24 LC 48 1010 Senate Bill 332 By: Senators Robertson of the 29th, Kennedy of the 18th, Gooch of the 51st, Hatchett of the 50th, Brass of the 28th and others A BILL TO BE ENTITLED AN ACT To amend Code Section 15-18-32 of the Official Code of Georgia Annotated, relating to 1 Prosecuting Attorneys Qualifications Commission, authority, membership, ex parte2 communications, governance, disciplinary actions, confidentiality, and privileged nature; to3 provide for related matters; to repeal conflicting laws; and for other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 Code Section 15-18-32 of the Official Code of Georgia Annotated, relating to Prosecuting7 Attorneys Qualifications Commission, authority, membership, ex parte communications,8 governance, disciplinary actions, confidentiality, and privileged nature, is amended by9 revising subsection (g) as follows:10 "(g) The commission, with the assistance of the Prosecuting Attorneys' Council of the State11 of Georgia, shall promulgate standards of conduct and rules for the commission's12 governance which will comport with due process and enforce the provisions of subsections13 (h) and (i) of this Code section; provided, however, that such standards and rules shall be 14 effective only upon review and adoption by the Supreme Court. Such standards and rules15 shall allow for a full investigation of a district attorney or solicitor-general only upon16 S. B. 332 - 1 - 24 LC 48 1010 majority vote of the investigative panel. When a commission member receives information 17 relating to the conduct of a district attorney or solicitor-general, such member shall provide18 such information to the commission's director for appropriate action."19 SECTION 2.20 All laws and parts of laws in conflict with this Act are repealed.21 S.
