Tracy Katz Muhl SYNOPSIS AS INTRODUCED: 20 ILCS 1305/1-41 new305 ILCS 5/5-50.5 new Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that subject to approval by the federal Centers for Medicare and Medicaid Services, both the fee-for service and managed care medical assistance programs shall reimburse qualified mental health professionals for hours spent supervising students and interns. Requires the Department of Healthcare and Family Services to establish a fee schedule for the covered services. Requires the Department to apply, by January 1, 2025, for any necessary federal waivers or approvals to implement the provisions of the amendatory Act. Requires the Department to submit to the Joint Committee on Administrative Rules a rulemaking proposal to implement the provisions of the amendatory Act as soon as practicable but no later than 6 months after the Department receives federal approval to reimburse qualified mental health professionals for hours spent supervising students and interns. Defines "qualified mental health professional". Amends the Department of Human Services Act. Provides that upon the receipt of all necessary federal waivers or approvals by the Department of Healthcare and Family Services as provided under the amendatory Act, the Department of Human Services shall reimburse qualified mental health professionals for hours spent supervising students and interns. 1  AN ACT concerning public aid.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Department of Human Services Act is amended
5  by adding Section 1-41 as follows:
6  (20 ILCS 1305/1-41 new)
7  Sec. 1-41. Qualified mental health professionals; coverage
8  for supervision hours. Upon the receipt of all necessary
9  federal waivers or approvals by the Department of Healthcare
10  and Family Services as provided under Section 5-50.5 of the
11  Illinois Public Aid Code, the Department of Human Services
12  shall reimburse qualified mental health professionals for
13  hours spent supervising students and interns. As used in this
14  Section, "qualified mental health professional" has the same
15  meaning ascribed to that term in Section 5-50.5 of the
16  Illinois Public Aid Code.
17  Section 10. The Illinois Public Aid Code is amended by
18  adding Section 5-50.5 as follows:
19  (305 ILCS 5/5-50.5 new)
20  Sec. 5-50.5. Qualified mental health professionals;
21  coverage for supervision hours.

1  (a) Subject to approval by the federal Centers for
2  Medicare and Medicaid Services, the medical assistance
3  program, including both the fee-for-service and managed care
4  medical assistance programs established under this Article,
5  shall reimburse qualified mental health professionals for
6  hours spent supervising students and interns. The Department
7  shall establish a fee schedule for services rendered under
8  this Section.
9  (b) By January 1, 2025, the Department shall apply for any
10  necessary federal waivers or approvals to implement this
11  Section. The Department shall submit to the Joint Committee on
12  Administrative Rules a rulemaking proposal to implement this
13  Section as soon as practicable but no later than 6 months after
14  federal approval is received.
15  (c) As used in this Section, "qualified mental health
16  professional" means the following:
17  (1) a licensed social worker possessing at least a
18  master's degree in social work and licensed under the
19  Clinical Social Work and Social Work Practice Act with
20  specialized training in mental health services or with at
21  least 2 years' experience in mental health services;
22  (2) a licensed professional counselor possessing at
23  least a master's degree and licensed under the
24  Professional Counselor and Clinical Professional Counselor
25  Licensing and Practice Act with specialized training in
26  mental health services or with at least 2 years'

1  experience in mental health services;
2  (3) a registered nurse licensed under the Nurse
3  Practice Act with at least one year of clinical experience
4  in a mental health setting or who possesses a master's
5  degree in psychiatric nursing;
6  (4) an occupational therapist licensed under the
7  Illinois Occupational Therapy Practice Act with at least
8  one year of clinical experience in a mental health
9  setting; or
10  (5) an individual possessing at least a master's
11  degree in counseling and guidance, rehabilitation
12  counseling, social work, vocational counseling,
13  psychology, pastoral counseling, or family therapy or a
14  related field, who has successfully completed a practicum
15  or internship that included a minimum of 1,000 hours of
16  supervised direct service, or who has one year of clinical
17  experience under the supervision of a qualified mental
18  health professional.
