An act relating to the Florida State Guard; creating 2 
s. 251.002, F.S.; requiring each applicant for the 3 
Florida State Guard to submit a complete set of 4 
fingerprints to the Division of the State Guard or to 5 
a certain vendor, entity, or agency; requiring 6 
fingerprints to be forwarded to the Department of Law 7 
Enforcement for state processing and to the Federal 8 
Bureau of Investigation for a national criminal 9 
history record check; requiring the Department of 10 
Military Affairs, and authorizing the division, to 11 
review certain results and make a specified 12 
determination; requiring the division to bear the fees 13 
for state and federal fingerprint processing and 14 
retention; specifying the state cost for fingerprint 15 
processing; requiring retention of fingerprints by the 16 
Department of Law Enforcement and enrollment of the 17 
fingerprints in the Federal Bureau of Investigation's 18 
national retained print arrest notification progra m; 19 
requiring an identified arrest record to be reported 20 
to the division; providing an effective date. 21

Be It Enacted by the Legislature of the State of Florida: 23 
 24 
 Section 1.  Section 251.002, Florida Statutes, is created 25

 251.002  Florida State Guard applicants; criminal history 27 
record checks.— 28 
 (1)  Each applicant for the Florida State Guard must submit 29 
a complete set of fingerprints to the Division of the State 30 
Guard or to the vendor, entity, or agency authorized by s. 31 
943.053(13) to accept electronic fingerprints. The division, 32 
vendor, entity, or agency, as applicable, shall forward the 33 
fingerprints to the Department of Law Enforcement for state 34 
processing, and the Department of Law Enforcement shall forward 35 
the fingerprints to the Federal Bureau of Investigation for a 36 
national criminal history record check. 37 
 (2)  The Department of Military Affairs shall, and the 38 
Division of the State Guard may, review the results of the state 39 
and national criminal history record checks and determine 40 
whether the applicant meets the specified qualifications to 41 
serve in the Florida State Guard. 42 
 (3)  Fees for state and federal fingerprint processing and 43 
retention must be borne by the Division of the State Guard. The 44 
state cost for fingerprint processing must be as provided in s. 45 
943.053(3)(e). 46 
 (4)  Fingerprints submitted to the Department of Law 47 
Enforcement pursuant to this section must be retained by the 48 
Department of Law Enforcement as provided in s. 943.05(2)(g) and 49 
(h) along with enrollment of the fingerpri nts in the Federal 50

 Section 2.  This act shall take effect upon becoming a law. 54
