AN ACT1
To amend and reenact R.S. 49:1302(E) and to enact R.S. 47:9004(B)(4) and R.S.2
49:1305(A)(3) and 1307, relative to boards, commissions, and like entities; to3
provide relative to disclosure of certain information concerning certain boards,4
commissions, and like entities; to provide for the publication of such information on5
the Internet; to provide for the powers and duties of the commissioner of6
administration relative thereto; to provide relative to disclosure of certain7
information by members of certain boards of directors; to provide for the powers and8
duties of the legislative auditor relative thereto; and to provide for related matters.9
Be it enacted by the Legislature of Louisiana:10
Section 1.  R.S. 47:9004(B)(4) is hereby enacted to read as follows:11
§9004. Board of directors; qualifications; terms; removal; chairman; compensation;12
meetings; records; appointment; corporation president; duties; removal; open13
board meetings14

(4)(a)  Those members appointed by the governor to the board of directors18
shall, prior to confirmation by the Senate, disclose the names of all business or19
professional clients with which the appointee or any corporation in which the20
appointee owns a controlling interest maintains a business or professional21
relationship at the time of the appointment.22
(b) The obligation to disclose shall be a continuing obligation of all members23
of the board of directors, including those members serving on and after January 1,24

(c) The disclosure of such business or professional relationships shall be1
made in writing to the Senate Committee on Senate and Governmental Affairs in the2
following manner:3
(i) For those relationships in existence at the time of appointment by the4
governor, disclosure shall occur within sixty days of the announcement of that5
appointment.6
(ii) For those relationships established during the term of the board member,7
such disclosure shall occur within sixty days of the commencement of the business8
or professional relationship.9

Section 2. R.S. 49:1302(E) is hereby amended and reenacted and R.S. 49:1305(A)(3)11
and 1307 are hereby enacted to read as follows:12
§1302.  Website; content13
The website established pursuant to R.S. 49:1301 shall contain the14
following information for boards, commissions, and like entities covered by15
this Chapter:16

E.(1) Membership information, including the number, names, compensation,18
terms, length of service, and method of selection of members.19
(2) The information required by this Subsection shall include per diem and20
reimbursement for travel expenses, including the amount of such expenses paid per21
meeting and an aggregate amount of such expenses paid per fiscal year.22

§1305.  Applicability24
A. This Chapter shall apply to the following boards, commissions, and like25
entities:26

(3) Each board and commission whose members are required to file annual28
financial disclosure statements pursuant to R.S. 42:1124.2.1.29

§1307.  Legislative auditor1
The legislative auditor shall work with the commissioner of administration2
to ensure that each board, commission, or like entity covered by this Chapter3
complies with the provisions of this Chapter.4
Section 3.(A) Prior to the effective date of this Act, the commissioner of5
administration shall take all reasonable and necessary actions, including contacting boards,6
commissions, and like entities covered by this Act, to ensure that the information on the7
website will be complete as required by this Act and Chapter 20 of Title 49 of the Louisiana8
Revised Statutes of 1950 on the effective date of this Act.9
(B) Prior to the effective date of this Act, each board, commission, or like entity10
covered by this Act shall fully cooperate with the commissioner of administration in11
implementing and complying with the requirements of this Section.  Prior to the effective12
date of this Act, each board, commission, and like entity covered by this Act shall provide13
the information required by this Act and Chapter 20 of Title 49 of the Louisiana Revised14
Statutes of 1950 to the commissioner of administration as soon as possible to allow for the15
inclusion of the information on the website on the effective date of this Act.16
Section 4.  This Act shall become effective on May 1, 2011.17
