Paragraphs (c) and (d) of subsection (2) of 17 section 379.2273, Florida Statutes, are redesignated as 18 paragraphs (d) and (e), respectively, and a new paragraph (c) is 19 added to that subsection, and subsection (4) of that section is 20 amended, to read: 21 379.2273 Florida Red Tide Mitigation and Technology 22 Development Initiative; Initiative Technology Advisory Council. — 23 (2) The Florida Red Tide Mitigation and Technology 24 Development Initiative is established as a partnership between 25 HB 1565 2024 CODING: Words stricken are deletions; words underlined are additions. hb1565-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S the Fish and Wildlife Research Institute within the commission 26 and Mote Marine Laboratory. 27 (c) Upon successful completion of science -based laboratory 28 testing of prevention, control, and mitigation approaches and 29 technologies, the initiative shall develop field tri al 30 deployment technologies for the approaches and technologies. 31 When the initiative develops a field trial deployment 32 technology, the initiative shall submit a report with its 33 findings to the department. Within 30 business days after 34 receipt of the report, the department shall review the 35 technology and approve, approve with conditions, or deny with 36 explanation the use of the technology in state waters exhibiting 37 red tide bloom concentrations of greater than 10,000 cells per 38 liter. If the department fails to approve, approve with 39 conditions, or deny with explanation a field trial deployment 40 technology within 30 business days after receipt of the report, 41 the technology shall be deemed approved for use in state waters 42 exhibiting red tide bloom concentrations of greater than 10,000 43 cells per liter. 44 (4) This section expires June 30, 2027 2025. 45 Section 2.
