11	11	1 AN ACT concerning criminal law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Criminal Code of 2012 is amended by
15	15	5 changing Section 25-1 as follows:
16	16	6 (720 ILCS 5/25-1) (from Ch. 38, par. 25-1)
17	17	7 Sec. 25-1. Mob action.
18	18	8 (a) A person commits mob action when he or she engages in
19	19	9 any of the following:
20	20	10 (1) the knowing or reckless use of force or violence
21	21	11 disturbing the public peace by 2 or more persons acting
22	22	12 together and without authority of law;
23	23	13 (2) the knowing assembly of 2 or more persons with the
24	24	14 intent to commit or facilitate the commission of a felony
25	25	15 or misdemeanor; or
26	26	16 (3) the knowing assembly of 2 or more persons, without
27	27	17 authority of law, for the purpose of doing violence to the
28	28	18 person or property of anyone supposed to have been guilty
29	29	19 of a violation of the law, or for the purpose of exercising
30	30	20 correctional powers or regulative powers over any person
31	31	21 by violence;
32	32	22 (4) the knowing or reckless steering of a motor
33	33	23 vehicle so that it makes a controlled skid sideways

69	69	2 direction opposite to that of the turn if the activity
70	70	3 results in the use of force or violence disturbing the
71	71	4 public peace; or
72	72	5 (5) the knowing or reckless act of street racing if
73	73	6 the activity results in the use of force or violence
74	74	7 disturbing the public peace. In this paragraph (5),
75	75	8 "street racing" has the meaning ascribed to it in Section
76	76	9 11-506 of the Illinois Vehicle Code.
77	77	10 (b) Sentence.
78	78	11 (1) Mob action in violation of paragraph (1), (4), or
79	79	12 (5) of subsection (a) is a Class 4 felony.
80	80	13 (2) Mob action in violation of paragraphs (2) and (3)
81	81	14 of subsection (a) is a Class C misdemeanor.
82	82	15 (3) A participant in a mob action that by violence
83	83	16 inflicts injury to the person or property of another
84	84	17 commits a Class 4 felony.
85	85	18 (4) A participant in a mob action who does not
86	86	19 withdraw when commanded to do so by a peace officer
87	87	20 commits a Class A misdemeanor.
88	88	21 (5) In addition to any other sentence that may be
89	89	22 imposed, a court shall order any person convicted of mob
90	90	23 action to perform community service for not less than 30
91	91	24 and not more than 120 hours, if community service is
92	92	25 available in the jurisdiction and is funded and approved
93	93	26 by the county board of the county where the offense was

104	104	1 committed. In addition, whenever any person is placed on
105	105	2 supervision for an alleged offense under this Section, the
106	106	3 supervision shall be conditioned upon the performance of
107	107	4 the community service. This paragraph does not apply when
108	108	5 the court imposes a sentence of incarceration.
