1111 1 AN ACT concerning gaming.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Lottery Law is amended by changing
1515 5 Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11,
1616 6 and 21.13 and by adding Sections 21.4, 21.15, and 21.16 as

1919 9 Sec. 9.3. Expenditure and distribution of lottery
2020 10 proceeds.
2121 11 (a) Beginning July 1, 2022, except as provided in Sections
2222 12 21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and
2323 13 21.13, 21.15, and 21.16 of this Act and Section 25-70 of the
2424 14 Sports Wagering Act, the Department shall distribute all
2525 15 proceeds of lottery tickets and shares sold in the following
2626 16 priority and manner:
2727 17 (1) The payment of prizes and retailer bonuses.
2828 18 (2) The payment of costs incurred in the operation and
2929 19 administration of the Lottery, including the payment of
3030 20 sums due to the private manager under the management
3131 21 agreement with the Department and including costs of
3232 22 administering the Lottery sports wagering program pursuant
3333 23 to Section 25-70 of the Sports Wagering Act.

6868 1 (3) On the last day of each month or as soon thereafter
6969 2 as possible, the State Comptroller shall direct and the
7070 3 State Treasurer shall transfer from the State Lottery Fund
7171 4 to the Common School Fund the Department's estimate of net

7373 6 (4) If an amount in excess of the annual net lottery
7474 7 proceeds is transferred for a fiscal year, then the
7575 8 Department shall offset the monthly transfers of estimated
7676 9 net lottery proceeds during the following fiscal year by
7777 10 that excess amount. If an amount less than the annual net
7878 11 lottery proceeds is transferred for a fiscal year, then
7979 12 after the related annual fiscal year audit is completed
8080 13 following such fiscal year, the Department shall direct
8181 14 the deposit of any remaining annual net lottery proceeds
8282 15 from such fiscal year, subject to payments under
8383 16 paragraphs (1) and (2), into the Common School Fund as
8484 17 soon thereafter as possible.
8585 18 (b) The net lottery proceeds shall be determined by
8686 19 deducting from total annual lottery proceeds the expenditures
8787 20 required by paragraphs (1) and (2) of subsection (a). The
8888 21 total annual lottery proceeds and annual net lottery proceeds
8989 22 shall be determined according to generally accepted accounting
9090 23 principles for governmental entities and verified by an annual
9191 24 fiscal year audit.

104104 2 Sec. 20. State Lottery Fund.
105105 3 (a) There is created in the State Treasury a special fund
106106 4 to be known as the State Lottery Fund. Such fund shall consist
107107 5 of all revenues received from (1) the sale of lottery tickets
108108 6 or shares, (net of commissions, fees representing those
109109 7 expenses that are directly proportionate to the sale of
110110 8 tickets or shares at the agent location, and prizes of less
111111 9 than $600 which have been validly paid at the agent level), (2)
112112 10 application fees, and (3) all other sources including moneys
113113 11 credited or transferred thereto from any other fund or source
114114 12 pursuant to law. Interest earnings of the State Lottery Fund
115115 13 shall be credited to the Common School Fund.
116116 14 (a-5) The receipt and distribution of moneys under Section
117117 15 21.4 of this Act shall be in accordance with Section 21.4.
118118 16 (b) The receipt and distribution of moneys under Section
119119 17 21.5 of this Act shall be in accordance with Section 21.5.
120120 18 (c) The receipt and distribution of moneys under Section

158158 20 (a) The Department shall offer a joint special instant
159159 21 scratch-off game for the benefit of the special causes
160160 22 identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
161161 23 21.11, 21.13, 21.15, and 21.16. The operation of the game
162162 24 shall be governed by this Section and any rules adopted by the

178178 5 (b) Once the joint special instant scratch-off game is
179179 6 used to fund a special cause, the game will be used to fund the
180180 7 special cause for the remainder of the special causes'
181181 8 existence per the causes' respective Section of this Act.
182182 9 (c) New specialty tickets and causes authorized by this
183183 10 Act shall be funded by the joint special instant scratch-off
184184 11 game. New specialty tickets and causes after February 1, 2024
185185 12 must have a sunset date. The Department shall be limited to
186186 13 supporting no more than 10 causes in total at any given time.
187187 14 (d) Net revenue received from the sale of the joint
188188 15 special instant scratch-off game for the purposes of this
189189 16 Section shall be divided equally among the special causes the
190190 17 game benefits. The Department shall transfer the net revenue
191191 18 into the special fund identified for each special cause in
192192 19 accordance with the special cause's respective Section of this
193193 20 Act. As used in this Section, "net revenue" means the total
194194 21 amount for which tickets have been sold less the sum of the
195195 22 amount paid out in prizes and to retailers, and direct and
196196 23 estimated administrative expenses incurred in operation of the
197197 24 ticket.

209209 1 Sec. 21.5. Carolyn Adams Ticket For The Cure.
210210 2 (a) The Department shall offer a special instant
211211 3 scratch-off game with the title of "Carolyn Adams Ticket For
212212 4 The Cure". The game shall commence on January 1, 2006 or as
213213 5 soon thereafter, in the discretion of the Director, as is
214214 6 reasonably practical, and shall be discontinued on December
215215 7 31, 2026. The operation of the game shall be governed by this
216216 8 Act and any rules adopted by the Department. The Department
217217 9 must consult with the Carolyn Adams Ticket For The Cure Board,
218218 10 which is established under Section 2310-347 of the Department
219219 11 of Public Health Powers and Duties Law of the Civil
220220 12 Administrative Code of Illinois, regarding the design and
221221 13 promotion of the game. If any provision of this Section is
222222 14 inconsistent with any other provision of this Act, then this
223223 15 Section governs.
224224 16 (b) The Carolyn Adams Ticket For The Cure Grant Fund is
225225 17 created as a special fund in the State treasury. The net
226226 18 revenue from the Carolyn Adams Ticket For The Cure special
227227 19 instant scratch-off game shall be deposited into the Fund for
228228 20 appropriation by the General Assembly solely to the Department
229229 21 of Public Health for the purpose of making grants to public or
230230 22 private entities in Illinois for the purpose of funding breast
231231 23 cancer research, and supportive services for breast cancer
232232 24 survivors and those impacted by breast cancer and breast
233233 25 cancer education. In awarding grants, the Department of Public
234234 26 Health shall consider criteria that includes, but is not

246246 2 in incidence and mortality rates of breast cancer, based on
247247 3 data from the Illinois Cancer Registry, and populations facing
248248 4 barriers to care. The Department of Public Health shall,
249249 5 before grants are awarded, provide copies of all grant
250250 6 applications to the Carolyn Adams Ticket For The Cure Board,
251251 7 receive and review the Board's recommendations and comments,
252252 8 and consult with the Board regarding the grants. For purposes
253253 9 of this Section, the term "research" includes, without
254254 10 limitation, expenditures to develop and advance the
255255 11 understanding, techniques, and modalities effective in the
256256 12 detection, prevention, screening, and treatment of breast
257257 13 cancer and may include clinical trials. The grant funds may
258258 14 not be used for institutional, organizational, or
259259 15 community-based overhead costs, indirect costs, or levies.
260260 16 Moneys received for the purposes of this Section,
261261 17 including, without limitation, net revenue from the special
262262 18 instant scratch-off game and gifts, grants, and awards from
263263 19 any public or private entity, must be deposited into the Fund.
264264 20 Any interest earned on moneys in the Fund must be deposited
265265 21 into the Fund.
266266 22 As used in this subsection, For purposes of this
267267 23 subsection, "net revenue" means the total amount for which
268268 24 tickets have been sold less the sum of the amount paid out in

287287 7 implement and administer the provisions of this Section.

290290 10 Sec. 21.6. Scratch-off for Illinois veterans.
291291 11 (a) The Department shall offer a special instant
292292 12 scratch-off game for the benefit of Illinois veterans. The
293293 13 game shall commence on January 1, 2006 or as soon thereafter,
294294 14 at the discretion of the Director, as is reasonably practical.
295295 15 The operation of the game shall be governed by this Act and any
296296 16 rules adopted by the Department. If any provision of this
297297 17 Section is inconsistent with any other provision of this Act,
298298 18 then this Section governs.
299299 19 (b) The Illinois Veterans Assistance Fund is created as a
300300 20 special fund in the State treasury. The net revenue from the
301301 21 Illinois veterans scratch-off game shall be deposited into the
302302 22 Fund for appropriation by the General Assembly solely to the
303303 23 Department of Veterans' Affairs for making grants, funding
304304 24 additional services, or conducting additional research

316316 1 (i) veterans' behavioral health services;
317317 2 (ii) veterans' homelessness;
318318 3 (iii) the health insurance costs of veterans;
319319 4 (iv) veterans' disability benefits, including but not
320320 5 limited to, disability benefits provided by veterans
321321 6 service organizations and veterans assistance commissions
322322 7 or centers;
323323 8 (v) the long-term care of veterans; provided that,
324324 9 beginning with moneys appropriated for fiscal year 2008,
325325 10 no more than 20% of such moneys shall be used for health
326326 11 insurance costs;
327327 12 (vi) veteran employment and employment training; and
328328 13 (vii) veterans' emergency financial assistance,
329329 14 including, but not limited to, past due utilities,
330330 15 housing, and transportation costs.
331331 16 In order to expend moneys from this special fund,
332332 17 beginning with moneys appropriated for fiscal year 2008, the
333333 18 Director of Veterans' Affairs shall appoint a 3-member funding
334334 19 authorization committee. The Director shall designate one of
335335 20 the members as chairperson. The committee shall meet on a
336336 21 quarterly basis, at a minimum, and shall authorize expenditure
337337 22 of moneys from the special fund by a two-thirds vote.
338338 23 Decisions of the committee shall not take effect unless and
339339 24 until approved by the Director of Veterans' Affairs. Each
340340 25 member of the committee shall serve until a replacement is
341341 26 named by the Director of Veterans' Affairs. One member of the

353353 2 Moneys collected from the special instant scratch-off game
354354 3 shall be used only as a supplemental financial resource and
355355 4 shall not supplant existing moneys that the Department of
356356 5 Veterans' Affairs may currently expend for the purposes set
357357 6 forth in items (i) through (v).
358358 7 Moneys received for the purposes of this Section,
359359 8 including, without limitation, net revenue from the special
360360 9 instant scratch-off game and from gifts, grants, and awards
361361 10 from any public or private entity, must be deposited into the
362362 11 Fund. Any interest earned on moneys in the Fund must be
363363 12 deposited into the Fund.
364364 13 As used in this subsection, For purposes of this
365365 14 subsection, "net revenue" means the total amount for which

408408 22 including, without limitation, net revenue from the special
409409 23 instant scratch-off game and from gifts, grants, and awards
410410 24 from any public or private entity, must be deposited into the

474474 16 (b) The Quality of Life Endowment Fund is created as a
475475 17 special fund in the State treasury. The net revenue from the
476476 18 Quality of Life special instant scratch-off game must be
477477 19 deposited into the Fund for appropriation by the General
478478 20 Assembly solely to the Department of Public Health for the
479479 21 purpose of HIV/AIDS-prevention education and for making grants
480480 22 to public or private entities in Illinois for the purpose of
481481 23 funding organizations that serve the highest at-risk
482482 24 categories for contracting HIV or developing AIDS. Grants

507507 14 $300,001 to $700,000 will compete with like organizations for
508508 15 25% of the Quality of Life annual fund, and organizations with
509509 16 an annual budget of $700,001 and upward will compete with like
510510 17 organizations for 25% of the Quality of Life annual fund. The
511511 18 lottery may designate a percentage of proceeds for marketing
512512 19 purposes. The grant funds may not be used for institutional,
513513 20 organizational, or community-based overhead costs, indirect
514514 21 costs, or levies.
515515 22 Grants awarded from the Fund are intended to augment the
516516 23 current and future State funding for the prevention and
517517 24 treatment of HIV/AIDS and are not intended to replace that

916916 3 (2) Establishing a not-for-profit entity charged with

919919 6 with administering, and funding scholarships to students
920920 7 who are the children of immigrants to the United States.
921921 8 (3) Publicizing the availability of scholarships from
922922 9 the Illinois DREAM Fund.
923923 10 (4) Selecting the recipients of scholarships funded
924924 11 through the Illinois DREAM Fund.
925925 12 (5) Researching issues pertaining to the availability
926926 13 of assistance with the costs of higher education for the
927927 14 children of immigrants and other issues regarding access
928928 15 for and the performance of the children of immigrants
929929 16 within higher education.
930930 17 (6) Overseeing implementation of the other provisions
931931 18 of this amendatory Act of the 97th General Assembly.
932932 19 (7) Establishing and administering training programs
933933 20 for high school counselors and counselors, admissions
934934 21 officers, and financial aid officers of public
935935 22 institutions of higher education. The training programs
936936 23 shall instruct participants on the educational
937937 24 opportunities available to college-bound students who are
938938 25 the children of immigrants, including, but not limited to,

950950 1 DREAM Fund Commission may also establish a public
951951 2 awareness campaign regarding educational opportunities
952952 3 available to college bound students who are the children
953953 4 of immigrants.
954954 5 The Illinois DREAM Fund Commission shall establish, by
955955 6 rule, procedures for accepting and evaluating applications for
956956 7 scholarships from the children of immigrants and issuing
957957 8 scholarships to selected student applicants.
958958 9 (c) To receive a scholarship under this Section, a student
959959 10 must meet all of the following qualifications:
960960 11 (1) Have resided with his or her parents or guardian
961961 12 while attending a public or private high school in this
962962 13 State.
963963 14 (2) Have graduated from a public or private high
964964 15 school or received the equivalent of a high school diploma
965965 16 in this State.
966966 17 (3) Have attended school in this State for at least 3
967967 18 years as of the date he or she graduated from high school
968968 19 or received the equivalent of a high school diploma.
969969 20 (4) Have at least one parent who immigrated to the
970970 21 United States.
971971 22 (d) The Illinois Student Assistance Commission shall
972972 23 establish an Illinois DREAM Fund to provide scholarships under
973973 24 this Section. The Illinois DREAM Fund shall be funded entirely
974974 25 from private contributions, gifts, grants, awards, and
975975 26 proceeds from the scratch-off created in Section 21.16 of the
