ENROLLED HB 1023 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1023-01-er Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to St. Lucie County; providing an 2 exception to general law; providing definitions; 3 limiting compensation to a health care provider that 4 provides medical services for an inmate housed in a 5 St. Lucie County detention center if the provider does 6 not have a contract with the county to provide such 7 services; limiting compensation to an entity that 8 provides emergency medical transportation servi ces for 9 an inmate housed in a St. Lucie County detention 10 center if the entity does not have a contract with the 11 county to provide such services; providing 12 applicability; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Flo rida: 15 16 Section 1. (1) Notwithstanding any other law to the 17 contrary, this act and all rules adopted pursuant to this act 18 apply to the area located within St. Lucie County. 19 (2) As used in this act, the term: 20 (a) "Air ambulance" means a fixed -wing or rotary-wing 21 aircraft used for, or intended to be used for, air 22 transportation of sick or injured persons requiring or likely to 23 require medical attention during transport. 24 (b) "Ambulance" or "emergency medical services vehicle" 25 ENROLLED HB 1023 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1023-01-er Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S means a privately or pub licly owned vehicle or vessel that is 26 designed, constructed, reconstructed, maintained, equipped, or 27 operated for, and is used for, or intended to be used for, land 28 or water transportation of sick or injured persons requiring or 29 likely to require medical a ttention during transport. 30 (c) "Emergency medical transportation services" includes, 31 but is not limited to, services rendered by means of an 32 ambulance, emergency medical services vehicle, or air ambulance. 33 (d) "Health care provider" means: 34 1. A hospital licensed under chapter 395, Florida 35 Statutes. 36 2. A physician or physician assistant licensed under 37 chapter 458, Florida Statutes. 38 3. An osteopathic physician or physician assistant 39 licensed under chapter 459, Florida Statutes. 40 4. A podiatric phys ician licensed under chapter 461, 41 Florida Statutes. 42 5. A health maintenance organization certificated under 43 part I of chapter 641, Florida Statutes. 44 6. An ambulatory surgical center licensed under chapter 45 395, Florida Statutes. 46 7. An other medical facility as defined in paragraph (e). 47 8. A professional association, partnership, corporation, 48 joint venture, or other association composed of the persons 49 provided in subparagraphs 2., 3., and 4. for professional 50 ENROLLED HB 1023 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1023-01-er Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S activity. 51 (e) "Other medical facility" means a facility the primary 52 purpose of which is to provide human medical diagnostic services 53 or a facility providing nonsurgical human medical treatment, to 54 which facility the patient is admitted and from which facility 55 the patient is discharged within th e same working day, and which 56 facility is not part of a hospital. However, a facility existing 57 for the primary purpose of performing terminations of pregnancy 58 or an office maintained by a physician or dentist for the 59 practice of medicine may not be constru ed to be an "other 60 medical facility." 61 (3) Compensation to a health care provider to provide 62 medical services for an inmate housed in a St. Lucie County 63 detention center may not exceed 110 percent of the Medicare 64 allowable rate if the health care provider does not have a 65 contract with St. Lucie County to provide inmate medical 66 services. However, compensation to a health care provider may 67 not exceed 125 percent of the Medicare allowable rate if: 68 (a) The health care provider does not have a contract with 69 St. Lucie County to provide inmate medical services; and 70 (b) The health care provider reported a negative operating 71 margin for the previous year to the Agency for Health Care 72 Administration through hospital -audited financial data. 73 (4) Compensation to an entity to provide emergency medical 74 transportation services for an inmate housed in a St. Lucie 75 ENROLLED HB 1023 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1023-01-er Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S County detention center may not exceed 110 percent of the 76 Medicare allowable rate if the entity does not have a contract 77 with St. Lucie County to provide inmat e emergency medical 78 transportation services. 79 (5) This act does not apply to charges for medical 80 services provided at a hospital operated by St. Lucie County. 81 Section 2. This act shall take effect upon becoming a law. 82
