2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. Property. In consideration of the lands
5 reserved for Chief Shab-eh-nay by the Treaty of Prairie du
6 Chien of July 29, 1829, as well as the Prairie Band Potawatomi
7 Nation's historic connection to those lands and the
8 surrounding area, the Director of Natural Resources, on behalf
9 of the State of Illinois, is authorized to execute and deliver
10 to the Prairie Band Potawatomi Nation, for and in
11 consideration of $1 paid to the Department of Natural
12 Resources, a quit claim deed to the following described real
13 property comprising all of the lands within Shabbona Lake and
14 State Park, located in DeKalb County, owned by the State of
15 Illinois:

9 Section 10. Conveyance.
10 (a) Subject to the conditions set forth in subsections
11 (b), (c), and (d), the Director of Natural Resources, on
12 behalf of the State of Illinois and the Department of Natural
13 Resources, shall convey by quit claim deed all right, title,
14 and interest of the State of Illinois and the Department of
15 Natural Resources in and to the real property described in
16 Section 5 to the Prairie Band Potawatomi Nation.
17 (b) The conveyance of real property authorized by Section
18 5 shall be made so long as the conveyance to the Prairie Band
19 Potawatomi Nation does not violate any federal funding
20 restrictions, nor violate the terms of any federal grant, nor
21 require the Department to reimburse, refund, or provide
22 replacement land to the federal government (U.S. Fish and
23 Wildlife Service, National Park Service, or the U.S.
24 Department of the Interior) for federal grant funds awarded to
25 the Department to acquire property, construct infrastructure

1 and enhance the natural habitat or provide recreational
2 opportunities for public use at the Shabbona Lake and State
3 Park.
4 (c) The conveyance of real property authorized by Section
5 5 shall be made so long as the Department of Natural Resources
6 and the Prairie Band of the Potawatomi Nation enter into a land
7 management agreement pursuant to Section 3b of the State Parks
8 Act.
9 (d) The conveyance of real property authorized by Section
10 5 shall be made subject to existing public utilities, existing
11 public roads, and any and all reservations, easements,
12 encumbrances, licenses, covenants, and restrictions of record.
13 Section 15. Recording. The Director of Natural Resources
14 shall obtain a certified copy of this Act within 60 days after
15 its effective date. The Department of Natural Resources shall
16 ensure that a certified copy of this Act and any quit claim
17 deed executed pursuant to this Act that is provided to the
18 Prairie Band Potawatomi Nation shall be recorded by the
19 Prairie Band Potawatomi Nation in the Recorder's Office of the
20 county in which the land is located.
21 Section 90. The State Parks Act is amended by adding
22 Section 3b as follows:

1 Sec. 3b. Shabbona Lake and State Park; land management
2 agreement.
3 (a) The Department of Natural Resources may enter into a
4 land management agreement with the Prairie Band Potawatomi
5 Nation and other necessary parties for the purpose of
6 managing, maintaining, or operating the real property conveyed
7 to the Prairie Band Potawatomi Nation by this amendatory Act
8 of the 103rd General Assembly. Any such agreement shall
9 contain the purpose, powers, rights, objectives, and
10 responsibilities of each contracting party and a requirement
11 that the land conveyed by this amendatory Act of the 103rd
12 General Assembly remain open for public recreation during the
13 term of any such agreement. All agreements entered into
14 pursuant to this Section shall be subject to the written
15 approval of the Director of Natural Resources.
16 (b) Subject to appropriation, the Department of Natural
17 Resources may use State resources for the management,
18 maintenance, and operation of the real property conveyed to
19 the Prairie Band Potawatomi Nation by this amendatory Act in
20 accordance with the land management agreement that it executes
21 with the Prairie Band Potawatomi Nation under this Section.
22 (c) In this Section, "land management agreement" means one
23 or more agreements, or set of agreements, made for the purpose
24 of managing, maintaining, or operating the real property
25 conveyed to the Prairie Band Potawatomi Nation by this
26 amendatory Act of the 103rd General Assembly.
