19	19		St. Lucie County detention center if the provider does 6
20	20		not have a contract with the county to provide such 7
21	21		services; limiting compensation to an entity that 8
22	22		provides emergency medical transportation servi ces for 9
23	23		an inmate housed in a St. Lucie County detention 10
24	24		center if the entity does not have a contract with the 11
25	25		county to provide such services; providing 12
26	26		applicability; providing an effective date. 13

28	28		Be It Enacted by the Legislature of the State of Flo rida: 15

30	30		Section 1. (1) Notwithstanding any other law to the 17
31	31		contrary, this act and all rules adopted pursuant to this act 18
32	32		apply to the area located within St. Lucie County. 19
33	33		(2) As used in this act, the term: 20
34	34		(a) "Air ambulance" means a fixed -wing or rotary-wing 21
35	35		aircraft used for, or intended to be used for, air 22
36	36		transportation of sick or injured persons requiring or likely to 23
37	37		require medical attention during transport. 24
38	38		(b) "Ambulance" or "emergency medical services vehicle" 25

51	51		means a privately or pub licly owned vehicle or vessel that is 26
52	52		designed, constructed, reconstructed, maintained, equipped, or 27
53	53		operated for, and is used for, or intended to be used for, land 28
54	54		or water transportation of sick or injured persons requiring or 29
55	55		likely to require medical a ttention during transport. 30
56	56		(c) "Emergency medical transportation services" includes, 31
57	57		but is not limited to, services rendered by means of an 32
58	58		ambulance, emergency medical services vehicle, or air ambulance. 33
59	59		(d) "Health care provider" means: 34
60	60		1. A hospital licensed under chapter 395, Florida 35
61	61		Statutes. 36
62	62		2. A physician or physician assistant licensed under 37
63	63		chapter 458, Florida Statutes. 38
64	64		3. An osteopathic physician or physician assistant 39
65	65		licensed under chapter 459, Florida Statutes. 40
66	66		4. A podiatric phys ician licensed under chapter 461, 41
67	67		Florida Statutes. 42
68	68		5. A health maintenance organization certificated under 43
69	69		part I of chapter 641, Florida Statutes. 44
70	70		6. An ambulatory surgical center licensed under chapter 45
71	71		395, Florida Statutes. 46
72	72		7. An other medical facility as defined in paragraph (e). 47
73	73		8. A professional association, partnership, corporation, 48
74	74		joint venture, or other association composed of the persons 49
75	75		provided in subparagraphs 2., 3., and 4. for professional 50

89	89		(e) "Other medical facility" means a facility the primary 52
90	90		purpose of which is to provide human medical diagnostic services 53
91	91		or a facility providing nonsurgical human medical treatment, to 54
92	92		which facility the patient is admitted and from which facility 55
93	93		the patient is discharged within th e same working day, and which 56
94	94		facility is not part of a hospital. However, a facility existing 57
95	95		for the primary purpose of performing terminations of pregnancy 58
96	96		or an office maintained by a physician or dentist for the 59
97	97		practice of medicine may not be constru ed to be an "other 60
98	98		medical facility." 61
99	99		(3) Compensation to a health care provider to provide 62
100	100		medical services for an inmate housed in a St. Lucie County 63
101	101		detention center may not exceed 110 percent of the Medicare 64
102	102		allowable rate if the health care provider does not have a 65
103	103		contract with St. Lucie County to provide inmate medical 66
104	104		services. However, compensation to a health care provider may 67
105	105		not exceed 125 percent of the Medicare allowable rate if: 68
106	106		(a) The health care provider does not have a contract with 69
107	107		St. Lucie County to provide inmate medical services; and 70
108	108		(b) The health care provider reported a negative operating 71
109	109		margin for the previous year to the Agency for Health Care 72
110	110		Administration through hospital -audited financial data. 73
111	111		(4) Compensation to an entity to provide emergency medical 74
112	112		transportation services for an inmate housed in a St. Lucie 75

126	126		Medicare allowable rate if the entity does not have a contract 77
127	127		with St. Lucie County to provide inmat e emergency medical 78

129	129		(5) This act does not apply to charges for medical 80
130	130		services provided at a hospital operated by St. Lucie County. 81
131	131		Section 2. This act shall take effect upon becoming a law. 82
