11 3.Exceptasprescribedundersubsection4ofthissection,apoliticalsubdivision
12shallnotprohibittheoperationofano-impact,home-basedbusinessorotherwise
13requireapersontoapplyfor,registerfor,orobtainanypermit,license,variance,or
14othertypeofpriorapprovalfromthepoliticalsubdivisiontooperateano-impact,
15home-basedbusiness.Forthepurposesofthissection,ahome-basedbusinessqualifies
16asano-impact,home-basedbusinessif:
17 (1)Thetotalnumberofemployeesandclientson-siteatonetimedoesnotexceed
18theoccupancylimitfortheresidentialdwelling;and
19 (2)Theactivitiesofthebusiness:
20 (a)Arelimitedtothesaleoflawfulgoodsandservices;
21 (b)Mayinvolvehavingmorethanoneclientonthepropertyatonetime;
22 (c)Donotcauseasubstantialincreaseintrafficthroughtheresidentialarea;
23 (d)Donotviolateanyparkingregulationsestablishedbythepolitical
24subdivision;

33andbuildingcodes,healthandsanitation,transportationortrafficcontrol,solidor
34hazardouswaste,pollution,andnoisecontrol;or

58certificateof[useand]inspectionoroccupancypermitforresidentialorcommercial
59structuresasprovidedforintherevisedmunicipalcodeofanycitynotwithinacounty,
60whichnowhasormayhereafterhaveapopulationinexcessofthreehundredthousand
61inhabitants.
62 [6.]7.Ifthereisabuildingorstructureontheparcel,thepurchasershallapplyforan
63occupancypermitfromthecityorappropriategovernmentalagencywithintendaysafterthe
64confirmationhearing.Anypurchaserwhoisapubliccorporationactinginagovernmental
65capacityshallnotberequiredtoacquiretheoccupancypermit.Whenaparcel,acquiredata
66sheriffsale,containingabuildingissoldfromapubliccorporationactinginagovernmental
67capacity,thesubsequentpurchasershallberequiredtoapplyfortheoccupancypermit.
68Failuretoapplyforsuchoccupancypermitwithintendaysafterconfirmationshallresultin
