SENATE BILL NO. 479

MILITARY AFFAIRS. Removes certain provisions in the Louisiana Insurance Code
regarding payment by group insurers of lump sum benefits to National Guardsmen activated
by the governor or the president of the United States. (gov sig)
AN ACT1
To repeal R.S. 22:941(A)(5), relative to group life insurance; to remove authority for certain2
lump sum payments of death and permanent disability benefits for Louisiana3
National Guardsmen activated by the governor or the president of the United States;4
to provide for an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 22:941(A)(5) is hereby repealed.7
Section 2. This Act shall take effect and become operative if and when the Act which8
originated as Senate Bill 245 of this 2010 Regular Session of the Legislature, that provides9
for death and disability benefits for National Guardsmen in Title 29 of the Louisiana Revised10
Statutes of 1950, is enacted and becomes law and is effective.11
Section 3. This Act shall become effective upon signature by the governor or, if not12
signed by the governor, upon expiration of the time for bills to become law without signature13
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If14
vetoed by the governor and subsequently approved by the legislature, this Act shall become15
effective on the day following such approval.16 SB NO. 479

Proposed law removes provisions in Title 22, the Louisiana Insurance Code, that provide for
lump sum payments by group insurers for death or permanent total disability to National
Guardsmen activated by the governor or the president of the United States.
Proposed law is contingent upon passage and enactment into law of SB 245 which amends
Title 29 to provide for payment of lump sum amounts for death or a qualifying permanent
disability to National Guardsmen activated by the governor or president of the United States.
Effective upon signature of the governor or lapse of time for gubernatorial action.
(Repeals R.S. 22:941(A)(5))
