59.313.1.Therecorderofdeedsinacitynotwithinacountymayrefuseany
2documentpresentedforrecordingthatdoesnotmeetthefollowingrequirements:
3 (1)Thedocumentshallconsistofoneormoreindividualpagesnotpermanently
4boundnorinacontinuousform.Thedocumentshallnothaveanyattachmentstapledor
5otherwiseaffixedtoanypageexceptasnecessarytocomplywithstatutoryrequirements,
6providedthatadocumentmaybestapledtogetherforpresentationforrecording;alabelthat
7isfirmlyattachedwithabarcodeorreturnaddressmaybeacceptedforrecording;
8 (2)Thesizeofprintortypeshallnotbesmallerthaneight-pointtypeandshallbein
9blackordarkink.Shouldanydocumentpresentedforrecordingcontaintypesmallerthan
10eight-pointtype,suchdocumentshallbeaccompaniedbyanexacttypewrittencopynot

442.403.1.Anyrestrictivecovenantrecitalsonproperty,realorpersonal,foundin
2anydeeds,plats,restrictions,covenants,orotherconveyancesofanytypeornature,filedfor
3recordatanytimeintheofficeoftherecorderofdeedsinanycounty[, whichrelate] that
4relatetotherace,color,religion,ornationaloriginofanyperson[,] shallbevoidand
5unenforceable[,] andshallbeignored,asifthesameneverexisted.
6 2.Anypersonorlegalentitywithaninterestinrealpropertyoranyagentofsuch
7personorentity,shallnotincuranyliabilitybyreasonofthemereexistenceofarestrictive
8covenantdescribedinsubsection1ofthissectioninanydocumentfiledforrecordbefore
9May3,1948,inanyrecorderofdeeds'office.
10 3.NodeedrecordedonorafterAugust28,2022,shallcontainareferencetothe
11specificportionofarestrictivecovenantpurportingtorestricttheownershiporuseof
12thepropertyasprohibitedundersubsection1ofthissection.Arecorderofdeedsmay
13refusetoacceptanydeedsubmittedforrecordingthatreferencesthespecificportionof
14anysuchrestrictivecovenant.Theattorneywhopreparesorsubmitsadeedfor
15recordinghastheresponsibilityofensuringthatthespecificportionofsucharestrictive
16covenantisnotspecificallyreferencedinthedeedpriortosuchdeedbeingsubmittedfor
HB1662	6 17recording.Adeedmayincludeageneralprovisionthatstatesthatsuchdeedissubject
18toanyandallcovenantsandrestrictionsofrecord;however,suchprovisionshallnot
19applytothespecificportionofarestrictivecovenantpurportingtorestrictthe
20ownershiporuseofthepropertyasprohibitedundersubsection1ofthissection.Any
21deedthatisrecordedafterAugust27,2022,thatmistakenlycontainssucharestrictive
22covenantshallneverthelessconstituteavalidtransferofrealproperty.
23 4.Anyrestrictivecovenantprohibitedundersubsection1ofthissectionmaybe
24releasedbytheownerofrealpropertysubjecttosuchcovenantbyrecordinga
25certificateofreleaseofprohibitedcovenants.Therealpropertyownermayrecorda
26certificateeitherpriortorecordingofadeedconveyingrealpropertytoapurchaseror
27whensuchrealpropertyownerdiscoversthatsuchprohibitedcovenantexistsand
28choosestoaffirmativelyreleasethesame.Acertificatemaybepreparedwithout
