1  AN ACT concerning education.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The University of Illinois Act is amended by
5  changing the title of the Act and Section 7e-5 as follows:
6  (110 ILCS 305/7e-5)
7  Sec. 7e-5. In-state tuition charge.
8  (a) Notwithstanding any other provision of law to the
9  contrary, at a minimum, for tuition purposes, the Board of
10  Trustees shall deem an individual an Illinois resident, until
11  the individual establishes a residence outside of this State,
12  if all of the following conditions are met:
13  (1) The individual enrolls in or attains credits at
14  any of the following: The individual resided with his or
15  her parent or guardian while attending a public or private
16  high school in this State.
17  (A) a public or private elementary school in this
18  State;
19  (B) a public or private high school in this State;
20  (C) an adult school organized under the Public
21  Community College Act; or
22  (D) a community college campus organized under the
23  Public Community College Act.

11  college campus organized under the Public Community
12  College Act.
13  (3) (Blank.) The individual attended school in this
14  State for at least 3 years as of the date the individual
15  graduated from high school or received the equivalent of a
16  high school diploma.
17  (4) The individual registers as an entering student in
18  the University not earlier than the 2003 fall semester.
19  (5) In the case of an individual who is not a citizen
20  or a permanent resident of the United States, the
21  individual provides the University with an affidavit
22  stating that the individual will file an application to
23  become a permanent resident of the United States at the
24  earliest opportunity the individual is eligible to do so.
25  This subsection (a) applies only to tuition for a term or
26  semester that begins on or after May 20, 2003 (the effective

2  implementing this subsection (a) shall be absorbed by the
3  University Income Fund.
4  (b) If a person is on active military duty and stationed in
5  Illinois, then the Board of Trustees shall deem that person
6  and any of his or her dependents Illinois residents for
7  tuition purposes. Beginning with the 2009-2010 academic year,
8  if a person is on active military duty and is stationed out of
9  State, but he or she was stationed in this State for at least 3
10  years immediately prior to being reassigned out of State, then
11  the Board of Trustees shall deem that person and any of his or
12  her dependents Illinois residents for tuition purposes, as
13  long as that person or his or her dependent (i) applies for
14  admission to the University within 18 months of the person on
15  active military duty being reassigned or (ii) remains
16  continuously enrolled at the University. Beginning with the
17  2013-2014 academic year, if a person is utilizing benefits
18  under the federal Post-9/11 Veterans Educational Assistance
19  Act of 2008 or any subsequent variation of that Act, then the
20  Board of Trustees shall deem that person an Illinois resident
21  for tuition purposes. Beginning with the 2015-2016 academic
22  year, if a person is utilizing benefits under the federal
23  All-Volunteer Force Educational Assistance Program, then the
24  Board of Trustees shall deem that person an Illinois resident

9  8d-5 as follows:
