83soldbytheresidentialrenovationloancommissioninthemannerprescribedinsections 8467.970to67.983.Theresidentialrenovationloancommissionshallreimbursetheland 85reutilizationauthorityforallexpensesdirectlyincurredinrelationtosuchpropertyunder 86sections92.700to92.920priortothetransfer. 92.815.1.Duringsuchwaitingperiodandatanytimepriortothetimeofforeclosure 2salebythesheriff,anyinterestedpartymayredeemanyparcelofrealestateasprovidedby 3sections92.700to92.920;exceptthatduringsuchtimeandatanytimepriortothetimeof SSHCSHB1662 14 4foreclosuresalebythesheriff,thecollectorshallenterintoawrittenredemptioncontractwith 5theownerofanyrealestateoccupiedasahomesteadandwhohasnotpreviouslydefaulted 6uponanysuchwrittenredemptioncontract,providedthatinnoinstanceshallsuch 7installmentsexceedtwelveinnumberorextendmorethantwenty-fourmonthsnextafterany 8agreementforsuchinstallmentpaymentsshallhavebeenenteredinto;providedfurther,that 9upongoodcausebeingshownbytheownerofanyparcelofrealestateoccupiedasa 10homestead,orinthecaseofimprovedrealestatewithatotalassessedvaluationofnotmore 11thanfivethousanddollars,ownedbyanindividual,theincomefromsuchpropertybeinga 12majorfactorinthetotalincomeofsuchindividual,orbyanyoneonhisbehalf,thecourtmay, 13initsdiscretion,fixthetimeandtermsofpaymentinsuchcontracttopermitallofsuch 14installmentstobepaidwithinnotlongerthanforty-eightmonthsafteranyorderoragreement 15astoinstallmentpaymentsshallhavebeenmade.Thecollectorshallnotenterintoa 16redemptioncontractwithrespecttoanyimprovedparcelnotoccupiedasahomestead. 17 2.Solongassuchinstallmentsbepaidaccordingtothetermsofthecontract,thesix 18months'waitingperiodshallbeextended,butifanyinstallmentbenotpaidwhendue,the 19extensionofthewaitingperiodshallbeendedandtherealestateshallimmediatelybe 3.Onanannualbasis,thecollectorshallmakepubliclyavailablethenumberof 24parcelsunderredemptioncontractunderthissection. 92.817.1.Thecourtshallstaythesaleofanyparceltobesoldunderexecution 2ofataxforeclosurejudgmentobtainedunderthischapter,whichisthesubjectofan 3actionfiledundersections447.620to447.640,providedthatthepartythathasbrought 4suchanactionhas,uponanorderofthecourt,paidintothecircuitcourttheprincipal 5amountofalllandtaxesthendueandowingunderthetaxforeclosurejudgment, 6exclusiveofpenaltiesandinterest,priortothedateofanyproposedsaleunder 7execution. 8 2.Uponthegrantingbythecourtoftemporarypossessionofanyproperty 9undersection447.632,uponorder,thecircuitcourtshalldirectpaymenttothecollector 10ofallprincipallandtaxestheretoforepaidtothecircuitcourt.Inaddition,inanyorder 11grantingafinaljudgmentordeedundersection447.625or447.640,thecourtshallalso 12orderthepermanentextinguishmentofpenaltiesandinterestarisingfromactionsto 13collectdelinquentlandtaxesdueontheparcelagainstthegranteeofsaiddeed,andall 14successorsininterest;exceptinghowever,anydefendantinsuchaction. 15 3.Ifanowneroftheparcelmovesthecourtforrestorationofpossessionunder 16section447.638,theownershallpayintothecircuitcourtalllandtaxamountscurrently SSHCSHB1662 15 17dueandowingontheproperty,includingallstatutorypenalties,interest,attorney'sfees, 18andcourtcostsretroactivetothedateofaccrual.Uponanordergrantingthe 19restorationofpossessiontoanownerundersection447.638,thecourtshallorderthat 20thefundspaidtothecourtundersubsection2ofthissectionbereturnedtothepayer, 21andthatthefundspaidtothecourtunderthissubsectionbepaidouttothecollector. 22 4.Ifthepartythatbroughttheactionundersections447.620to447.640 23dismissesitsactionpriortogainingtemporarypossessionoftheproperty,itshall 24recoveranyamountspaidintothecircuitcourtpriortothatdateforprincipalland 25taxes. 92.825.1.Thesaleshallbeconducted,thesheriff'sreturnthereofmade,andthe 2sheriff'sdeedpursuanttothesaleexecuted,allasprovidedinthecaseofsalesofrealestate 3takenunderexecutionexceptasotherwiseprovidedinsections92.700to92.920,and 4providedthatsuchsaleneednotoccurduringthetermofcourtorwhilethecourtisinsession. 5 2.Suchsaleshallconveythewholeinterestofeverypersonhavingorclaimingany 6right,titleorinterestinorlienuponsuchrealestate,whethersuchpersonhasansweredor 7not,subjecttorights-of-waythereonofpublicutilitiesuponwhichtaxhasbeenotherwise 8paid,andsubjectonlytothetaxlienthereon,ifany,oftheUnitedStatesofAmerica. 9 3.Thecollectorshalladvancefromcurrenttaxcollectionsthesumsnecessarytopay 10forthepublicationofalladvertisementsrequiredbytheprovisionsofsections92.700to 1192.920andshallbeallowedcreditthereforinhisaccountswiththetaxingauthoritiesonapro 12ratabasis.Heshallgivecreditinsuchaccountsforallsuchadvancesrecoveredbyhim. 13Suchexpensesofpublicationshallbeapportionedprorataamongandtaxedascostsagainst 14therespectiveparcelsofrealestatedescribedinthejudgment;provided,however,thatnone 15ofthecostshereinenumerated,includingthecostsofpublication,shallconstituteanylien 16upontherealestateaftersuchsale. 17 4.Nopersonshallbeeligibletobidatthetimeofthesheriff'ssaleunlesssuch 18personhas,nolaterthantendaysbeforethesaledate,demonstratedtothesatisfaction 19ofthecollectororsheriffthatthepersonisnottheownerofanyparcelofrealestatein 20thecitythatissubjecttodelinquentpropertytaxes,unpaidspecialtaxbills,orvacant 21buildingfees.Aprospectivebiddershallbeprohibitedfromparticipatinginthe 22delinquentlandtaxsaleifheorshehaspreviouslybidatasheriff'ssaleandfailedto 23paybidamounts,confirmthesale,orsignasheriff'sdeed.Thecollectororsheriffmay 24requireprospectivebidderstosubmitanaffidavitattestingtotherequirementsofthis 25sectionandisexpresslyauthorizedtopermanentlyprecludeanyprospectivebidder 26fromparticipatinginthesaleforfailuretocomplywiththissection.Notwithstanding 27theprovisionsofthissection,anytaxingauthorityorlandreutilizationauthorityshall 21suchrealestate;providedfurther,thatsuchtitleshallnotbesubjecttothelienofspecialtax 22bills[whichhasattachedtotheparcelofrealestatepriortoJanuary1,1972,butthelienof 23suchspecialtaxbillsshallattachtotheproceedsofthesheriff'ssaleortotheproceedsofthe 24ultimatesaleofsuchparcelbythelandreutilizationauthority]. 92.840.1.Withinsixmonthsafterthesheriffsellsanyparcelofrealestate,thecourt 2shall,uponitsownmotionoruponmotionofanyinterestedparty,setthecausedownfor 3hearingtoconfirmorsetasidetheforeclosuresaleoftherealestate,eventhoughsuch 4parcelsarenotalloftheparcelsofrealestatedescribedinthenoticeofsheriff'sforeclosure 5sale.Noticeofthehearingshallbesentbyanyinterestedparty,orthecourt,movingto 6confirmtheforeclosuresale,toeachpersonwho[received] wassentnoticeofsaleas 7specifiedin[subsection3]subsections4and5ofsection92.810andtoanyother 8necessarypartiesasrequiredbyprevailingnotionsofdueprocess. SSHCSHB1662 18 45 4.Ifthereareanyfundsremainingoftheproceedsafterthesheriff'ssaleandafterthe 46distributionofsuchfundsassetoutinthissectionandnopersonentitledtoanysuchfunds, 47whetherornotapartytothesuit,shall,withintwoyearsaftersuchsale,appearandclaimthe 48funds,[they] tenpercentshallbedistributedtotheSt.LouisAffordableHousingTrust 49Fundorequivalentofsuchcityoperatingundersections92.700to92.920forpurposes 50thatpromotethereductionandpreventionofvacantproperties,blightremediation,and 51cleanupandmaintenanceofvacantproperty,withtheremaindertobedistributedtothe 52appropriatetaxingauthorities. 53 5.Anycityoperatingundertheprovisionsofsections92.700to92.920,by 54ordinance,mayelecttoallocateaportionofitsshareoftheproceedsofthesheriff'ssale 55towardsafundforthepurposeofdefendingagainstclaimschallengingthesufficiencyof 56noticeprovisionsunderthissection. 57 6.Forthepurposeofthissection,theterm"occupancypermit"shallmeanthe 58certificateof[useand]inspectionoroccupancypermitforresidentialorcommercial 59structuresasprovidedforintherevisedmunicipalcodeofanycitynotwithinacounty, 60whichnowhasormayhereafterhaveapopulationinexcessofthreehundredthousand 61inhabitants. 62 [6.]7.Ifthereisabuildingorstructureontheparcel,thepurchasershallapplyforan 63occupancypermitfromthecityorappropriategovernmentalagencywithintendaysafterthe 64confirmationhearing.Anypurchaserwhoisapubliccorporationactinginagovernmental 65capacityshallnotberequiredtoacquiretheoccupancypermit.Whenaparcel,acquiredata 66sheriffsale,containingabuildingissoldfromapubliccorporationactinginagovernmental 67capacity,thesubsequentpurchasershallberequiredtoapplyfortheoccupancypermit. 68Failuretoapplyforsuchoccupancypermitwithintendaysafterconfirmationshallresultin 69thesaleandconfirmationbeingimmediatelysetasidebythemotionofanyinterestedparty 70andthatparcelshallagainbeadvertisedandofferedforsalebythesherifftothehighest 71bidderatpublicauctionforcashatanysubsequentsheriffforeclosuresale. 72 [7.]8.Thesheriffshallincludeadeedrestrictioninthesheriff'sdeed,issuedafter 73confirmationandaftertheapplicationofanoccupancypermitforanyparcelcontaininga 74buildingorstructure.Thedeedrestrictionshallstatethatthepurchasersatthesheriff'ssale 75whohadthepropertyconfirmedandwhoappliedforanoccupancypermitshallobtainan 76occupancypermitforthebuildingorstructurefromtheappropriategovernmentalagency 77priortoanysubsequenttransferorsaleofthisproperty.Thisdeedrestrictionshallnotexist 78asalienagainstsuchrealestate[whilethepurchasersholdsameintheamountoffive 79thousanddollars].
