19	19	1 AN ACT concerning education.
20	20	2 Be it enacted by the People of the State of Illinois,
21	21	3 represented in the General Assembly:
22	22	4 Section 5. The University of Illinois Act is amended by
23	23	5 changing the title of the Act and Section 7e-5 as follows:
24	24	6 (110 ILCS 305/7e-5)
25	25	7 Sec. 7e-5. In-state tuition charge.
26	26	8 (a) Notwithstanding any other provision of law to the
27	27	9 contrary, at a minimum, for tuition purposes, the Board of
28	28	10 Trustees shall deem an individual an Illinois resident, until
29	29	11 the individual establishes a residence outside of this State,
30	30	12 if all of the following conditions are met:
31	31	13 (1) The individual enrolls in or attains credits at
32	32	14 any of the following: The individual resided with his or
33	33	15 her parent or guardian while attending a public or private
34	34	16 high school in this State.
35	35	17 (A) a public or private elementary school in this
36	36	18 State;
37	37	19 (B) a public or private high school in this State;
38	38	20 (C) an adult school organized under the Public
39	39	21 Community College Act; or
40	40	22 (D) a community college campus organized under the

105	105	14 State for at least 3 years as of the date the individual
106	106	15 graduated from high school or received the equivalent of a
107	107	16 high school diploma.
108	108	17 (4) The individual registers as an entering student in
109	109	18 the University not earlier than the 2003 fall semester.
110	110	19 (5) In the case of an individual who is not a citizen
111	111	20 or a permanent resident of the United States, the
112	112	21 individual provides the University with an affidavit
113	113	22 stating that the individual will file an application to
114	114	23 become a permanent resident of the United States at the
115	115	24 earliest opportunity the individual is eligible to do so.
116	116	25 This subsection (a) applies only to tuition for a term or
117	117	26 semester that begins on or after May 20, 2003 (the effective

129	129	2 implementing this subsection (a) shall be absorbed by the
130	130	3 University Income Fund.
131	131	4 (b) If a person is on active military duty and stationed in
132	132	5 Illinois, then the Board of Trustees shall deem that person
133	133	6 and any of his or her dependents Illinois residents for
134	134	7 tuition purposes. Beginning with the 2009-2010 academic year,
135	135	8 if a person is on active military duty and is stationed out of
136	136	9 State, but he or she was stationed in this State for at least 3
137	137	10 years immediately prior to being reassigned out of State, then
138	138	11 the Board of Trustees shall deem that person and any of his or
139	139	12 her dependents Illinois residents for tuition purposes, as
140	140	13 long as that person or his or her dependent (i) applies for
141	141	14 admission to the University within 18 months of the person on
142	142	15 active military duty being reassigned or (ii) remains
143	143	16 continuously enrolled at the University. Beginning with the
144	144	17 2013-2014 academic year, if a person is utilizing benefits
145	145	18 under the federal Post-9/11 Veterans Educational Assistance
146	146	19 Act of 2008 or any subsequent variation of that Act, then the
147	147	20 Board of Trustees shall deem that person an Illinois resident
148	148	21 for tuition purposes. Beginning with the 2015-2016 academic
149	149	22 year, if a person is utilizing benefits under the federal
150	150	23 All-Volunteer Force Educational Assistance Program, then the
151	151	24 Board of Trustees shall deem that person an Illinois resident
152	152	25 for tuition purposes. Beginning with the 2019-2020 academic

913	913	8 variation of that Act, then the Board shall deem that person an
914	914	9 Illinois resident for tuition purposes. Beginning with the
915	915	10 2015-2016 academic year, if a person is utilizing benefits
916	916	11 under the federal All-Volunteer Force Educational Assistance
917	917	12 Program, then the Board shall deem that person an Illinois
918	918	13 resident for tuition purposes. Beginning with the 2019-2020
919	919	14 academic year, per the federal requirements for maintaining
920	920	15 approval for veterans' education benefits under 38 U.S.C.
921	921	16 3679(c), if a person is on active military duty or is receiving
922	922	17 veterans' education benefits, then the Board of Trustees shall
923	923	18 deem that person an Illinois resident for tuition purposes for
924	924	19 any academic quarter, semester, or term, as applicable.

940	940	1 (a) Notwithstanding any other provision of law to the
941	941	2 contrary, at a minimum, for tuition purposes, the Board shall
942	942	3 deem an individual an Illinois resident, until the individual
943	943	4 establishes a residence outside of this State, if all of the
944	944	5 following conditions are met:
945	945	6 (1) The individual enrolls in or attains credits at
946	946	7 any of the following: The individual resided with his or
947	947	8 her parent or guardian while attending a public or private
948	948	9 high school in this State.
949	949	10 (A) a public or private elementary school in this
950	950	11 State;
951	951	12 (B) a public or private high school in this State;
952	952	13 (C) an adult school organized under the Public
953	953	14 Community College Act; or
954	954	15 (D) a community college campus organized under the
955	955	16 Public Community College Act.
956	956	17 (2) The individual satisfies any of the following:
957	957	18 (A) the The individual graduated from a public or
958	958	19 private high school or received the equivalent of a
959	959	20 high school diploma in this State.
960	960	21 (B) the individual attained an associate's degree
961	961	22 from a community college campus organized under the
962	962	23 Public Community College Act; or
963	963	24 (C) the individual fulfilled the minimum transfer
964	964	25 requirements established by Chicago State University
965	965	26 for students transferring from a campus of a community

977	977	2 College Act.
978	978	3 (3) (Blank.) The individual attended school in this
979	979	4 State for at least 3 years as of the date the individual
980	980	5 graduated from high school or received the equivalent of a
981	981	6 high school diploma.
982	982	7 (4) The individual registers as an entering student in
983	983	8 the University not earlier than the 2003 fall semester.
984	984	9 (5) In the case of an individual who is not a citizen
985	985	10 or a permanent resident of the United States, the
986	986	11 individual provides the University with an affidavit
987	987	12 stating that the individual will file an application to
988	988	13 become a permanent resident of the United States at the
989	989	14 earliest opportunity the individual is eligible to do so.
990	990	15 This subsection (a) applies only to tuition for a term or
991	991	16 semester that begins on or after May 20, 2003 (the effective
992	992	17 date of Public Act 93-7). Any revenue lost by the University in
993	993	18 implementing this subsection (a) shall be absorbed by the
994	994	19 University Income Fund.
995	995	20 (b) If a person is on active military duty and stationed in
996	996	21 Illinois, then the Board shall deem that person and any of his
997	997	22 or her dependents Illinois residents for tuition purposes.
998	998	23 Beginning with the 2009-2010 academic year, if a person is on
999	999	24 active military duty and is stationed out of State, but he or
1000	1000	25 she was stationed in this State for at least 3 years
1001	1001	26 immediately prior to being reassigned out of State, then the
