11	11	1 AN ACT concerning gaming.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Lottery Law is amended by changing
15	15	5 Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11,
16	16	6 and 21.13 and by adding Sections 21.4, 21.15, and 21.16 as
17	17	7 follows:

19	19	9 Sec. 9.3. Expenditure and distribution of lottery
20	20	10 proceeds.
21	21	11 (a) Beginning July 1, 2022, except as provided in Sections
22	22	12 21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and
23	23	13 21.13, 21.15, and 21.16 of this Act and Section 25-70 of the
24	24	14 Sports Wagering Act, the Department shall distribute all
25	25	15 proceeds of lottery tickets and shares sold in the following
26	26	16 priority and manner:
27	27	17 (1) The payment of prizes and retailer bonuses.
28	28	18 (2) The payment of costs incurred in the operation and
29	29	19 administration of the Lottery, including the payment of
30	30	20 sums due to the private manager under the management
31	31	21 agreement with the Department and including costs of
32	32	22 administering the Lottery sports wagering program pursuant
33	33	23 to Section 25-70 of the Sports Wagering Act.

68	68	1 (3) On the last day of each month or as soon thereafter
69	69	2 as possible, the State Comptroller shall direct and the
70	70	3 State Treasurer shall transfer from the State Lottery Fund
71	71	4 to the Common School Fund the Department's estimate of net
72	72	5 lottery proceeds.
73	73	6 (4) If an amount in excess of the annual net lottery
74	74	7 proceeds is transferred for a fiscal year, then the
75	75	8 Department shall offset the monthly transfers of estimated
76	76	9 net lottery proceeds during the following fiscal year by
77	77	10 that excess amount. If an amount less than the annual net
78	78	11 lottery proceeds is transferred for a fiscal year, then
79	79	12 after the related annual fiscal year audit is completed
80	80	13 following such fiscal year, the Department shall direct
81	81	14 the deposit of any remaining annual net lottery proceeds
82	82	15 from such fiscal year, subject to payments under
83	83	16 paragraphs (1) and (2), into the Common School Fund as
84	84	17 soon thereafter as possible.
85	85	18 (b) The net lottery proceeds shall be determined by
86	86	19 deducting from total annual lottery proceeds the expenditures
87	87	20 required by paragraphs (1) and (2) of subsection (a). The
88	88	21 total annual lottery proceeds and annual net lottery proceeds
89	89	22 shall be determined according to generally accepted accounting
90	90	23 principles for governmental entities and verified by an annual
91	91	24 fiscal year audit.

104	104	2 Sec. 20. State Lottery Fund.
105	105	3 (a) There is created in the State Treasury a special fund
106	106	4 to be known as the State Lottery Fund. Such fund shall consist
107	107	5 of all revenues received from (1) the sale of lottery tickets
108	108	6 or shares, (net of commissions, fees representing those
109	109	7 expenses that are directly proportionate to the sale of
110	110	8 tickets or shares at the agent location, and prizes of less
111	111	9 than $600 which have been validly paid at the agent level), (2)
112	112	10 application fees, and (3) all other sources including moneys
113	113	11 credited or transferred thereto from any other fund or source
114	114	12 pursuant to law. Interest earnings of the State Lottery Fund
115	115	13 shall be credited to the Common School Fund.
116	116	14 (a-5) The receipt and distribution of moneys under Section
117	117	15 21.4 of this Act shall be in accordance with Section 21.4.
118	118	16 (b) The receipt and distribution of moneys under Section
119	119	17 21.5 of this Act shall be in accordance with Section 21.5.
120	120	18 (c) The receipt and distribution of moneys under Section
121	121	19 21.6 of this Act shall be in accordance with Section 21.6.

157	157	19 Sec. 21.4. Joint Special Instant Scratch-off game.
158	158	20 (a) The Department shall offer a joint special instant
159	159	21 scratch-off game for the benefit of the special causes
160	160	22 identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
161	161	23 21.11, 21.13, 21.15, and 21.16. The operation of the game
162	162	24 shall be governed by this Section and any rules adopted by the
163	163	25 Department. The game shall commence on January 1, 2024 or as

176	176	3 inconsistent with any other provision in the Act, then this

178	178	5 (b) Once the joint special instant scratch-off game is
179	179	6 used to fund a special cause, the game will be used to fund the
180	180	7 special cause for the remainder of the special causes'
181	181	8 existence per the causes' respective Section of this Act.
182	182	9 (c) New specialty tickets and causes authorized by this
183	183	10 Act shall be funded by the joint special instant scratch-off
184	184	11 game. New specialty tickets and causes after February 1, 2024
185	185	12 must have a sunset date. The Department shall be limited to
186	186	13 supporting no more than 10 causes in total at any given time.
187	187	14 (d) Net revenue received from the sale of the joint
188	188	15 special instant scratch-off game for the purposes of this
189	189	16 Section shall be divided equally among the special causes the
190	190	17 game benefits. The Department shall transfer the net revenue
191	191	18 into the special fund identified for each special cause in
192	192	19 accordance with the special cause's respective Section of this
193	193	20 Act. As used in this Section, "net revenue" means the total
194	194	21 amount for which tickets have been sold less the sum of the
195	195	22 amount paid out in prizes and to retailers, and direct and
196	196	23 estimated administrative expenses incurred in operation of the
197	197	24 ticket.

209	209	1 Sec. 21.5. Carolyn Adams Ticket For The Cure.
210	210	2 (a) The Department shall offer a special instant
211	211	3 scratch-off game with the title of "Carolyn Adams Ticket For
212	212	4 The Cure". The game shall commence on January 1, 2006 or as
213	213	5 soon thereafter, in the discretion of the Director, as is
214	214	6 reasonably practical, and shall be discontinued on December
215	215	7 31, 2026. The operation of the game shall be governed by this
216	216	8 Act and any rules adopted by the Department. The Department
217	217	9 must consult with the Carolyn Adams Ticket For The Cure Board,
218	218	10 which is established under Section 2310-347 of the Department
219	219	11 of Public Health Powers and Duties Law of the Civil
220	220	12 Administrative Code of Illinois, regarding the design and
221	221	13 promotion of the game. If any provision of this Section is
222	222	14 inconsistent with any other provision of this Act, then this
223	223	15 Section governs.
224	224	16 (b) The Carolyn Adams Ticket For The Cure Grant Fund is
225	225	17 created as a special fund in the State treasury. The net
226	226	18 revenue from the Carolyn Adams Ticket For The Cure special
227	227	19 instant scratch-off game shall be deposited into the Fund for
228	228	20 appropriation by the General Assembly solely to the Department
229	229	21 of Public Health for the purpose of making grants to public or
230	230	22 private entities in Illinois for the purpose of funding breast
231	231	23 cancer research, and supportive services for breast cancer
232	232	24 survivors and those impacted by breast cancer and breast
233	233	25 cancer education. In awarding grants, the Department of Public
234	234	26 Health shall consider criteria that includes, but is not

245	245	1 limited to, projects and initiatives that address disparities
246	246	2 in incidence and mortality rates of breast cancer, based on
247	247	3 data from the Illinois Cancer Registry, and populations facing
248	248	4 barriers to care. The Department of Public Health shall,
249	249	5 before grants are awarded, provide copies of all grant
250	250	6 applications to the Carolyn Adams Ticket For The Cure Board,
251	251	7 receive and review the Board's recommendations and comments,
252	252	8 and consult with the Board regarding the grants. For purposes
253	253	9 of this Section, the term "research" includes, without
254	254	10 limitation, expenditures to develop and advance the
255	255	11 understanding, techniques, and modalities effective in the
256	256	12 detection, prevention, screening, and treatment of breast
257	257	13 cancer and may include clinical trials. The grant funds may
258	258	14 not be used for institutional, organizational, or
259	259	15 community-based overhead costs, indirect costs, or levies.
260	260	16 Moneys received for the purposes of this Section,
261	261	17 including, without limitation, net revenue from the special
262	262	18 instant scratch-off game and gifts, grants, and awards from
263	263	19 any public or private entity, must be deposited into the Fund.
264	264	20 Any interest earned on moneys in the Fund must be deposited
265	265	21 into the Fund.
266	266	22 As used in this subsection, For purposes of this
267	267	23 subsection, "net revenue" means the total amount for which
268	268	24 tickets have been sold less the sum of the amount paid out in
269	269	25 prizes and to retailers, and direct and estimated the actual
270	270	26 administrative expenses of the Department solely related to

282	282	2 (c) During the time that tickets are sold for the Carolyn
283	283	3 Adams Ticket For The Cure game, the Department shall not
284	284	4 unreasonably diminish the efforts devoted to marketing any
285	285	5 other instant scratch-off lottery game.
286	286	6 (d) The Department may adopt any rules necessary to
287	287	7 implement and administer the provisions of this Section.

290	290	10 Sec. 21.6. Scratch-off for Illinois veterans.
291	291	11 (a) The Department shall offer a special instant
292	292	12 scratch-off game for the benefit of Illinois veterans. The
293	293	13 game shall commence on January 1, 2006 or as soon thereafter,
294	294	14 at the discretion of the Director, as is reasonably practical.
295	295	15 The operation of the game shall be governed by this Act and any
296	296	16 rules adopted by the Department. If any provision of this
297	297	17 Section is inconsistent with any other provision of this Act,
298	298	18 then this Section governs.
299	299	19 (b) The Illinois Veterans Assistance Fund is created as a
300	300	20 special fund in the State treasury. The net revenue from the
301	301	21 Illinois veterans scratch-off game shall be deposited into the
302	302	22 Fund for appropriation by the General Assembly solely to the
303	303	23 Department of Veterans' Affairs for making grants, funding
304	304	24 additional services, or conducting additional research

316	316	1 (i) veterans' behavioral health services;
317	317	2 (ii) veterans' homelessness;
318	318	3 (iii) the health insurance costs of veterans;
319	319	4 (iv) veterans' disability benefits, including but not
320	320	5 limited to, disability benefits provided by veterans
321	321	6 service organizations and veterans assistance commissions
322	322	7 or centers;
323	323	8 (v) the long-term care of veterans; provided that,
324	324	9 beginning with moneys appropriated for fiscal year 2008,
325	325	10 no more than 20% of such moneys shall be used for health
326	326	11 insurance costs;
327	327	12 (vi) veteran employment and employment training; and
328	328	13 (vii) veterans' emergency financial assistance,
329	329	14 including, but not limited to, past due utilities,
330	330	15 housing, and transportation costs.
331	331	16 In order to expend moneys from this special fund,
332	332	17 beginning with moneys appropriated for fiscal year 2008, the
333	333	18 Director of Veterans' Affairs shall appoint a 3-member funding
334	334	19 authorization committee. The Director shall designate one of
335	335	20 the members as chairperson. The committee shall meet on a
336	336	21 quarterly basis, at a minimum, and shall authorize expenditure
337	337	22 of moneys from the special fund by a two-thirds vote.
338	338	23 Decisions of the committee shall not take effect unless and
339	339	24 until approved by the Director of Veterans' Affairs. Each
340	340	25 member of the committee shall serve until a replacement is
341	341	26 named by the Director of Veterans' Affairs. One member of the

469	469	11 the Department of Public Health Powers and Duties Law of the
470	470	12 Civil Administrative Code of Illinois, regarding the design
471	471	13 and promotion of the game. If any provision of this Section is
472	472	14 inconsistent with any other provision of this Act, then this
473	473	15 Section governs.
474	474	16 (b) The Quality of Life Endowment Fund is created as a
475	475	17 special fund in the State treasury. The net revenue from the
476	476	18 Quality of Life special instant scratch-off game must be
477	477	19 deposited into the Fund for appropriation by the General
478	478	20 Assembly solely to the Department of Public Health for the
479	479	21 purpose of HIV/AIDS-prevention education and for making grants
480	480	22 to public or private entities in Illinois for the purpose of
481	481	23 funding organizations that serve the highest at-risk
482	482	24 categories for contracting HIV or developing AIDS. Grants

503	503	10 competitive slot in the "Request for Proposal" process.
504	504	11 Organizations with an annual budget of $300,000 or less will
505	505	12 compete with like size organizations for 50% of the Quality of
506	506	13 Life annual fund. Organizations with an annual budget of
507	507	14 $300,001 to $700,000 will compete with like organizations for
508	508	15 25% of the Quality of Life annual fund, and organizations with
509	509	16 an annual budget of $700,001 and upward will compete with like
510	510	17 organizations for 25% of the Quality of Life annual fund. The
511	511	18 lottery may designate a percentage of proceeds for marketing
512	512	19 purposes. The grant funds may not be used for institutional,
513	513	20 organizational, or community-based overhead costs, indirect
514	514	21 costs, or levies.
515	515	22 Grants awarded from the Fund are intended to augment the
516	516	23 current and future State funding for the prevention and
517	517	24 treatment of HIV/AIDS and are not intended to replace that

852	852	5 shall consult with the Illinois DREAM Fund Commission
853	853	6 established under Section 67 of the Higher Education Student
854	854	7 Assistance Act regarding the design and promotion of the game.
855	855	8 (b) The operation of any games under this Section shall be
856	856	9 governed by this Act, and any rules shall be adopted by the
857	857	10 Department.
858	858	11 (c) For purposes of this Section, "net revenue" means the
859	859	12 total amount for which tickets have been sold less the sum of
860	860	13 the amount paid out in prizes and the actual administrative
861	861	14 expenses of the Department solely related to the Illinois
862	862	15 DREAM scratch-off game.
863	863	16 (d) During the time that tickets are sold for the Illinois
864	864	17 DREAM scratch-off game, the Department shall not unreasonably
865	865	18 diminish the efforts devoted to marketing any other instant
866	866	19 scratch-off lottery game.
867	867	20 (e) The Department may adopt any rules necessary to
868	868	21 implement and administer this Section in consultation with the
869	869	22 Illinois DREAM Fund Commission.

919	919	6 with administering, and funding scholarships to students
920	920	7 who are the children of immigrants to the United States.
921	921	8 (3) Publicizing the availability of scholarships from
922	922	9 the Illinois DREAM Fund.
923	923	10 (4) Selecting the recipients of scholarships funded
924	924	11 through the Illinois DREAM Fund.
925	925	12 (5) Researching issues pertaining to the availability
926	926	13 of assistance with the costs of higher education for the
927	927	14 children of immigrants and other issues regarding access
928	928	15 for and the performance of the children of immigrants

930	930	17 (6) Overseeing implementation of the other provisions
931	931	18 of this amendatory Act of the 97th General Assembly.
932	932	19 (7) Establishing and administering training programs
933	933	20 for high school counselors and counselors, admissions
934	934	21 officers, and financial aid officers of public
935	935	22 institutions of higher education. The training programs
936	936	23 shall instruct participants on the educational
937	937	24 opportunities available to college-bound students who are
938	938	25 the children of immigrants, including, but not limited to,

951	951	2 awareness campaign regarding educational opportunities

954	954	5 The Illinois DREAM Fund Commission shall establish, by
955	955	6 rule, procedures for accepting and evaluating applications for
956	956	7 scholarships from the children of immigrants and issuing
957	957	8 scholarships to selected student applicants.
958	958	9 (c) To receive a scholarship under this Section, a student
959	959	10 must meet all of the following qualifications:
960	960	11 (1) Have resided with his or her parents or guardian
961	961	12 while attending a public or private high school in this
962	962	13 State.
963	963	14 (2) Have graduated from a public or private high
964	964	15 school or received the equivalent of a high school diploma
965	965	16 in this State.
966	966	17 (3) Have attended school in this State for at least 3
967	967	18 years as of the date he or she graduated from high school
968	968	19 or received the equivalent of a high school diploma.
969	969	20 (4) Have at least one parent who immigrated to the
970	970	21 United States.
971	971	22 (d) The Illinois Student Assistance Commission shall
972	972	23 establish an Illinois DREAM Fund to provide scholarships under
973	973	24 this Section. The Illinois DREAM Fund shall be funded entirely
974	974	25 from private contributions, gifts, grants, awards, and
