The following facilities are recommended to have 2 such signs: 3 (1) Bridges where suicides by jumping have occurred or 4 are likely to occur. 5 (2) Locations that provide services to people that 6 have high incidence of suicide or mental health conditions 7 that would benefit from knowing about the hotline. 8 (b) The signs must be designed to communicate that dialing 9 9-8-8 on a telephone will connect callers to behavioral health 10 and suicide prevention services as provided in accordance with 11 State and federal laws governing the 9-8-8 number. 12 (c) If a sign is located along a State highway or the 13 interstate system, the Department of Transportation must 14 approve the location prior to erecting the sign, but no permit 15 is necessary. 16 Section 20. Conflict of laws. Signs created under this Act 17 may not conflict with provisions of the federal Manual of 18 Uniform Traffic Control Devices or existing State laws related 19 to placement and design of signs. 20 Section 25. No private right of action. Nothing contained 21 in this Act shall be construed as conferring a right of action 22 in cases where no right of action exists independent of this 23 Act. Maintenance of signs. A public body may 5 accept gifts or donations to pay for the creation, 6 installation, or maintenance of signs under this Act. 7 Section 35. The Department of Professional Regulation Law 8 is amended by adding Section 2105-370 as follows: 9 (20 ILCS 2105/2105-370 new) 10 Sec. 2105-370. Educational materials on veterans and 11 military members suicide prevention. 12 (a) Subject to appropriation, the Department shall consult 13 with the Department of Veterans Affairs' to create educational 14 materials informing health care providers regulated by the 15 Department's Division of Professional Regulation about the 16 availability of the nationwide 9-8-8 phone number for 17 individuals in crisis to connect with suicide prevention and 18 mental health crisis counselors. The educational materials 19 must include information about the nationwide veterans crisis 20 line for veterans and service members, and, beginning July 1, 21 2024, information about the resources developed under 22 subsection (e) of Section 2i of the Department of Veterans' 23 Affairs Act. HB2795 - 3 - LRB103 26923 KTG 53287 b HB2795- 4 -LRB103 26923 KTG 53287 b HB2795 - 4 - LRB103 26923 KTG 53287 b HB2795 - 4 - LRB103 26923 KTG 53287 b 1 (b) The Department shall: 2 (1) determine the health professions to which this 3 Section shall apply; and 4 (2) collaborate with the corresponding disciplinary 5 authority or board to ensure that the educational 6 materials are distributed electronically to appropriate 7 licensed health care providers when a provider renews his 8 or her license. 9 (c) Beginning July 1, 2024, all health care providers are 10 strongly encouraged to inquire with new patients entering care 11 whether the patient is a veteran, member of the military, or a 12 family member of a veteran or member of the military. If the 13 patient responds in the affirmative, the provider is 14 encouraged to share the educational materials created under 15 this Section with the patient. 16 Section 40. The Department of Veterans' Affairs Act is 17 amended by adding Sections 2i, 2j, and 40 as follows: 18 (20 ILCS 2805/2i new) 19 Sec. 2i. Suicide prevention community-based services grant 20 program. 21 (a) Legislative intent and findings. 22 (1) Suicide is a public health issue that affects many 23 Illinois families and communities daily. 24 (2) Service members, veterans, and their families are HB2795 - 4 - LRB103 26923 KTG 53287 b HB2795- 5 -LRB103 26923 KTG 53287 b HB2795 - 5 - LRB103 26923 KTG 53287 b HB2795 - 5 - LRB103 26923 KTG 53287 b 1 at a higher risk of being affected by suicide as 2 experiences prior to enlistment, during service, and 3 transition from service can contribute to suicidal 4 thoughts and behaviors. 5 (3) Family members of veterans who die by suicide are 6 at higher risk for future suicide due to the exposure of 7 experiencing suicide loss. Research shows for every 8 suicide that occurs, 135 people suffer from the effects 9 either directly or indirectly, meaning veteran suicides 10 impact a community of 2,600,000 people. 11 (4) There is no one path to suicide, but life 12 experiences, moral injury, trauma, culture, and health can 13 play a major role in suicidal behavior. Military and 14 veteran culture in particular includes stigma around 15 mental wellness and help-seeking behavior, emphasizes 16 reliability on group cohesion, and facilitates access, 17 comfortability, and familiarity with lethal means such as 18 firearms. Additionally, a significant number of veterans 19 do not seek care within the veterans administration 20 system. 21 (7) The General Assembly intends to address the 22 tragedy of suicide among veterans, military members, and 23 their families through support of professionals and 24 community and peer organizations serving veterans, 25 cultural changes that support help-seeking behaviors, and 26 investments in education, training, prevention, and care. HB2795 - 5 - LRB103 26923 KTG 53287 b HB2795- 6 -LRB103 26923 KTG 53287 b HB2795 - 6 - LRB103 26923 KTG 53287 b HB2795 - 6 - LRB103 26923 KTG 53287 b 1 (b) As used in this Section: 2 "Fund" means the Veterans and Military Members Suicide 3 Prevention Fund. 4 "Military members" means Illinois residents who are 5 actively serving members of the Illinois National Guard or 6 United States Reserve Forces, or active duty military 7 personnel. 8 "Veteran" means an Illinois resident who has served as a 9 member of the United States Armed Services on active duty, a 10 member of the Illinois National Guard, or a member of the 11 United States Reserve Forces, and who has received an 12 honorable discharge. 13 (c) Suicide prevention community-based services grant 14 program. 15 (1) The Department shall establish and administer a 16 suicide prevention community-based services grant program 17 for the purpose of providing suicide prevention, peer 18 support, and other assistance to at-risk and transitioning 19 veterans and military members and their families in their 20 communities. 21 (2) Subject to appropriation and any amounts disbursed 22 from the Veterans and Military Members Suicide Prevention 23 Fund created in subsection (d), the Department, in 24 consultation with the Department of Public Health's 25 suicide prevention coordinator project manager, must 26 establish a process to receive, review, process, and award HB2795 - 6 - LRB103 26923 KTG 53287 b HB2795- 7 -LRB103 26923 KTG 53287 b HB2795 - 7 - LRB103 26923 KTG 53287 b HB2795 - 7 - LRB103 26923 KTG 53287 b 1 grants to organizations, including nonprofit and peer 2 support community programs, that address veterans, 3 military members, and their families who may be at risk of 4 suicide and other mental health crises. Priority must be 5 given to organizations using peer support models that use 6 evidence-based, research-based, or promising practices. 7 (3) The Department shall report to the General 8 Assembly annually beginning July 1, 2024, on grant 9 recipients, the number of veterans and military members 10 served, and the types of services offered by grant 11 recipients. 12 (4) The Department of Public Health and its suicide 13 prevention coordinator project manager shall evaluate the 14 effectiveness of each grant program recipient providing 15 suicide prevention and peer support services to veterans, 16 military members, and their families who may be at risk of 17 suicide and other mental health crises. 18 (d) Veterans and Military Members Suicide Prevention Fund. 19 (1) The Veterans and Military Members Suicide 20 Prevention Fund is created as a special find in the State 21 treasury. The Fund shall consist of moneys appropriated by 22 the General Assembly, revenues received from the Prevent 23 Veteran Suicide universal special license plates, and all 24 receipts from gifts, grants, bequests, devises, or other 25 donations from public and private sources to support 26 veterans and military members suicide prevention measures. HB2795 - 7 - LRB103 26923 KTG 53287 b HB2795- 8 -LRB103 26923 KTG 53287 b HB2795 - 8 - LRB103 26923 KTG 53287 b HB2795 - 8 - LRB103 26923 KTG 53287 b 1 Expenditures from the Fund may be used only for the 2 purposes provided in paragraph (3) of this subsection. 3 Only the Director of Veterans' Affairs or the Director's 4 designee may authorize expenditures from the Fund. 5 (2)(A) The Department may request and accept 6 nondedicated contributions, grants, or gifts in cash or 7 otherwise, and voluntary donations for deposit into the 8 Fund, including funds generated by voluntary donations 9 under subparagraph (B). 10 (B) The Department may accept, for deposit into the 11 account, voluntary donations from persons who are: 12 (i) applying for a concealed pistol license or 13 renewal of a concealed pistol license; or 14 (ii) undergoing a background check under Section 15 3.1 of the Firearm Owners Identification Card Act in 16 connection with the purchase of a firearm from a 17 firearms dealer. 18 The Department shall coordinate with local law 19 enforcement agencies, the Illinois State Police, and 20 firearms dealers licensed under the Firearm Dealer License 21 Certification Act to develop a form and process for 22 publicizing and collecting voluntary donations under this 23 subparagraph. The Department and the Illinois State Police 24 shall post educational information regarding the voluntary 25 donation provisions of this subsection on their websites. 26 (3) All moneys deposited into the Fund must be used HB2795 - 8 - LRB103 26923 KTG 53287 b HB2795- 9 -LRB103 26923 KTG 53287 b HB2795 - 9 - LRB103 26923 KTG 53287 b HB2795 - 9 - LRB103 26923 KTG 53287 b 1 for activities that are dedicated to the benefit of 2 veteran and military member suicide education and 3 prevention including, but not limited to, providing 4 programs, peer support, and services that assist veterans 5 and military members in addressing mental health and 6 wellness impacts of military service, trauma, moral 7 injury, and transition to civilian life. Moneys may also 8 be used for the suicide prevention community-based 9 services grant program established in subsection (c). 10 Moneys from the Fund may not be used to supplant existing 11 moneys received by the Department nor shall grant 12 recipients use the moneys to supplant existing funding. 13 (e) Subject to the availability of amounts appropriated 14 for this specific purpose, the Department shall: 15 (1) Create and maintain a database of information on 16 nonprofit, for-profit, city, county, State, and federal 17 organizations, providers, and resources that address the 18 mental health, well-being, and suicide prevention of 19 veterans, military members, and their families. The 20 Department shall establish criteria for inclusion in the 21 database by July 1, 2023. The Department must make the 22 database accessible on its website to veterans, military 23 members, and their families by July 1, 2024. 24 (2) Provide suicide prevention education training and 25 information for veterans, military members, and their 26 families that is accessible through the internet. HB2795 - 9 - LRB103 26923 KTG 53287 b HB2795- 10 -LRB103 26923 KTG 53287 b HB2795 - 10 - LRB103 26923 KTG 53287 b HB2795 - 10 - LRB103 26923 KTG 53287 b 1 (3) By December 1, 2024, create, in consultation with 2 the Suicide-Safer Homes Task Force established under 3 Section 2j of this Act, a web-based application to be 4 shared by State agencies and primary care providers with 5 veterans, military members, and their families to provide 6 applicable information and resources, including, but not 7 limited to, benefits, mental health resources, and lethal 8 means safety information. 9 (20 ILCS 2805/2j new) 10 Sec. 2j. Suicide-Safer Homes Task Force. 11 (a) Subject to appropriation, a Suicide-Safer Homes Task 12 Force is established to raise public awareness and increase 13 suicide prevention education among new partners who are in key 14 positions to help reduce suicide. The Task Force shall be 15 administered and staffed by the Department. Any such memorial must include a component designed 6 to reflect on the great number of active duty service members 7 and veterans who have died by suicide after serving in these 8 wars. The design of such a memorial must serve to honor those 9 who are lost and provide a sacred space for healing and 10 reflection for veterans and military families. 11 (b) The State Global War on Terror Memorial Fund is 12 created as a special fund in the State treasury. The purpose of 13 the Fund is to support the establishment and maintenance of 14 the Global War on Terror Memorial. The Director of Veterans' 15 Affairs may solicit and accept moneys from gifts, grants, or 16 endowments for this purpose. All receipts from federal funds, 17 gifts, or grants from the private sector, foundations, or 18 other sources must be deposited into the Fund. Expenditures 19 from the Fund may be used only for the design, siting, 20 permitting, construction, maintenance, dedication, or creation 21 of educational materials related to placement of this memorial 22 on land held by the Department of Veterans' Affairs. Only the 23 Director, or the Director's designee, may authorize 24 expenditures from the Fund. 25 The Director may adopt rules governing the receipt and use of 26 moneys in the Fund. The Firearm Dealer License Certification Act 5 is amended by adding Section 5-57 as follows: 6 (430 ILCS 68/5-57 new) 7 Sec. 5-57. Storage services. 8 (a) In order to better prevent suicide by veterans, 9 military members, and their families, an expansion of safe 10 storage of firearms and reduced access to lethal means in the 11 community is encouraged. 12 (b) A certified licensee who provides a service of 13 allowing a person to temporarily store a firearm on the 14 certified licensee's premises in a storage locker, box, or 15 container that is locked and not accessible to the certified 16 licensee does not thereby create a special relationship, for 17 civil liability purposes, between the certified licensee and 18 the person who temporarily stores the firearm on the certified 19 licensee's premises. 20 Section 65. Universal special license plates. 2 (a) In addition to any other special license plate, the 3 Secretary, upon receipt of all applicable fees and 4 applications made in the form prescribed by the Secretary, may 5 issue Universal special license plates to residents of 6 Illinois on behalf of organizations that have been authorized 7 by the General Assembly to issue decals for Universal special 8 license plates. Appropriate documentation, as determined by 9 the Secretary, shall accompany each application. Authorized 10 organizations shall be designated by amendment to this 11 Section. When applying for a Universal special license plate 12 the applicant shall inform the Secretary of the name of the 13 authorized organization from which the applicant will obtain a 14 decal to place on the plate. The Secretary shall make a record 15 of that organization and that organization shall remain 16 affiliated with that plate until the plate is surrendered, 17 revoked, or otherwise cancelled. The authorized organization 18 may charge a fee to offset the cost of producing and 19 distributing the decal, but that fee shall be retained by the 20 authorized organization and shall be separate and distinct 21 from any registration fees charged by the Secretary. No decal, 22 sticker, or other material may be affixed to a Universal 23 special license plate other than a decal authorized by the 24 General Assembly in this Section or a registration renewal 25 sticker. Plates 3 issued under this Section shall expire according to the 4 multi-year procedure under Section 3-414.1 of this Code. 5 (b) The design, color, and format of the Universal special 6 license plate shall be wholly within the discretion of the 7 Secretary. Universal special license plates are not required 8 to designate "Land of Lincoln", as prescribed in subsection 9 (b) of Section 3-412 of this Code. The design shall allow for 10 the application of a decal to the plate. Organizations 11 authorized by the General Assembly to issue decals for 12 Universal special license plates shall comply with rules 13 adopted by the Secretary governing the requirements for and 14 approval of Universal special license plate decals. The 15 Secretary may, in his or her discretion, allow Universal 16 special license plates to be issued as vanity or personalized 17 plates in accordance with Section 3-405.1 of this Code. The 18 Secretary of State must make a version of the special 19 registration plates authorized under this Section in a form 20 appropriate for motorcycles and autocycles. 21 (c) When authorizing a Universal special license plate, 22 the General Assembly shall set forth whether an additional fee 23 is to be charged for the plate and, if a fee is to be charged, 24 the amount of the fee and how the fee is to be distributed. 25 When necessary, the authorizing language shall create a 26 special fund in the State treasury into which fees may be HB2795 - 18 - LRB103 26923 KTG 53287 b HB2795- 19 -LRB103 26923 KTG 53287 b HB2795 - 19 - LRB103 26923 KTG 53287 b HB2795 - 19 - LRB103 26923 KTG 53287 b 1 deposited for an authorized Universal special license plate. 2 Additional fees may only be charged if the fee is to be paid 3 over to a State agency or to a charitable entity that is in 4 compliance with the registration and reporting requirements of 5 the Charitable Trust Act and the Solicitation for Charity Act. 6 Any charitable entity receiving fees for the sale of Universal 7 special license plates shall annually provide the Secretary of 8 State a letter of compliance issued by the Attorney General 9 verifying that the entity is in compliance with the Charitable 10 Trust Act and the Solicitation for Charity Act. 11 (d) Upon original issuance and for each registration 12 renewal period, in addition to the appropriate registration 13 fee, if applicable, the Secretary shall collect any additional 14 fees, if required, for issuance of Universal special license 15 plates. The fees shall be collected on behalf of the 16 organization designated by the applicant when applying for the 17 plate. All fees collected shall be transferred to the State 18 agency on whose behalf the fees were collected, or paid into 19 the special fund designated in the law authorizing the 20 organization to issue decals for Universal special license 21 plates.
