1919 1 AN ACT concerning education.
2020 2 Be it enacted by the People of the State of Illinois,
2121 3 represented in the General Assembly:
2222 4 Section 5. The University of Illinois Act is amended by
2323 5 changing the title of the Act and Section 7e-5 as follows:

2525 7 Sec. 7e-5. In-state tuition charge.
2626 8 (a) Notwithstanding any other provision of law to the
2727 9 contrary, at a minimum, for tuition purposes, the Board of
2828 10 Trustees shall deem an individual an Illinois resident, until
2929 11 the individual establishes a residence outside of this State,
3030 12 if all of the following conditions are met:
3131 13 (1) The individual enrolls in or attains credits at
3232 14 any of the following: The individual resided with his or
3333 15 her parent or guardian while attending a public or private
3434 16 high school in this State.
3535 17 (A) a public or private elementary school in this
3636 18 State;
3737 19 (B) a public or private high school in this State;
3838 20 (C) an adult school organized under the Public

109109 18 the University not earlier than the 2003 fall semester.
110110 19 (5) In the case of an individual who is not a citizen
111111 20 or a permanent resident of the United States, the
112112 21 individual provides the University with an affidavit
113113 22 stating that the individual will file an application to
114114 23 become a permanent resident of the United States at the
115115 24 earliest opportunity the individual is eligible to do so.
116116 25 This subsection (a) applies only to tuition for a term or
117117 26 semester that begins on or after May 20, 2003 (the effective

139139 12 her dependents Illinois residents for tuition purposes, as
140140 13 long as that person or his or her dependent (i) applies for
141141 14 admission to the University within 18 months of the person on
142142 15 active military duty being reassigned or (ii) remains
143143 16 continuously enrolled at the University. Beginning with the
144144 17 2013-2014 academic year, if a person is utilizing benefits
145145 18 under the federal Post-9/11 Veterans Educational Assistance
146146 19 Act of 2008 or any subsequent variation of that Act, then the
147147 20 Board of Trustees shall deem that person an Illinois resident
148148 21 for tuition purposes. Beginning with the 2015-2016 academic
149149 22 year, if a person is utilizing benefits under the federal
150150 23 All-Volunteer Force Educational Assistance Program, then the
151151 24 Board of Trustees shall deem that person an Illinois resident

941941 2 contrary, at a minimum, for tuition purposes, the Board shall
942942 3 deem an individual an Illinois resident, until the individual
943943 4 establishes a residence outside of this State, if all of the
944944 5 following conditions are met:
945945 6 (1) The individual enrolls in or attains credits at
946946 7 any of the following: The individual resided with his or
947947 8 her parent or guardian while attending a public or private
948948 9 high school in this State.
949949 10 (A) a public or private elementary school in this
950950 11 State;
951951 12 (B) a public or private high school in this State;
952952 13 (C) an adult school organized under the Public
953953 14 Community College Act; or
954954 15 (D) a community college campus organized under the
955955 16 Public Community College Act.
956956 17 (2) The individual satisfies any of the following:
957957 18 (A) the The individual graduated from a public or
958958 19 private high school or received the equivalent of a
959959 20 high school diploma in this State.
960960 21 (B) the individual attained an associate's degree
961961 22 from a community college campus organized under the
962962 23 Public Community College Act; or
963963 24 (C) the individual fulfilled the minimum transfer
964964 25 requirements established by Chicago State University

977977 2 College Act.
978978 3 (3) (Blank.) The individual attended school in this
979979 4 State for at least 3 years as of the date the individual
980980 5 graduated from high school or received the equivalent of a
981981 6 high school diploma.
982982 7 (4) The individual registers as an entering student in
983983 8 the University not earlier than the 2003 fall semester.
984984 9 (5) In the case of an individual who is not a citizen
985985 10 or a permanent resident of the United States, the
986986 11 individual provides the University with an affidavit
987987 12 stating that the individual will file an application to
988988 13 become a permanent resident of the United States at the
989989 14 earliest opportunity the individual is eligible to do so.
990990 15 This subsection (a) applies only to tuition for a term or
991991 16 semester that begins on or after May 20, 2003 (the effective
992992 17 date of Public Act 93-7). Any revenue lost by the University in
993993 18 implementing this subsection (a) shall be absorbed by the
994994 19 University Income Fund.
995995 20 (b) If a person is on active military duty and stationed in
996996 21 Illinois, then the Board shall deem that person and any of his
997997 22 or her dependents Illinois residents for tuition purposes.
998998 23 Beginning with the 2009-2010 academic year, if a person is on
999999 24 active military duty and is stationed out of State, but he or
10001000 25 she was stationed in this State for at least 3 years

10121012 1 Board shall deem that person and any of his or her dependents
10131013 2 Illinois residents for tuition purposes, as long as that
10141014 3 person or his or her dependent (i) applies for admission to the
10151015 4 University within 18 months of the person on active military
10161016 5 duty being reassigned or (ii) remains continuously enrolled at
10171017 6 the University. Beginning with the 2013-2014 academic year, if
10181018 7 a person is utilizing benefits under the federal Post-9/11
10191019 8 Veterans Educational Assistance Act of 2008 or any subsequent
10201020 9 variation of that Act, then the Board shall deem that person an
10211021 10 Illinois resident for tuition purposes. Beginning with the
10221022 11 2015-2016 academic year, if a person is utilizing benefits
10231023 12 under the federal All-Volunteer Force Educational Assistance
10241024 13 Program, then the Board shall deem that person an Illinois
10251025 14 resident for tuition purposes. Beginning with the 2019-2020
10261026 15 academic year, per the federal requirements for maintaining
10271027 16 approval for veterans' education benefits under 38 U.S.C.
10281028 17 3679(c), if a person is on active military duty or is receiving
10291029 18 veterans' education benefits, then the Board of Trustees shall
10301030 19 deem that person an Illinois resident for tuition purposes for
10311031 20 any academic quarter, semester, or term, as applicable.
