1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Criminal Code of 2012 is amended by
1515 5 changing Section 25-1 as follows:
1616 6 (720 ILCS 5/25-1) (from Ch. 38, par. 25-1)
1717 7 Sec. 25-1. Mob action.
1818 8 (a) A person commits mob action when he or she engages in
1919 9 any of the following:
2020 10 (1) the knowing or reckless use of force or violence
2121 11 disturbing the public peace by 2 or more persons acting
2222 12 together and without authority of law;
2323 13 (2) the knowing assembly of 2 or more persons with the
2424 14 intent to commit or facilitate the commission of a felony
2525 15 or misdemeanor; or
2626 16 (3) the knowing assembly of 2 or more persons, without
2727 17 authority of law, for the purpose of doing violence to the
2828 18 person or property of anyone supposed to have been guilty
2929 19 of a violation of the law, or for the purpose of exercising
3030 20 correctional powers or regulative powers over any person
3131 21 by violence;
3232 22 (4) the knowing or reckless steering of a motor
3333 23 vehicle so that it makes a controlled skid sideways

6868 1 through a turn with the front wheels pointed in a
6969 2 direction opposite to that of the turn if the activity
7070 3 results in the use of force or violence disturbing the
7171 4 public peace; or
7272 5 (5) the knowing or reckless act of street racing if
7373 6 the activity results in the use of force or violence
7474 7 disturbing the public peace. In this paragraph (5),
7575 8 "street racing" has the meaning ascribed to it in Section
7676 9 11-506 of the Illinois Vehicle Code.
7777 10 (b) Sentence.
7878 11 (1) Mob action in violation of paragraph (1), (4), or
7979 12 (5) of subsection (a) is a Class 4 felony.
8080 13 (2) Mob action in violation of paragraphs (2) and (3)
8181 14 of subsection (a) is a Class C misdemeanor.
8282 15 (3) A participant in a mob action that by violence
8383 16 inflicts injury to the person or property of another
8484 17 commits a Class 4 felony.
8585 18 (4) A participant in a mob action who does not
8686 19 withdraw when commanded to do so by a peace officer
8787 20 commits a Class A misdemeanor.
8888 21 (5) In addition to any other sentence that may be
8989 22 imposed, a court shall order any person convicted of mob
9090 23 action to perform community service for not less than 30
9191 24 and not more than 120 hours, if community service is
9292 25 available in the jurisdiction and is funded and approved
9393 26 by the county board of the county where the offense was

104104 1 committed. In addition, whenever any person is placed on
105105 2 supervision for an alleged offense under this Section, the
106106 3 supervision shall be conditioned upon the performance of
107107 4 the community service. This paragraph does not apply when
108108 5 the court imposes a sentence of incarceration.
