SectionA.Chapter160,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection160.565,toreadasfollows:
160.565.1.Thisactshallbeknownandmaybecitedasthe"ExtendedLearning
2OpportunitiesAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Extendedlearningopportunity",anout-of-classroomlearningexperience
5thatisapprovedbythestateboardofeducation,aschoolboard,oracharterschooland
6thatprovidesastudentwith:
7 (a)Enrichmentopportunities;
8 (b)Careerreadinessoremployabilityskillsopportunitiesincluding,butnot
9limitedto,internships;preapprenticeships;orapprenticeships;or
10 (c)Anyotherapprovededucationalopportunity;
11 (2)"Parent",astudent'sparent,guardian,orotherpersonhavingcontrolor
12custodyofsuchstudent;
13 (3)"Student",anychildattendinganelementaryorsecondarypublicschoolin
14gradeskindergartenthroughtwelve.
15 3.Beginningwiththe2023-24schoolyear,thestateboardofeducationandeach
16localschoolboardshallroutinelyinformstudentsandparentsoftheabilityforstudents
17toearncreditforparticipatinginextendedlearningopportunities.Employeesofthe

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18stateboardofeducationandpublicschoolsmayassiststudentsandparentsin
19completingenrollmentprocessesrequiredforparticipatinginapprovedextended
20learningopportunities.Nostudentorparentshallberequiredtoobtainpermission
21fromthestudent'sschooldistrictorcharterschooltoenrollinanextendedlearning
22opportunity.Beforeparticipatinginanyextendedlearningopportunity,thestudentand
23atleastoneparentshallsignanagreementdetailingallprogramrequirementsinaform
24developedbythestateboardofeducation.
25 4.Anextendedlearningopportunityshallcountasacredittowardgraduation
26requirementsandtheachievementofapplicablestatestandardsforstudents.Toreceive
27credit,astudentshallsubmitawrittenrequestforcreditandproofofsuccessful
28completionoftheextendedlearningopportunitytoadesignatedadministratorofthe
29schoolthestudentattends.
30 5.Thestateboardofeducationshalladopt,andeachlocalschooldistrictshall
31distributeandimplement,extendedlearningopportunitiespoliciesthatprovideallof
32thefollowing:
33 (1)Anapplicationprocessforacceptingandapprovingextendedlearning
34opportunitiesofferedforcreditfromoutsideentities;
35 (2)Alistofentitiesthatareeligibletosubmitapplicationstoofferextended
36learningopportunitiesincluding,butnotlimitedto:
37 (a)Nonprofitorganizations;
38 (b)Businesseswithestablishedlocations;
39 (c)Tradeassociations;and
40 (d)TheArmedForcesoftheUnitedStates,subjecttoapplicableage
41requirements;
42 (3)Aprocessforstudentsandparentstorequestcredit;
43 (4)Criteriathatschooldistrictsandcharterschoolsshallusetodetermine
44whetheraproposedextendedlearningopportunityshallbeapproved;and
45 (5)Criteriathatschooldistrictsandcharterschoolsshallusetoawarda
46certificateofcompletionandcreditforcompletinganextendedlearningopportunity
47including,butnotlimitedto,allowingastudenttodemonstratecompetenciesthrough
48performance-basedassessmentsandothermethodsindependentofinstructionaltime
49andcredithours.
50 6.Anentityapprovedbythestateboardofeducationtoofferanextended
51learningopportunityshallbeautomaticallyqualifiedtoofferthatextendedlearning
52opportunitytoallschooldistrictsandcharterschools.
53 7.Astudentwhosuccessfullycompletesanapprovedextendedlearning
54opportunityandsatisfiescriteriafortheawardofacertificationofcompletionand
HB1856	2 55creditundersubdivision(5)ofsubsection5ofthissectionshallbeconsideredtohave
56completedallrequiredcourseworkfortheparticularcourse.Inanextendedlearning
57opportunitythatsatisfiesallrequiredcourseworkforahighschoolcourse,thestudent
58shallalsobeconsideredtohavesatisfiedtheequivalentnumberofcreditstowardthe
59student'sgraduationrequirements.
60 8.Anypolicyorprocedureadoptedbythestateboardofeducation,aschool
61board,oracharterschoolforparticipatinginanextendedlearningopportunityshall
62provideeverystudentanequalopportunitytoparticipateandshallsatisfyestablished
63timelinesandrequirementsforpurposesoftranscribingcreditsandstatereporting.
64 9.Thestateboardofeducationmaypromulgaterulestoimplementthe
65provisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection
66536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome
67effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,
68ifapplicable,section536.028.Thissectionandchapterarenonseverable,andifanyof
69thepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelay
70theeffectivedate,ortodisapproveandannularulearesubsequentlyheld
71unconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
72adoptedafterAugust28,2022,shallbeinvalidandvoid.
