Section 251.002, Florida Statutes, is created 25 ENROLLED CS/HB 1551 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1551-02-er Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S to read: 26 251.002 Florida State Guard applicants; criminal history 27 record checks.— 28 (1) Each applicant for the Florida State Guard must submit 29 a complete set of fingerprints to the Division of the State 30 Guard or to the vendor, entity, or agency authorized by s. 31 943.053(13) to accept electronic fingerprints. The division, 32 vendor, entity, or agency, as applicable, shall forward the 33 fingerprints to the Department of Law Enforcement for state 34 processing, and the Department of Law Enforcement shall forward 35 the fingerprints to the Federal Bureau of Investigation for a 36 national criminal history record check. 37 (2) The Department of Military Affairs shall, and the 38 Division of the State Guard may, review the results of the state 39 and national criminal history record checks and determine 40 whether the applicant meets the specified qualifications to 41 serve in the Florida State Guard. 42 (3) Fees for state and federal fingerprint processing and 43 retention must be borne by the Division of the State Guard. Any arrest record identified must be 52 reported to the Division of the State Guard. 53 Section 2. This act shall take effect upon becoming a law. 54
