Tracy Katz Muhl SYNOPSIS AS INTRODUCED: 20 ILCS 1305/1-41 new305 ILCS 5/5-50.5 new Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that subject to approval by the federal Centers for Medicare and Medicaid Services, both the fee-for service and managed care medical assistance programs shall reimburse qualified mental health professionals for hours spent supervising students and interns. Requires the Department of Healthcare and Family Services to establish a fee schedule for the covered services. Requires the Department to apply, by January 1, 2025, for any necessary federal waivers or approvals to implement the provisions of the amendatory Act. Requires the Department to submit to the Joint Committee on Administrative Rules a rulemaking proposal to implement the provisions of the amendatory Act as soon as practicable but no later than 6 months after the Department receives federal approval to reimburse qualified mental health professionals for hours spent supervising students and interns. Defines "qualified mental health professional". Amends the Department of Human Services Act. Provides that upon the receipt of all necessary federal waivers or approvals by the Department of Healthcare and Family Services as provided under the amendatory Act, the Department of Human Services shall reimburse qualified mental health professionals for hours spent supervising students and interns. 1212 1 AN ACT concerning public aid.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Department of Human Services Act is amended
1616 5 by adding Section 1-41 as follows:
1717 6 (20 ILCS 1305/1-41 new)
1818 7 Sec. 1-41. Qualified mental health professionals; coverage
1919 8 for supervision hours. Upon the receipt of all necessary
2020 9 federal waivers or approvals by the Department of Healthcare
2121 10 and Family Services as provided under Section 5-50.5 of the
2222 11 Illinois Public Aid Code, the Department of Human Services
2323 12 shall reimburse qualified mental health professionals for
2424 13 hours spent supervising students and interns. As used in this
2525 14 Section, "qualified mental health professional" has the same
2626 15 meaning ascribed to that term in Section 5-50.5 of the
2727 16 Illinois Public Aid Code.
2828 17 Section 10. The Illinois Public Aid Code is amended by
2929 18 adding Section 5-50.5 as follows:

6969 1 (a) Subject to approval by the federal Centers for
7070 2 Medicare and Medicaid Services, the medical assistance
7171 3 program, including both the fee-for-service and managed care
7272 4 medical assistance programs established under this Article,
7373 5 shall reimburse qualified mental health professionals for
7474 6 hours spent supervising students and interns. The Department
7575 7 shall establish a fee schedule for services rendered under
7676 8 this Section.
7777 9 (b) By January 1, 2025, the Department shall apply for any
7878 10 necessary federal waivers or approvals to implement this
7979 11 Section. The Department shall submit to the Joint Committee on
8080 12 Administrative Rules a rulemaking proposal to implement this
8181 13 Section as soon as practicable but no later than 6 months after
8282 14 federal approval is received.
8383 15 (c) As used in this Section, "qualified mental health
8484 16 professional" means the following:
8585 17 (1) a licensed social worker possessing at least a
8686 18 master's degree in social work and licensed under the
8787 19 Clinical Social Work and Social Work Practice Act with
8888 20 specialized training in mental health services or with at
8989 21 least 2 years' experience in mental health services;
9090 22 (2) a licensed professional counselor possessing at
9191 23 least a master's degree and licensed under the
9292 24 Professional Counselor and Clinical Professional Counselor
9393 25 Licensing and Practice Act with specialized training in
9494 26 mental health services or with at least 2 years'

105105 1 experience in mental health services;
106106 2 (3) a registered nurse licensed under the Nurse
107107 3 Practice Act with at least one year of clinical experience
108108 4 in a mental health setting or who possesses a master's
109109 5 degree in psychiatric nursing;
110110 6 (4) an occupational therapist licensed under the
111111 7 Illinois Occupational Therapy Practice Act with at least
112112 8 one year of clinical experience in a mental health
113113 9 setting; or
114114 10 (5) an individual possessing at least a master's
115115 11 degree in counseling and guidance, rehabilitation
116116 12 counseling, social work, vocational counseling,
117117 13 psychology, pastoral counseling, or family therapy or a
118118 14 related field, who has successfully completed a practicum
119119 15 or internship that included a minimum of 1,000 hours of
120120 16 supervised direct service, or who has one year of clinical
121121 17 experience under the supervision of a qualified mental
122122 18 health professional.
