2828 Be It Enacted by the Legislature of the State of Flo rida: 15
2929 16
3030 Section 1. (1) Notwithstanding any other law to the 17
3131 contrary, this act and all rules adopted pursuant to this act 18
3232 apply to the area located within St. Lucie County. 19
3333 (2) As used in this act, the term: 20
3434 (a) "Air ambulance" means a fixed -wing or rotary-wing 21
3535 aircraft used for, or intended to be used for, air 22
3636 transportation of sick or injured persons requiring or likely to 23
3737 require medical attention during transport. 24
3838 (b) "Ambulance" or "emergency medical services vehicle" 25

5151 means a privately or pub licly owned vehicle or vessel that is 26
5252 designed, constructed, reconstructed, maintained, equipped, or 27
5353 operated for, and is used for, or intended to be used for, land 28
5454 or water transportation of sick or injured persons requiring or 29
5555 likely to require medical a ttention during transport. 30
5656 (c) "Emergency medical transportation services" includes, 31
5757 but is not limited to, services rendered by means of an 32
5858 ambulance, emergency medical services vehicle, or air ambulance. 33
5959 (d) "Health care provider" means: 34
6060 1. A hospital licensed under chapter 395, Florida 35
6161 Statutes. 36
6262 2. A physician or physician assistant licensed under 37
6363 chapter 458, Florida Statutes. 38
6464 3. An osteopathic physician or physician assistant 39
6565 licensed under chapter 459, Florida Statutes. 40
6666 4. A podiatric phys ician licensed under chapter 461, 41
6767 Florida Statutes. 42
6868 5. A health maintenance organization certificated under 43
6969 part I of chapter 641, Florida Statutes. 44
7070 6. An ambulatory surgical center licensed under chapter 45
7171 395, Florida Statutes. 46
7272 7. An other medical facility as defined in paragraph (e). 47
7373 8. A professional association, partnership, corporation, 48
7474 joint venture, or other association composed of the persons 49
7575 provided in subparagraphs 2., 3., and 4. for professional 50

8989 (e) "Other medical facility" means a facility the primary 52
9090 purpose of which is to provide human medical diagnostic services 53
9191 or a facility providing nonsurgical human medical treatment, to 54
9292 which facility the patient is admitted and from which facility 55
9393 the patient is discharged within th e same working day, and which 56
9494 facility is not part of a hospital. However, a facility existing 57
9595 for the primary purpose of performing terminations of pregnancy 58
9696 or an office maintained by a physician or dentist for the 59
9797 practice of medicine may not be constru ed to be an "other 60
9898 medical facility." 61
9999 (3) Compensation to a health care provider to provide 62
100100 medical services for an inmate housed in a St. Lucie County 63
101101 detention center may not exceed 110 percent of the Medicare 64
102102 allowable rate if the health care provider does not have a 65
103103 contract with St. Lucie County to provide inmate medical 66
104104 services. However, compensation to a health care provider may 67
105105 not exceed 125 percent of the Medicare allowable rate if: 68
106106 (a) The health care provider does not have a contract with 69
107107 St. Lucie County to provide inmate medical services; and 70
108108 (b) The health care provider reported a negative operating 71
109109 margin for the previous year to the Agency for Health Care 72
110110 Administration through hospital -audited financial data. 73
111111 (4) Compensation to an entity to provide emergency medical 74
112112 transportation services for an inmate housed in a St. Lucie 75

129129 (5) This act does not apply to charges for medical 80
130130 services provided at a hospital operated by St. Lucie County. 81
131131 Section 2. This act shall take effect upon becoming a law. 82
