A bill to be entitled 1 
An act relating to location of equipment owned by 2 
amusement business owner; prohibiting counties and 3 
municipalities from enacting certain policies, 4 
ordinances, regulations, or other measures that 5 
require payment from an amusement business owner for 6 
the placement, parking, or storage of equipment for 7 
longer than a specified length of time on certain 8 
lands classified as agricultural lands; providing 9 
definitions; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  (1)  Notwithstanding any law to the contrary, a 14 
county or municipality may not enact any policy, ordinance, 15 
regulation, or other measure t hat addresses lands classified as 16 
agricultural lands 5 acres or larger if such policy, ordinance, 17 
regulation, or other measure requires a monetary exaction from 18 
any amusement business owner whose equipment is placed, parked, 19 
or stored on the agricultural l and for 6 months or longer. This 20 
prohibition applies only if the agricultural land is fully 21 
fenced along the perimeter and the equipment that is placed, 22 
parked, or stored on the agricultural land is at least 100 feet 23 
from the perimeter fencing. 24 
 (2)  For purposes of this section, the term: 25

 (a)  "agricultural lands" means those parcels classified by 26 
the property appraiser as agricultural lands under s. 193.461. 27 
 (b)  "amusement business owner" means a provider of 28 
services affiliated with a circus or carniv al such as rides, 29 
food, beverages, and games who travels around the United States 30 
on a seasonal or temporary basis to provide such services to 31 
state, district, and county fairs as defined in s. 616.001, or 32 
who supports events sponsored by not -for-profit organizations 33 
for fundraising. 34 
 Section 2.  This act shall take effect July 1, 2024. 35
