HOUSE ENROLLED ACT No. 1008 AN ACT to amend the Indiana Code concerning general provisions. Be it enacted by the General Assembly of the State of Indiana: SECTION 1. IC 1-3-3 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2025]: Chapter 3. Indiana-Illinois Boundary Adjustment Commission Sec. 1. As used in this chapter, "commission" refers to the Indiana-Illinois boundary adjustment commission established by section 3 of this chapter. Sec. 2. As used in this chapter, "Indiana member" refers to a commission member appointed under section 4(a)(1) of this chapter. Sec. 3. The Indiana-Illinois boundary adjustment commission is established. Sec. 4. (a) The commission consists of the following members: (1) Six (6) individuals who are not members of the general assembly appointed by the governor. Not more than four (4) members appointed under this subdivision may be members of the same political party. (2) Five (5) individuals from the State of Illinois appointed under Illinois law. (b) The governor shall notify the governor of the State of Illinois that the governor has appointed members to the commission under HEA 1008 — Concur 2 subsection (a). (c) The governor shall schedule the first meeting of the commission not later than September 1, 2025. At the commission's first meeting, the members shall elect from the commission's members: (1) the commission's chair; and (2) other officers the commission considers necessary or appropriate. Sec. 5. (a) This section applies only to an Indiana member. (b) A member of the commission serves a four (4) year term that expires on June 30 of an odd-numbered year. (c) A member of the commission may be reappointed to successive terms. (d) The governor shall fill a vacancy on the commission. An individual appointed to fill a vacancy serves for the unexpired term of the individual's predecessor. Sec. 6. The commission shall meet at least once each calendar year. The commission may meet more frequently: (1) at the call of the chair; or (2) if six (6) or more commission members request a meeting. Sec. 7. (a) This section applies only to an Indiana member. (b) Each member of the commission who is not a state employee is entitled to receive the same per diem, mileage, and travel allowances paid to individuals who serve as legislative and lay members, respectively, of interim study committees established by the legislative council. (c) Each member of the commission who is a state employee is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency. (d) Per diem, mileage, and travel allowances paid under this chapter shall be paid from appropriations made to the governor's office. Sec. 8. (a) A quorum of the commission consists of at least six (6) members. (b) A quorum is necessary for the commission to take official action. A quorum is not required for the committee to meet, take testimony, and hold discussion. Sec. 9. The commission's business must be conducted during a public meeting held in compliance with IC 5-14-1.5. HEA 1008 — Concur 3 Sec. 10. A writing prepared by, owned by, used by, in the possession of, or retained by the commission in the performance of an official function of the commission is a public record as provided in IC 5-14-3. Sec. 11. The governor shall designate an agency of the executive branch to serve as a staff agency for the commission. Sec. 12. The commission shall discuss and recommend whether it is advisable to adjust the boundary between the State of Indiana and the State of Illinois. Sec. 13. Not later than sixty (60) days after the completion of the commission's duties under this chapter, the commission shall submit a written report to the general assembly in an electronic format under IC 5-14-6. The report must state the following: (1) A summary of the commission's work performed under this chapter. (2) The commission's recommendations, including any legislation recommended by the commission. Sec. 14. A commission recommendation to adjust the boundary between the State of Indiana and the State of Illinois does not take effect until approved by all of the following: (1) The general assembly. (2) The legislature of the State of Illinois. (3) The Congress of the United States.
