4	4		2 Be it enacted by the People of the State of Illinois,
5	5		3 represented in the General Assembly:
6	6		4 Section 5. Property. In consideration of the lands
7	7		5 reserved for Chief Shab-eh-nay by the Treaty of Prairie du
8	8		6 Chien of July 29, 1829, as well as the Prairie Band Potawatomi
9	9		7 Nation's historic connection to those lands and the
10	10		8 surrounding area, the Director of Natural Resources, on behalf
11	11		9 of the State of Illinois, is authorized to execute and deliver
12	12		10 to the Prairie Band Potawatomi Nation, for and in
13	13		11 consideration of $1 paid to the Department of Natural
14	14		12 Resources, a quit claim deed to the following described real
15	15		13 property comprising all of the lands within Shabbona Lake and
16	16		14 State Park, located in DeKalb County, owned by the State of
17	17		15 Illinois:

1194	1194		10 5 shall be made subject to existing public utilities, existing
1195	1195		11 public roads, and any and all reservations, easements,
1196	1196		12 encumbrances, licenses, covenants, and restrictions of record.
1197	1197		13 Section 15. Recording. The Director of Natural Resources
1198	1198		14 shall obtain a certified copy of this Act within 60 days after
1199	1199		15 its effective date. The Department of Natural Resources shall
1200	1200		16 ensure that a certified copy of this Act and any quit claim
1201	1201		17 deed executed pursuant to this Act that is provided to the
1202	1202		18 Prairie Band Potawatomi Nation shall be recorded by the
1203	1203		19 Prairie Band Potawatomi Nation in the Recorder's Office of the
1204	1204		20 county in which the land is located.

1220	1220		3 (a) The Department of Natural Resources may enter into a
1221	1221		4 land management agreement with the Prairie Band Potawatomi
1222	1222		5 Nation and other necessary parties for the purpose of
1223	1223		6 managing, maintaining, or operating the real property conveyed
1224	1224		7 to the Prairie Band Potawatomi Nation by this amendatory Act
1225	1225		8 of the 103rd General Assembly. Any such agreement shall
1226	1226		9 contain the purpose, powers, rights, objectives, and
1227	1227		10 responsibilities of each contracting party and a requirement
1228	1228		11 that the land conveyed by this amendatory Act of the 103rd
1229	1229		12 General Assembly remain open for public recreation during the
1230	1230		13 term of any such agreement. All agreements entered into
1231	1231		14 pursuant to this Section shall be subject to the written
1232	1232		15 approval of the Director of Natural Resources.
1233	1233		16 (b) Subject to appropriation, the Department of Natural
1234	1234		17 Resources may use State resources for the management,
1235	1235		18 maintenance, and operation of the real property conveyed to
1236	1236		19 the Prairie Band Potawatomi Nation by this amendatory Act in
1237	1237		20 accordance with the land management agreement that it executes
1238	1238		21 with the Prairie Band Potawatomi Nation under this Section.
1239	1239		22 (c) In this Section, "land management agreement" means one
1240	1240		23 or more agreements, or set of agreements, made for the purpose
1241	1241		24 of managing, maintaining, or operating the real property
1242	1242		25 conveyed to the Prairie Band Potawatomi Nation by this
1243	1243		26 amendatory Act of the 103rd General Assembly.
