An Act An authorizing the city of Somerville to continue the employment of Charles J. Femino 
as acting chief of police.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Chapter 12 of the acts of 2023 is hereby repealed.
2 SECTION 2. Notwithstanding any general or special law to the contrary, Charles J. 
3Femino, acting chief of police of the city of Somerville, who previously retired and waived his 
4retirement allowance pursuant to section 90B of chapter 32 of the General Laws while working 
5as the acting chief, may continue to serve in such position until the date on which a permanent 
6police chief is appointed, he is relieved of his duties by the mayor, or he reaches age 68, 
7whichever occurs first; provided, however, that he is mentally and physically capable of 
8performing the duties of such position. The mayor may, at the expense of the city, require him to 
9be examined by an impartial physician designated by the mayor to determine such capability. No 
10further deductions shall be made from the regular compensation of Charles J. Femino under said 
11chapter 32 for any service performed subsequent to his reaching age 65 and upon retirement  2 of 2
12Charles J. Femino shall resume a superannuation retirement allowance equal to that of his pre-
13waiver rate. 
14 SECTION 3. This act shall take effect upon its passage.
