2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Section 29.0185, Florida Statutes, is amended 14
2828 to read: 15
2929 29.0185 Provision of state -funded due process services to 16
3030 individuals.— 17
3131 (1) Due process services may not be provided with state 18
3232 revenues to an individual unless the individual on whose behalf 19
3333 the due process services are being provided is eligible for 20
3434 court-appointed counsel under s. 27.40, based upon a 21
3535 determination of indigency under s. 27.52, regardless of whether 22
3636 such counsel is appointed or the individual on whose behalf the 23
3737 due process services are being provided is eligible for court -24
3838 appointed counsel under s. 27.40 and has been determined 25

5252 (2) Notwithstanding subsection (1), state revenues may be 27
5353 used by the state courts system to provide court -appointed 28
5454 interpreting services to nonindigent individuals if funds are 29
5555 available in the fiscal year appropriation for due pr ocess 30
5656 services and if interpreting services are provided as prescribed 31
5757 by the Supreme Court. 32
5858 Section 2. Section 29.0195, Florida Statutes, is amended 33
5959 to read: 34
6060 29.0195 Recovery of expenditures for state -funded 35
6161 services.— 36
6262 (1) The trial court administ rator of each circuit shall 37
6363 recover expenditures for state -funded services when those 38
6464 services have been furnished to a user of the state court system 39
6565 who possesses the present ability to pay. The rate of 40
6666 compensation for such services is shall be the actual cost of 41
6767 the services, including the cost of recovery. The trial court 42
6868 administrator shall deposit moneys recovered under this section 43
6969 in the Administrative Trust Fund within the state courts system. 44
7070 The trial court administrator shall recover the costs of court 45
7171 reporter services and transcription; translations court 46
7272 interpreter services, including translation ; and any other 47
7373 service for which state funds were used to provide a product or 48
7474 service within the circuit. 49
7575 (2) This section does not authorize co st recovery for 50
