| 13 | 13 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 14 | 14 | | of the same, as follows: |
|---|
| 15 | 15 | | 1 SECTION 1. Chapter 12 of the acts of 2023 is hereby repealed. |
|---|
| 16 | 16 | | 2 SECTION 2. Notwithstanding any general or special law to the contrary, Charles J. |
|---|
| 17 | 17 | | 3Femino, acting chief of police of the city of Somerville, who previously retired and waived his |
|---|
| 18 | 18 | | 4retirement allowance pursuant to section 90B of chapter 32 of the General Laws while working |
|---|
| 19 | 19 | | 5as the acting chief, may continue to serve in such position until the date on which a permanent |
|---|
| 20 | 20 | | 6police chief is appointed, he is relieved of his duties by the mayor, or he reaches age 68, |
|---|
| 21 | 21 | | 7whichever occurs first; provided, however, that he is mentally and physically capable of |
|---|
| 22 | 22 | | 8performing the duties of such position. The mayor may, at the expense of the city, require him to |
|---|
| 23 | 23 | | 9be examined by an impartial physician designated by the mayor to determine such capability. No |
|---|
| 24 | 24 | | 10further deductions shall be made from the regular compensation of Charles J. Femino under said |
|---|
| 25 | 25 | | 11chapter 32 for any service performed subsequent to his reaching age 65 and upon retirement 2 of 2 |
|---|
| 26 | 26 | | 12Charles J. Femino shall resume a superannuation retirement allowance equal to that of his pre- |
|---|
| 27 | 27 | | 13waiver rate. |

| 28 | 28 | | 14 SECTION 3. This act shall take effect upon its passage. |
