Provides that a county or municipality may not adopt, enforce, or implement an ordinance, resolution, policy, program, or other regulation affecting a tenancy that (1) imposes or threatens to impose a penalty against a resident, property owner, tenant, landlord, or other person solely as a consequence of contact with a law enforcement agency, (2) requires a property owner or landlord to do, or imposes a penalty on a property owner or landlord for the failure to do, specified things, (3) defines as a nuisance, any contact by a tenant with a law enforcement agency, any request by a tenant, landlord, resident or property owner for emergency assistance, (4) requires a tenant to obtain a certificate of occupancy as a condition of tenancy, or (5) establishes, maintains, or promotes a registry of tenants for the purposes of discouraging a landlord from renting to a tenant on the registry or excluding a tenant on the registry from rental housing within the county or municipality. Defines "penalty". Limits the concurrent exercise of home rule powers. Effective immediately. 1212 1 AN ACT concerning local government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Counties Code is amended by adding Section
1616 5 5-12022 as follows:
1717 6 (55 ILCS 5/5-12022 new)
1818 7 Sec. 5-12022. Prohibition on crime-free housing
1919 8 ordinances.
2020 9 (a) As used in this Section, "penalty against a landlord"
2121 10 includes, but is not limited to, an action against a landlord
2222 11 in response to a landlord failing to implement or enforce an
2323 12 ordinance, resolution, policy, program, or other regulation
2424 13 prohibited by this Section, including revoking, suspending, or
2525 14 refusing to issue a permit or license otherwise required by
2626 15 the county for a property owner or landlord to engage in the
2727 16 business of leasing within the county.
2828 17 (b) A county may not adopt, enforce, or implement an
2929 18 ordinance, resolution, policy, program, or other regulation
3030 19 affecting a tenancy that does any of the following:
3131 20 (1) imposes or threatens to impose a penalty against a
3232 21 resident, property owner, tenant, landlord, or other
3333 22 person solely as a consequence of contact with a law

7171 1 (2) requires a property owner or landlord to do, or
7272 2 imposes a penalty on a property owner or landlord for the
7373 3 failure to do, any of the following:
7474 4 (A) evict or penalize a tenant because of the
7575 5 tenant's association with another tenant or household
7676 6 member who has had contact with a law enforcement
7777 7 agency or has a criminal conviction;
7878 8 (B) evict, refuse to lease or renew a lease, or
7979 9 otherwise penalize a tenant because of the tenant's
8080 10 criminal history or alleged unlawful conduct or
8181 11 arrest; or
8282 12 (C) include a provision in a lease or rental
8383 13 agreement that provides as grounds for eviction, any
8484 14 cause that is in conflict with state or federal law;
8585 15 (3) defines as a nuisance any contact by a tenant with
8686 16 a law enforcement agency or any request by a tenant,
8787 17 landlord, resident or property owner for emergency
8888 18 assistance;
8989 19 (4) requires a tenant to obtain a certificate of
9090 20 occupancy as a condition of tenancy; or
9191 21 (5) establishes, maintains, or promotes a registry of
9292 22 tenants for the purposes of discouraging a landlord from
9393 23 renting to a tenant on the registry or excluding a tenant
9494 24 on the registry from rental housing within the county.
9595 25 (c) A home rule county may not regulate tenancy in a manner
9696 26 inconsistent with this Section. This Section is a limitation

141141 1 imposes a penalty on a property owner or landlord for the
142142 2 failure to do, any of the following:
143143 3 (A) evict or penalize a tenant because of the
