66 AN ACT concerning school districts; relating to school security and
77 emergency response policies; establishing requirements for school
88 safety and security plans and cardiac emergency response plans;
99 creating the school safety and security grant fund and the school
1010 cardiac emergency response grant fund.
1111 Be it enacted by the Legislature of the State of Kansas:
1212 Section 1. (a) The state board of education shall develop and adopt
1313 statewide standards for school safety and security plans and cardiac
1414 emergency response plans. In developing such standards, the state board of
1515 education shall consult with the office of the adjutant general, the Kansas
1616 bureau of investigation, the department of health and environment, the
1717 state fire marshal and any other state agencies, municipal agencies and
1818 school boards as the state board deems necessary.
1919 (b) The standards developed by the state board of education shall
2020 include, but shall not be limited to:
2121 (1) Evaluation of the infrastructure of school buildings and
2222 attendance centers for compliance with standards adopted under
2323 subsections (e) and (f);
2424 (2) training of school district employees on school safety and security
2525 policies and procedures and cardiac emergency response policies and
2626 procedures;
2727 (3) conducting student drills on emergency situations;
2828 (4) procedures for making notifications to individuals located outside
2929 of the school building during emergency situations and maintaining
3030 communication with law enforcement agencies, emergency management
3131 agencies, emergency medical services and other necessary individuals;
3232 (5) procedures for securing school buildings during an emergency
3333 situation;
3434 (6) procedures for emergency evacuation of school buildings,
3535 including evacuation routes and sites;
3636 (7) procedures for recovery after an emergency situation ceases;
3737 (8) coordination and incorporation of school safety and security plans
3838 and cardiac emergency response plans within existing school district
3939 emergency response plans;

7575 (9) distribution of school safety and security plans and cardiac
7676 emergency response plans to local law enforcement agencies and
7777 emergency management agencies;
7878 (10) procedures for ensuring accountability in adopting and
7979 implementing school safety and security plans and cardiac emergency
8080 response plans in accordance with the statewide standards adopted by the
8181 state board; and
8282 (11) any other policies and procedures the state board deems
8383 necessary for school safety and security plans or cardiac emergency
8484 response plans.
8585 (c) As part of such standards, the state board shall identify roles and
8686 responsibilities for implementing school safety and security plans and
8787 cardiac emergency response plans at the school district and school building
8888 levels, including, but not limited to, the role of local law enforcement
8989 agencies and local emergency management agencies when partnering with
9090 school districts in the development and implementation of such plans.
9191 (d) The state board may consider and utilize any materials,
9292 documentation or videos that are available through the United States
9393 department of homeland security in developing standards for school safety
9494 and security plans, and any such resources that are available through the
9595 United States department of health and human services, the American
9696 heart association or any other nationally recognized, guidelines-based
9797 organization focused on emergency cardiovascular care in developing
9898 standards for cardiac emergency response plans.
9999 (e) The statewide standards for school safety and security plans shall
100100 address, but shall not be limited to:
101101 (1) The infrastructure of school buildings and attendance centers
102102 operated by school districts, including, but not limited to, secured
103103 entrances, windows and other facets of the structural integrity of such
104104 buildings;
105105 (2) security technology to be utilized in such buildings, including, but
106106 not limited to, intrusion detection systems and security cameras;
107107 (3) communications systems, including, but not limited to, systems
108108 for interoperability between the school district and law enforcement
109109 agencies; and
110110 (4) any other systems or facilities the state board deems necessary for
111111 the safety and security of such buildings.
112112 (f) The statewide standards for cardiac emergency response plans
113113 shall address, but shall not be limited to:
114114 (1) The appropriate use of school personnel to respond to incidents
115115 involving an individual experiencing suspected sudden cardiac arrest while
116116 on school grounds, including incidents involving an individual attending
117117 or participating in an athletic practice or event, whether such practice or

161161 event is conducted on school grounds or at a separate location;
162162 (2) establishing a cardiac emergency response team;
163163 (3) implementing placement of automated external defibrillators and
164164 routine maintenance of such devices within school buildings, including
165165 appropriate placement in accordance with guidelines established by the
166166 American heart association or any nationally recognized, guidelines-based
167167 organization focused on emergency cardiovascular care;
168168 (4) identifying the location of each automated external defibrillator;
169169 (5) training of school personnel in the use of automated external
170170 defibrillators and cardiopulmonary resuscitation during an emergency in
171171 accordance with guidelines established by the American heart association
172172 or any nationally recognized, guidelines-based organization focused on
173173 emergency cardiovascular care;
174174 (6) communications systems with local emergency medical services;
175175 and
176176 (7) developing an event-specific emergency action plan for each
177177 school-sanctioned event held at a location separate from school grounds
178178 that includes:
179179 (A) The roles of school and emergency medical services personnel,
180180 communications systems and available emergency equipment, including a
181181 portable automated external defibrillator; and
182182 (B) access to and plan for emergency transport.
183183 (g) The state board shall regularly review and update the standards
184184 for school safety and security plans and cardiac emergency response plans.
185185 Any changes to such standards shall be provided to each school district by
186186 written notification upon adoption by the state board.
187187 (h) The state board shall provide notice of the adopted standards to
188188 those state agencies with whom the state board consulted in developing
189189 such standards. To the extent such standards contain emergency or security
190190 information or procedures, the state board shall maintain the
191191 confidentiality of such standards when sending notices pursuant to this
192192 subsection.
193193 Sec. 2. (a) The board of education of each school district shall adopt a
194194 comprehensive school safety and security plan based on the statewide
195195 standards adopted by the state board of education under section 1, and
196196 amendments thereto. Prior to the adoption of a school safety and security
197197 plan, each school district shall consult with one or more local law
198198 enforcement agencies and local emergency management agencies to
199199 review and evaluate:
200200 (1) Existing infrastructure of school buildings and attendance centers
201201 operated by such school district; and
202202 (2) current school district safety and security policies and procedures.

247247 agencies may provide guidance on improving a school district's building
248248 infrastructure or safety and security polices and procedures. The review
249249 and evaluation, and any guidance provided, shall be done in accordance
250250 with the standards adopted by the state board under section 1, and
251251 amendments thereto. Upon adoption of a school safety and security plan,
252252 the superintendent of the school district shall send a copy of such plan to
253253 each local law enforcement agency and emergency management agency
254254 with whom the school district consulted, and to the state board of
255255 education.
256256 (b) (1) The board of education of each school district shall adopt a
257257 comprehensive cardiac emergency response plan based on the statewide
258258 standards adopted by the state board of education under section 1, and
259259 amendments thereto.
260260 (2) Upon adoption, the cardiac emergency response plan shall be:
261261 (A) Provided to appropriate local law enforcement and emergency
262262 medical services and all school personnel;
263263 (B) reviewed by a school administrator with all school personnel
264264 prior to the first instructional day of each school year. The time and date of
265265 such review shall be documented as part of the plan; and
266266 (C) reviewed at the end of each school year by the school building
267267 administrators, school nurses and appropriate local law enforcement and
268268 emergency medical services.
269269 (3) The cardiac emergency response plan shall be rehearsed by
270270 simulation within 30 days prior to the beginning of each athletic season by
271271 all athletic directors, school nurses and all coaches, assistant coaches and
272272 athletic trainers who are coaching or otherwise participating in such
273273 athletic season.
274274 (4) Each athletic coach shall obtain a cardiopulmonary resuscitation
275275 certification or training recognized by a national accrediting body on heart
276276 health. At least one individual with such certification or training shall be in
277277 attendance at every interscholastic athletic practice and competition.
278278 Courses for such certification or training shall:
279279 (A) Be reviewed at least once every 30 months and revised if needed;
280280 (B) be completed through hands-on or online teaching methods in 10
281281 hours or less; and
282282 (C) include an end-of-course examination with a minimum qualifying
283283 score for successful course completion established by the board of
284284 education or the entity conducting such training.
285285 Sec. 3. (a) There is hereby established the school safety and security
286286 grant program to be administered by the state board of education. Each
287287 school district may submit an application to the state board of education in
288288 such form and manner as prescribed by the state board for an amount of
289289 grant moneys needed by such school district to implement such district's

333333 school safety and security plan adopted pursuant to section 2, and
334334 amendments thereto. Each grant application shall include a copy of the
335335 current school district safety and security plan, including all policies and
336336 procedures adopted for the implementation of such plan, and a description
337337 of the school safety and security improvements the district determines
338338 necessary for such implementation. The state board shall review all
339339 submitted applications and approve or deny such applications based on
340340 whether the applicant school district has demonstrated the necessity for the
341341 school safety and security improvements described in the application. As
342342 part of its review, the state board may conduct a hearing and provide the
343343 applicant school district an opportunity to present testimony as to the
344344 necessity of such school safety and security improvements. If the state
345345 board approves an application, it shall determine the amount of moneys to
346346 be disbursed to the applicant school district from the school safety and
347347 security grant fund. If the state board denies an application, then, within 15
348348 days of such denial, the state board shall send written notice of such denial
349349 to the superintendent of such school district.
350350 (b) All administrative proceedings pursuant to this section shall be
351351 conducted in accordance with the provisions of the Kansas administrative
352352 procedure act. Any action by the state board of education pursuant to this
353353 section shall be subject to review in accordance with the Kansas judicial
354354 review act.
355355 (c) There is hereby established in the state treasury the school safety
356356 and security grant fund to be administered by the department of education.
357357 All expenditures from the school safety and security grant fund shall be
358358 used for the disbursement of grant moneys for school safety and security
359359 improvements in accordance with this section and shall be made in
360360 accordance with appropriation acts upon warrants of the director of
361361 accounts and reports issued pursuant to vouchers approved by the
362362 commissioner of education or the commissioner's designee. Upon receipt
363363 of such grant moneys, the school district treasurer shall deposit the amount
364364 of such award in the general fund of the school district.
365365 Sec. 4. (a) There is hereby established the school cardiac emergency
366366 response grant program to be administered by the department of health and
367367 environment. Each school district may submit an application to the
368368 secretary of health and environment in such form and manner as
369369 prescribed by the secretary for an amount of grant moneys needed by such
370370 school district to implement such district's cardiac emergency response
371371 plan adopted pursuant to section 2, and amendments thereto. Each grant
372372 application shall include a copy of the current school district cardiac
373373 emergency response plan, including all policies and procedures adopted
374374 for the implementation of such plan, and a description of the school
375375 improvements the district determines necessary for such implementation.

419419 The secretary shall review all submitted applications and approve or deny
420420 such applications based on whether the applicant school district has
421421 demonstrated the necessity of the school improvements described in the
422422 application. As part of such review, the secretary may conduct a hearing
423423 and provide the applicant school district an opportunity to present
424424 testimony as to the necessity of such school improvements. If the secretary
425425 approves an application, the secretary shall determine the amount of
426426 moneys to be disbursed to the applicant school district from the school
427427 cardiac emergency response grant fund. If the secretary denies an
428428 application, then, within 15 days of such denial, the secretary shall send
429429 written notice of such denial to the superintendent of such school district.
430430 (b) All administrative proceedings pursuant to this section shall be
431431 conducted in accordance with the provisions of the Kansas administrative
432432 procedure act. Any action by the secretary of health and environment
433433 pursuant to this section shall be subject to review in accordance with the
434434 Kansas judicial review act.
435435 (c) There is hereby established in the state treasury the school cardiac
436436 emergency response grant fund to be administered by the department of
437437 health and environment. All expenditures from the school cardiac
438438 emergency response grant fund shall be used for the disbursement of grant
439439 moneys for school improvements in accordance with this section and shall
440440 be made in accordance with appropriation acts upon warrants of the
441441 director of accounts and reports issued pursuant to vouchers approved by
442442 the secretary of health and environment or the secretary's designee. Upon
443443 receipt of such grant moneys, the school district treasurer shall deposit the
444444 amount of such award in the general fund of the school district.
445445 Sec. 5. This act shall take effect and be in force from and after its
446446 publication in the statute book.
