37+A BILL FOR AN ACT to amend the Indiana Code concerning
38+general provisions.
1339 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 1-3-3 IS ADDED TO THE INDIANA CODE AS
15-A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
16-1, 2025]:
17-Chapter 3. Indiana-Illinois Boundary Adjustment Commission
18-Sec. 1. As used in this chapter, "commission" refers to the
19-Indiana-Illinois boundary adjustment commission established by
20-section 3 of this chapter.
21-Sec. 2. As used in this chapter, "Indiana member" refers to a
22-commission member appointed under section 4(a)(1) of this
23-chapter.
24-Sec. 3. The Indiana-Illinois boundary adjustment commission is
25-established.
26-Sec. 4. (a) The commission consists of the following members:
27-(1) Six (6) individuals who are not members of the general
28-assembly appointed by the governor. Not more than four (4)
29-members appointed under this subdivision may be members
30-of the same political party.
31-(2) Five (5) individuals from the State of Illinois appointed
32-under Illinois law.
33-(b) The governor shall notify the governor of the State of Illinois
34-that the governor has appointed members to the commission under
35-HEA 1008 — Concur 2
36-subsection (a).
37-(c) The governor shall schedule the first meeting of the
38-commission not later than September 1, 2025. At the commission's
39-first meeting, the members shall elect from the commission's
40-members:
41-(1) the commission's chair; and
42-(2) other officers the commission considers necessary or
43-appropriate.
44-Sec. 5. (a) This section applies only to an Indiana member.
45-(b) A member of the commission serves a four (4) year term that
46-expires on June 30 of an odd-numbered year.
47-(c) A member of the commission may be reappointed to
48-successive terms.
49-(d) The governor shall fill a vacancy on the commission. An
50-individual appointed to fill a vacancy serves for the unexpired term
51-of the individual's predecessor.
52-Sec. 6. The commission shall meet at least once each calendar
53-year. The commission may meet more frequently:
54-(1) at the call of the chair; or
55-(2) if six (6) or more commission members request a meeting.
56-Sec. 7. (a) This section applies only to an Indiana member.
57-(b) Each member of the commission who is not a state employee
58-is entitled to receive the same per diem, mileage, and travel
59-allowances paid to individuals who serve as legislative and lay
60-members, respectively, of interim study committees established by
61-the legislative council.
62-(c) Each member of the commission who is a state employee is
63-entitled to reimbursement for traveling expenses as provided under
64-IC 4-13-1-4 and other expenses actually incurred in connection
65-with the member's duties as provided in the state policies and
66-procedures established by the Indiana department of
67-administration and approved by the budget agency.
68-(d) Per diem, mileage, and travel allowances paid under this
69-chapter shall be paid from appropriations made to the governor's
70-office.
71-Sec. 8. (a) A quorum of the commission consists of at least six (6)
72-members.

102+2 testimony, and hold discussion.
103+3 Sec. 9. The commission's business must be conducted during a
104+4 public meeting held in compliance with IC 5-14-1.5.
105+5 Sec. 10. A writing prepared by, owned by, used by, in the
106+6 possession of, or retained by the commission in the performance of
107+7 an official function of the commission is a public record as
108+8 provided in IC 5-14-3.
109+9 Sec. 11. The governor shall designate an agency of the executive
110+10 branch to serve as a staff agency for the commission.
111+11 Sec. 12. The commission shall discuss and recommend whether
112+12 it is advisable to adjust the boundary between the State of Indiana
113+13 and the State of Illinois.
114+14 Sec. 13. Not later than sixty (60) days after the completion of the
115+15 commission's duties under this chapter, the commission shall
116+16 submit a written report to the general assembly in an electronic
117+17 format under IC 5-14-6. The report must state the following:
118+18 (1) A summary of the commission's work performed under
119+19 this chapter.
120+20 (2) The commission's recommendations, including any
121+21 legislation recommended by the commission.
122+22 Sec. 14. A commission recommendation to adjust the boundary
123+23 between the State of Indiana and the State of Illinois does not take
124+24 effect until approved by all of the following:
125+25 (1) The general assembly.
126+26 (2) The legislature of the State of Illinois.
127+27 (3) The Congress of the United States.
