10 | 10 | | cardiac emergency response grant fund. |

11 | 11 | | Be it enacted by the Legislature of the State of Kansas: |
---|
12 | 12 | | Section 1. (a) The state board of education shall develop and adopt |
---|
13 | 13 | | statewide standards for school safety and security plans and cardiac |
---|
14 | 14 | | emergency response plans. In developing such standards, the state board of |
---|
15 | 15 | | education shall consult with the office of the adjutant general, the Kansas |
---|
16 | 16 | | bureau of investigation, the department of health and environment, the |
---|
17 | 17 | | state fire marshal and any other state agencies, municipal agencies and |
---|
18 | 18 | | school boards as the state board deems necessary. |
---|
19 | 19 | | (b) The standards developed by the state board of education shall |
---|
20 | 20 | | include, but shall not be limited to: |
---|
21 | 21 | | (1) Evaluation of the infrastructure of school buildings and |
---|
22 | 22 | | attendance centers for compliance with standards adopted under |
---|
23 | 23 | | subsections (e) and (f); |
---|
24 | 24 | | (2) training of school district employees on school safety and security |
---|
25 | 25 | | policies and procedures and cardiac emergency response policies and |
---|
26 | 26 | | procedures; |
---|
27 | 27 | | (3) conducting student drills on emergency situations; |
---|
28 | 28 | | (4) procedures for making notifications to individuals located outside |
---|
29 | 29 | | of the school building during emergency situations and maintaining |
---|
30 | 30 | | communication with law enforcement agencies, emergency management |
---|
31 | 31 | | agencies, emergency medical services and other necessary individuals; |
---|
32 | 32 | | (5) procedures for securing school buildings during an emergency |
---|
33 | 33 | | situation; |
---|
34 | 34 | | (6) procedures for emergency evacuation of school buildings, |
---|
35 | 35 | | including evacuation routes and sites; |
---|
36 | 36 | | (7) procedures for recovery after an emergency situation ceases; |
---|
37 | 37 | | (8) coordination and incorporation of school safety and security plans |
---|
38 | 38 | | and cardiac emergency response plans within existing school district |
---|
39 | 39 | | emergency response plans; |
---|

---|
76 | 76 | | emergency response plans to local law enforcement agencies and |
---|
77 | 77 | | emergency management agencies; |
---|
78 | 78 | | (10) procedures for ensuring accountability in adopting and |
---|
79 | 79 | | implementing school safety and security plans and cardiac emergency |
---|
80 | 80 | | response plans in accordance with the statewide standards adopted by the |
---|
81 | 81 | | state board; and |
---|
82 | 82 | | (11) any other policies and procedures the state board deems |
---|
83 | 83 | | necessary for school safety and security plans or cardiac emergency |
---|
84 | 84 | | response plans. |
---|
85 | 85 | | (c) As part of such standards, the state board shall identify roles and |
---|
86 | 86 | | responsibilities for implementing school safety and security plans and |
---|
87 | 87 | | cardiac emergency response plans at the school district and school building |
---|
88 | 88 | | levels, including, but not limited to, the role of local law enforcement |
---|
89 | 89 | | agencies and local emergency management agencies when partnering with |
---|
90 | 90 | | school districts in the development and implementation of such plans. |
---|
91 | 91 | | (d) The state board may consider and utilize any materials, |
---|
92 | 92 | | documentation or videos that are available through the United States |
---|
93 | 93 | | department of homeland security in developing standards for school safety |
---|
94 | 94 | | and security plans, and any such resources that are available through the |
---|
95 | 95 | | United States department of health and human services, the American |
---|
96 | 96 | | heart association or any other nationally recognized, guidelines-based |
---|
97 | 97 | | organization focused on emergency cardiovascular care in developing |
---|
98 | 98 | | standards for cardiac emergency response plans. |
---|
99 | 99 | | (e) The statewide standards for school safety and security plans shall |
---|
100 | 100 | | address, but shall not be limited to: |
---|
101 | 101 | | (1) The infrastructure of school buildings and attendance centers |
---|
102 | 102 | | operated by school districts, including, but not limited to, secured |
---|
103 | 103 | | entrances, windows and other facets of the structural integrity of such |
---|
104 | 104 | | buildings; |
---|
105 | 105 | | (2) security technology to be utilized in such buildings, including, but |
---|
106 | 106 | | not limited to, intrusion detection systems and security cameras; |
---|
107 | 107 | | (3) communications systems, including, but not limited to, systems |
---|
108 | 108 | | for interoperability between the school district and law enforcement |
---|
109 | 109 | | agencies; and |
---|
110 | 110 | | (4) any other systems or facilities the state board deems necessary for |
---|
111 | 111 | | the safety and security of such buildings. |
---|
112 | 112 | | (f) The statewide standards for cardiac emergency response plans |
---|
113 | 113 | | shall address, but shall not be limited to: |
---|
114 | 114 | | (1) The appropriate use of school personnel to respond to incidents |
---|
115 | 115 | | involving an individual experiencing suspected sudden cardiac arrest while |
---|
116 | 116 | | on school grounds, including incidents involving an individual attending |
---|
117 | 117 | | or participating in an athletic practice or event, whether such practice or |
---|

---|
162 | 162 | | (2) establishing a cardiac emergency response team; |
---|
163 | 163 | | (3) implementing placement of automated external defibrillators and |
---|
164 | 164 | | routine maintenance of such devices within school buildings, including |
---|
165 | 165 | | appropriate placement in accordance with guidelines established by the |
---|
166 | 166 | | American heart association or any nationally recognized, guidelines-based |
---|
167 | 167 | | organization focused on emergency cardiovascular care; |
---|
168 | 168 | | (4) identifying the location of each automated external defibrillator; |
---|
169 | 169 | | (5) training of school personnel in the use of automated external |
---|
170 | 170 | | defibrillators and cardiopulmonary resuscitation during an emergency in |
---|
171 | 171 | | accordance with guidelines established by the American heart association |
---|
172 | 172 | | or any nationally recognized, guidelines-based organization focused on |
---|
173 | 173 | | emergency cardiovascular care; |
---|
174 | 174 | | (6) communications systems with local emergency medical services; |
---|
175 | 175 | | and |
---|
176 | 176 | | (7) developing an event-specific emergency action plan for each |
---|
177 | 177 | | school-sanctioned event held at a location separate from school grounds |
---|
178 | 178 | | that includes: |
---|
179 | 179 | | (A) The roles of school and emergency medical services personnel, |
---|
180 | 180 | | communications systems and available emergency equipment, including a |
---|
181 | 181 | | portable automated external defibrillator; and |
---|
182 | 182 | | (B) access to and plan for emergency transport. |
---|
183 | 183 | | (g) The state board shall regularly review and update the standards |
---|
184 | 184 | | for school safety and security plans and cardiac emergency response plans. |
---|
185 | 185 | | Any changes to such standards shall be provided to each school district by |
---|
186 | 186 | | written notification upon adoption by the state board. |
---|
187 | 187 | | (h) The state board shall provide notice of the adopted standards to |
---|
188 | 188 | | those state agencies with whom the state board consulted in developing |
---|
189 | 189 | | such standards. To the extent such standards contain emergency or security |
---|
190 | 190 | | information or procedures, the state board shall maintain the |
---|
191 | 191 | | confidentiality of such standards when sending notices pursuant to this |
---|
192 | 192 | | subsection. |
---|
193 | 193 | | Sec. 2. (a) The board of education of each school district shall adopt a |
---|
194 | 194 | | comprehensive school safety and security plan based on the statewide |
---|
195 | 195 | | standards adopted by the state board of education under section 1, and |
---|
196 | 196 | | amendments thereto. Prior to the adoption of a school safety and security |
---|
197 | 197 | | plan, each school district shall consult with one or more local law |
---|
198 | 198 | | enforcement agencies and local emergency management agencies to |
---|
199 | 199 | | review and evaluate: |
---|
200 | 200 | | (1) Existing infrastructure of school buildings and attendance centers |
---|
201 | 201 | | operated by such school district; and |
---|
202 | 202 | | (2) current school district safety and security policies and procedures. |
---|
203 | 203 | | The local law enforcement agencies and emergency management |
---|

---|
248 | 248 | | infrastructure or safety and security polices and procedures. The review |
---|
249 | 249 | | and evaluation, and any guidance provided, shall be done in accordance |
---|
250 | 250 | | with the standards adopted by the state board under section 1, and |
---|
251 | 251 | | amendments thereto. Upon adoption of a school safety and security plan, |
---|
252 | 252 | | the superintendent of the school district shall send a copy of such plan to |
---|
253 | 253 | | each local law enforcement agency and emergency management agency |
---|
254 | 254 | | with whom the school district consulted, and to the state board of |
---|
255 | 255 | | education. |
---|
256 | 256 | | (b) (1) The board of education of each school district shall adopt a |
---|
257 | 257 | | comprehensive cardiac emergency response plan based on the statewide |
---|
258 | 258 | | standards adopted by the state board of education under section 1, and |
---|
259 | 259 | | amendments thereto. |
---|
260 | 260 | | (2) Upon adoption, the cardiac emergency response plan shall be: |
---|
261 | 261 | | (A) Provided to appropriate local law enforcement and emergency |
---|
262 | 262 | | medical services and all school personnel; |
---|
263 | 263 | | (B) reviewed by a school administrator with all school personnel |
---|
264 | 264 | | prior to the first instructional day of each school year. The time and date of |
---|
265 | 265 | | such review shall be documented as part of the plan; and |
---|
266 | 266 | | (C) reviewed at the end of each school year by the school building |
---|
267 | 267 | | administrators, school nurses and appropriate local law enforcement and |
---|
268 | 268 | | emergency medical services. |
---|
269 | 269 | | (3) The cardiac emergency response plan shall be rehearsed by |
---|
270 | 270 | | simulation within 30 days prior to the beginning of each athletic season by |
---|
271 | 271 | | all athletic directors, school nurses and all coaches, assistant coaches and |
---|
272 | 272 | | athletic trainers who are coaching or otherwise participating in such |
---|
273 | 273 | | athletic season. |
---|
274 | 274 | | (4) Each athletic coach shall obtain a cardiopulmonary resuscitation |
---|
275 | 275 | | certification or training recognized by a national accrediting body on heart |
---|
276 | 276 | | health. At least one individual with such certification or training shall be in |
---|
277 | 277 | | attendance at every interscholastic athletic practice and competition. |
---|
278 | 278 | | Courses for such certification or training shall: |
---|
279 | 279 | | (A) Be reviewed at least once every 30 months and revised if needed; |
---|
280 | 280 | | (B) be completed through hands-on or online teaching methods in 10 |
---|
281 | 281 | | hours or less; and |
---|
282 | 282 | | (C) include an end-of-course examination with a minimum qualifying |
---|
283 | 283 | | score for successful course completion established by the board of |
---|
284 | 284 | | education or the entity conducting such training. |
---|
285 | 285 | | Sec. 3. (a) There is hereby established the school safety and security |
---|
286 | 286 | | grant program to be administered by the state board of education. Each |
---|
287 | 287 | | school district may submit an application to the state board of education in |
---|
288 | 288 | | such form and manner as prescribed by the state board for an amount of |
---|
289 | 289 | | grant moneys needed by such school district to implement such district's |
---|

334 | 334 | | amendments thereto. Each grant application shall include a copy of the |
---|
335 | 335 | | current school district safety and security plan, including all policies and |
---|
336 | 336 | | procedures adopted for the implementation of such plan, and a description |
---|
337 | 337 | | of the school safety and security improvements the district determines |
---|
338 | 338 | | necessary for such implementation. The state board shall review all |
---|
339 | 339 | | submitted applications and approve or deny such applications based on |
---|
340 | 340 | | whether the applicant school district has demonstrated the necessity for the |
---|
341 | 341 | | school safety and security improvements described in the application. As |
---|
342 | 342 | | part of its review, the state board may conduct a hearing and provide the |
---|
343 | 343 | | applicant school district an opportunity to present testimony as to the |
---|
344 | 344 | | necessity of such school safety and security improvements. If the state |
---|
345 | 345 | | board approves an application, it shall determine the amount of moneys to |
---|
346 | 346 | | be disbursed to the applicant school district from the school safety and |
---|
347 | 347 | | security grant fund. If the state board denies an application, then, within 15 |
---|
348 | 348 | | days of such denial, the state board shall send written notice of such denial |
---|
349 | 349 | | to the superintendent of such school district. |
---|
350 | 350 | | (b) All administrative proceedings pursuant to this section shall be |
---|
351 | 351 | | conducted in accordance with the provisions of the Kansas administrative |
---|
352 | 352 | | procedure act. Any action by the state board of education pursuant to this |
---|
353 | 353 | | section shall be subject to review in accordance with the Kansas judicial |
---|
354 | 354 | | review act. |
---|
355 | 355 | | (c) There is hereby established in the state treasury the school safety |
---|
356 | 356 | | and security grant fund to be administered by the department of education. |
---|
357 | 357 | | All expenditures from the school safety and security grant fund shall be |
---|
358 | 358 | | used for the disbursement of grant moneys for school safety and security |
---|
359 | 359 | | improvements in accordance with this section and shall be made in |
---|
360 | 360 | | accordance with appropriation acts upon warrants of the director of |
---|
361 | 361 | | accounts and reports issued pursuant to vouchers approved by the |
---|
362 | 362 | | commissioner of education or the commissioner's designee. Upon receipt |
---|
363 | 363 | | of such grant moneys, the school district treasurer shall deposit the amount |
---|
364 | 364 | | of such award in the general fund of the school district. |
---|
365 | 365 | | Sec. 4. (a) There is hereby established the school cardiac emergency |
---|
366 | 366 | | response grant program to be administered by the department of health and |
---|
367 | 367 | | environment. Each school district may submit an application to the |
---|
368 | 368 | | secretary of health and environment in such form and manner as |
---|
369 | 369 | | prescribed by the secretary for an amount of grant moneys needed by such |
---|
370 | 370 | | school district to implement such district's cardiac emergency response |
---|
371 | 371 | | plan adopted pursuant to section 2, and amendments thereto. Each grant |
---|
372 | 372 | | application shall include a copy of the current school district cardiac |
---|
373 | 373 | | emergency response plan, including all policies and procedures adopted |
---|
374 | 374 | | for the implementation of such plan, and a description of the school |
---|
375 | 375 | | improvements the district determines necessary for such implementation. |

---|
430 | 430 | | (b) All administrative proceedings pursuant to this section shall be |
---|
431 | 431 | | conducted in accordance with the provisions of the Kansas administrative |
---|
432 | 432 | | procedure act. Any action by the secretary of health and environment |
---|
433 | 433 | | pursuant to this section shall be subject to review in accordance with the |
---|
434 | 434 | | Kansas judicial review act. |
---|
435 | 435 | | (c) There is hereby established in the state treasury the school cardiac |
---|
436 | 436 | | emergency response grant fund to be administered by the department of |
---|
437 | 437 | | health and environment. All expenditures from the school cardiac |
---|
438 | 438 | | emergency response grant fund shall be used for the disbursement of grant |
---|
439 | 439 | | moneys for school improvements in accordance with this section and shall |
---|
