3131 Be It Enacted by the Legislature of the State of Florida: 18

3333 Section 1. Paragraphs (c) and (d) of subsection (2) of 20
3434 section 379.2273, Florida Statutes, are redesig nated as 21
3535 paragraphs (d) and (e), respectively, and a new paragraph (c) is 22
3636 added to that subsection, and subsection (4) of that section is 23
3737 amended, to read: 24

5252 (2) The Florida Red Tide Mitigation and Technology 27
5353 Development Initiative is established as a partnership between 28
5454 the Fish and Wildlife Research Institute within the commission 29
5555 and Mote Marine Laboratory. 30
5656 (c) Upon successful completi on of science-based laboratory 31
5757 testing of prevention, control, and mitigation technologies and 32
5858 approaches, the initiative shall develop recommendations for 33
5959 field trial deployment of the technologies and approaches in 34
6060 state waters. The initiative shall subm it a report on its 35
6161 findings and recommendations to the department, the commission, 36
6262 the Department of Agriculture and Consumer Services, and other 37
6363 state agencies with regulatory oversight of field trial 38
6464 deployment of the technologies and approaches in state waters. 39
6565 The department shall evaluate the technologies and approaches 40
6666 and identify all existing state permits Mote Marine Laboratory 41
6767 may use to deploy and test the technologies and approaches in 42
6868 state waters. The department shall submit its evaluation to Mote 43
6969 Marine Laboratory within 60 days after receipt of the report. If 44
7070 the department determines existing state permits may not be 45
7171 used, the department shall amend its regulatory or permitting 46
7272 processes to ensure the timely deployment of any red tide or 47
7373 similar harmful algal bloom mitigation and control technologies 48
7474 and approaches recommended by the initiative. Upon successful 49
7575 testing of the technologies and approaches, the department shall 50
