fees imposed by such governments. 39 Section 2. This act shall take effect upon becoming a law. 40
