3838 Section 1. Section 251.002, Florida Statutes, is created 25

5252 251.002 Florida State Guard applicants; criminal history 27

5454 (1) Each applicant for the Florida State Guard must submit 29
5555 a complete set of fingerprints to the Division of the State 30
5656 Guard or to the vendor, entity, or agency authorized by s. 31
5757 943.053(13) to accept electronic fingerprints. The division, 32
5858 vendor, entity, or agency, as applicable, shall forward the 33
5959 fingerprints to the Department of Law Enforcement for state 34
6060 processing, and the Department of Law Enforcement shall forward 35
6161 the fingerprints to the Federal Bureau of Investigation for a 36
6262 national criminal history record check. 37
6363 (2) The Department of Military Affairs shall, and the 38
6464 Division of the State Guard may, review the results of the state 39
6565 and national criminal history record checks and determine 40
6666 whether the applicant meets the specified qualifications to 41
6767 serve in the Florida State Guard. 42
6868 (3) Fees for state and federal fingerprint processing and 43
6969 retention must be borne by the Division of the State Guard. The 44
7070 state cost for fingerprint processing must be as provided in s. 45
7171 943.053(3)(e). 46
7272 (4) Fingerprints submitted to the Department of Law 47
7373 Enforcement pursuant to this section must be retained by the 48
7474 Department of Law Enforcement as provided in s. 943.05(2)(g) and 49
7575 (h) along with enrollment of the fingerpri nts in the Federal 50
