2discretion,auditthelistofregisteredvotersforanylocalelectionauthoritytoensure

4 2.Anyauditconductedbythesecretaryofstateshall,atleastquarterly,
5determinewhetherthelocalelectionauthorityhasperformedthefollowingvoter
6registrationlistmaintenanceactivities,asrequiredbylaw:
7 (1)Sendingverificationnoticesinaccordancewithsection115.155;and
8 (2)Registeringvotersandremovingnamesfromthevoterregistrationsystemin
9accordancewithsection115.158.
10 3.Aftercompletingtheaudit,thesecretaryofstateshallnotifythelocalelection
11authorityinwritingofanymaintenanceupdatesthatarerequiredandshalladvisethe
12localelectionauthoritytheyhaveninetydaystomakerequiredupdates.If,afterninety
13days,thesecretaryofstatedeterminesthatthelocalelectionauthorityhasnot
14performedtherequiredmaintenanceofvoterregistrationlistsasrequiredbylaw,the
15secretaryofstate'sofficemaywithholdtransactionfundsassociatedwithmaintenance
16ofthevoterregistrationlistsfromthelocalelectionauthority.
115.004.Thesectionsofthischapterandallrelatedrulesandregulationsshall
2notbeamendedormodifiedinanymannerinthetwenty-sixweeksprecedingany

115.013.Asusedinthischapter,unlessthecontextclearlyimpliesotherwise,the

115.022.1.Exceptasprovidedinsubsection5ofthissection,neitherthestateof

3expendprivatemoneys,excludingin-kinddonations,forpreparing,administering,or
4conductinganelection,includingregisteringvoters.
5 2.Notwithstandingsubsection1ofthissectiontothecontrary,in-kinddonations
6shallnotbereceivedfromanycandidate,candidatecommittee,campaigncommittee,or
7continuingcommittee,assuchtermsaredefinedinchapter130.
8 3.Forpurposesofthissection,"in-kinddonations"shallonlyinclude:
9 (1)Personalprotectiveequipment;
10 (2)Water;
11 (3)Locationsatwhichanelectionmaybeconducted;and
12 (4)Foodforanelectionauthority,staffofanelectionauthority,electionjudges,
13watchers,andchallengers.

15authorityinviolationofthissectionunlesssuchfundingisafederalmandateorpartof
16afederalandstateagreement.
17 5.Inanyeven-numberedyearinwhichtheamountofstatefundsappropriated
18toproportionallycompensatecountiespursuanttosections115.063and115.065isless
19thantheamountofsuchfundsthatwereappropriatedinthepreviouseven-numbered
20year,privatemoneysmaybereceivedbythesecretaryofstatetodisbursetocounties
21basedontheamountofregisteredvotersineachcounty.Theamountofprivatemoneys
22thatmaybereceivedbythesecretaryofstateshallnotexceedthedifferencebetweenthe
23amountofstatefundsappropriatedinthepreviouseven-numberedyearandthe
24amountappropriatedinthependingeven-numberedyear,plustenpercentofthetotal
25amountthatwasappropriatedinthepreviouseven-numberedyear.
115.045.Eachelectionauthorityshallhavetheauthoritytoemploysuchattorneys
2andotheremployeesasmaybenecessarytopromptlyandcorrectlyperformthedutiesofthe
3electionauthority.Whereanelectronicvotingsystemorvotingmachinesareused,the
4electionauthorityshalldesignatecompetentemployeestohavecustodyofandsupervise
5maintenanceofthevotingequipment.Boardofelectioncommissioners'employeesshallbe
6subjecttothesamerestrictionsandsubscribethesameoathasmembersoftheboardof
7electioncommissioners,exceptthatnoemployeeofaboardofelectioncommissionersshall
8berequiredtopostbondorresideandbearegisteredvoterwithinthejurisdictionofthe
9electionauthorityunlessdirectedtodosobytheboard.Employeeoathsandanybondsshall
10befiledandpreservedintheofficeoftheboard.
115.051.1.Ineachcountywhichdoesnothaveaboardofelectioncommissioners,
2thecountyclerkshallhavetherighttoemploysuchdeputiesandassistantsasarenecessaryto
3promptlyandcorrectlyregistervotersandconductelections.Whereanelectronicvoting
4systemorvotingmachinesareused,thecountyclerkshalldesignatecompetentemployeesto
5havecustodyofandsupervisemaintenanceofthevotingequipment.Eachdeputyshallbe
6subjecttothesamerestrictionsandsubscribethesameoathasthecountyclerk,exceptthatno
7employeeshallberequiredtopostbondorresideandbearegisteredvoterwithinthe
8jurisdictionoftheelectionauthorityunlessdirectedtodosobytheclerk.Employeeoaths
9andanybondsshallbefiledandpreservedintheofficeofthecountyclerk.
10 2.Withinthetotalamountfordeputiesandassistantsapprovedbythecounty
11commission,thesalaryofeachdeputyandassistantshallbesetbythecountyclerk.
115.081.1.Eachelectionauthorityshallappointelectionjudgesforeachpolling
2placewithinitsjurisdictioninaccordancewiththeprovisionsofthissection.
3 2.Inallprimaryandgeneralelections,theelectionauthorityshallappointatleasttwo
4judgesfromeachmajorpoliticalpartytoserveateachpollingplace.Thecommitteeofeach
SSSCSHB1878	5 5majorpoliticalpartywithinthejurisdictionofanelectionauthorityisauthorizedto
6providetheelectionauthoritywithalistofelectionjudgecandidateswhomeetthe
7requirementsundersection115.085.Thecandidatesshallnotberequiredtoreside
8withinthejurisdictionoftheelectionauthority,asauthorizedundersection115.085.If
9acommitteeofamajorpoliticalpartywithinthejurisdictionofanelectionauthority
10failstoprovidetheprescribednumberofqualifiednamestofillallelectionjudge
11positionsbeforethedateestablishedbytheelectionauthority,theelectionauthoritymay
12selectjudgestofillthepositionsasprovidedbylaw.Iftheelectionauthoritydetermines
13thatanamesubmittedbyacommitteeofamajorpoliticalpartyisnotqualifiedtoserve
14asanelectionjudge,theelectionauthorityshallallowthepartytosubmitanothername
15beforefillingthepositionasprovidedbylaw.Nomajorpoliticalpartyshallhavea
16majorityofthejudgesatanypollingplace.Noestablishedpartyshallhaveagreaternumber
17ofjudgesatanypollingplacethananymajorpoliticalparty.
18 3.Inanyelectionthatisnotaprimaryorgeneralelection,theelectionauthorityshall
19appointatleastonejudgefromeachmajorpoliticalpartytoserveateachpollingplace.No
20majorpoliticalpartyshallhaveamajorityofthejudgesatanypollingplace.Noestablished
21partyshallhaveagreaternumberofjudgesatanypollingplacethananymajorpoliticalparty.
22 4.Theelectionauthorityshalldesignatetwoofthejudgesappointedforeachpolling
23place,onefromeachmajorpoliticalparty,assupervisoryjudges.Supervisoryjudgesshallbe
24responsibleforthereturnofelectionsuppliesfromthepollingplacetotheelectionauthority
25andshallhaveanyadditionaldutiesprescribedbytheelectionauthority.
26 5.Electionjudgesmaybeemployedtoserveforthefirsthalforlasthalfofany
27electionday.Suchjudgesshallbepaidone-halftheregularrateofpay.Ifpart-timejudges
28areemployed,theelectionauthorityshallemploysuchjudgesandshallseethatasufficient
29numberforeachperiodarepresentatalltimessoastohavethepropertotalnumberofjudges
30presentateachpollingplacethroughouteachelectionday.Theelectionauthorityshall
31requirethatateachpollingplaceatleastoneelectionjudgefromeachpoliticalpartyservea
32fulldayandthatatalltimesduringthedaytherebeanequalnumberofelectionjudgesfrom
33eachpoliticalparty.
34 6.Anelectionauthoritymayappointadditionalelectionjudgesrepresentingother
35establishedpoliticalpartiesandadditionalelectionjudgeswhodonotclaimapolitical
36affiliation.Anyquestionwhichrequiresadecisionbythemajorityofjudgesshallonlybe
37madebythejudgesfromthemajorpoliticalparties.
115.085.Nopersonshallbeappointedtoserveasanelectionjudgewhoisnota
2registeredvoterinthisstate[; providedthat,beforeanyelectionauthoritymayappointjudges
3whoareregisteredvotersofanotherelectionauthority'sjurisdiction,theelectionauthority
4shallobtainthewrittenconsentoftheelectionauthorityforthejurisdictionwherethe
SSSCSHB1878	6 5prospectivejudgesareregisteredtovote]. Eachelectionjudgeshallbeapersonofgood
6reputeandcharacterwhocanspeak,read,andwritetheEnglishlanguage.Nopersonshall
7serveasanelectionjudgeatanypollingplaceinwhichhisorhernameorthenameofa
8relativewithintheseconddegree,byconsanguinityoraffinity,appearsontheballot.
9However,norelativeofanyunopposedcandidateshallbedisqualifiedfromservingasan
10electionjudgeinanyelectionjurisdictionofthestate.Noelectionjudgeshall,duringhisor
11hertermofoffice,holdanyotherelectivepublicoffice,otherthanasamemberofapolitical
12partycommitteeortownshipoffice,exceptanypersonwhoiselectedtoaboardor
13commissionofapoliticalsubdivisionorspecialdistrictmayserveasanelectionjudgeexcept
14atapollingplacewheresuchpoliticalsubdivisionorspecialdistricthasanissueorcandidate
15ontheballot.Inanycountyhavingapopulationoflessthantwohundredfiftythousand
16inhabitants,anycandidateforthecountycommitteeofapoliticalpartywhoisnotacandidate
17foranyotherofficeandwhoisunopposedforelectionasamemberofthecommitteeshallnot
18bedisqualifiedfromservingasanelectionjudge.
115.105.1.Thechairofthecountycommitteeofeachpoliticalpartynamedonthe
2ballotshallhavetherighttodesignateachallengerforeachpollingplace,whomaybe
3presentuntilallballotsarecastonthedayofelection,andachallengerforeachlocationat
4whichabsenteeballotsarecounted,whomaybepresentwhiletheballotsarebeingprepared
5forcountingandcounted.Nolaterthanfourbusinessdaysbeforetheelection,thechairof
6eachcountycommitteeofeachpoliticalpartynamedontheballotshallprovidesigned
7officialdesignationformswiththenamesofthedesignatedchallengersandsubstitutestothe
8localelectionauthorityforconfirmationofeligibilitytoserveasachallenger.Thelocal
9electionauthority,afterverifyingtheeligibilityofeachdesignatedandsubstitutechallenger,
10shallsignoffontheofficialdesignationforms,unlessthechallengerisfoundnottohavethe
11qualificationsestablishedbysubsection5ofthissection.Iftheelectionauthoritydetermines
12thatachallengerdoesnotmeetthequalificationsofsubsection5ofthissection,the
13designatingpartychairmaydesignateareplacementchallengerandprovidethelocalelection
14authoritywiththenameofthereplacementchallengerbefore5:00p.m.oftheMonday
15precedingtheelection.Thedesignatingchairmaysubstitutechallengersathisorher
16discretionduringsuchhours.
17 2.Challengesmayonlybemadewhenthechallengerbelievestheelectionlawsof
18thisstatehavebeenorwillbeviolated,andeachchallengershallreportanysuchbelieftothe
19electionjudges,ortotheelectionauthorityifnotsatisfiedwiththedecisionoftheelection
20judges.
21 3.Priortothecloseofthepolls,challengersmaylistandgiveoutthenamesofthose
22whohavevoted.Thelistingandgivingoutofnamesofthosewhohavevotedbyachallenger
23shallnotbeconsideredgivinginformationtendingtoshowthestateofthecount.

25partyballotselectedbythevoterandmaydisclosepartyaffiliationinformationafterthepolls
26close.
27 5.]Allpersonsselectedaschallengersshallhavethesamequalificationsrequiredby
28section115.085forelectionjudges,exceptthatsuchchallengershallbearegisteredvoterin
29thejurisdictionoftheelectionauthorityforwhichthechallengerisdesignatedasachallenger.
30 [6.]5.Anychallengebyachallengertoavoter'sidentificationforvalidityshallbe
31madeonlytotheelectionjudgesorotherelectionauthority.Ifthepollchallengerisnot
32satisfiedwiththedecisionoftheelectionjudges,thenheorshemayreporthisorherbelief
33thattheelectionlawsofthisstatehavebeenorwillbeviolatedtotheelectionauthorityas
34allowedunderthissection.
115.123.1.AllpublicelectionsshallbeheldonTuesday.Exceptasprovidedin
2subsections2and3ofthissection,andsection247.180,allpublicelectionsshallbeheldon
3thegeneralelectionday,theprimaryelectionday,thegeneralmunicipalelectionday,thefirst
4TuesdayafterthefirstMondayinNovember,oronanotherdayexpresslyprovidedbycityor
5countycharter,andinnonprimaryyearsonthefirstTuesdayafterthefirstMondayinAugust.
6BondelectionsmaybeheldonthefirstTuesdayafterthefirstMondayinFebruarybutno
7otherissueshallbeincludedontheballotforsuchelection.
8 2.[Notwithstandingtheprovisionsofsubsection1ofthissection,anelectionfora
9presidentialprimaryheldpursuanttosections115.755to115.785shallbeheldonthesecond
10TuesdayafterthefirstMondayinMarchofeachpresidentialelectionyear.
11 3.]Thefollowingelectionsshallbeexemptfromtheprovisionsofsubsection1of
12thissection:
13 (1)Bondelectionsnecessitatedbyfire,vandalismornaturaldisaster;
14 (2)Electionsforwhichownershipofrealpropertyisrequiredbylawforvoting;
15 (3)Specialelectionstofillvacanciesandtodecidetievotesorelectioncontests;and
16 (4)Taxelectionsnecessitatedbyafinancialhardshipduetoafivepercentorgreater
17declineinper-pupilstaterevenuetoaschooldistrictfromthepreviousyear.

115.135.1.Anypersonwhoisqualifiedtovote,orwhoshallbecomequalifiedto
2voteonorbeforethedayofelection,shallbeentitledtoregisterinthejurisdictionwithin
3whichheorsheresides.Inordertovoteinanyelectionforwhichregistrationisrequired,a
4personmustberegisteredtovoteinthe[jurisdictionofhisorherresidence] stateofMissouri

6registrationisbeingheldifsuchtimeislaterthan5:00p.m.,onthefourthWednesdaypriorto
7theelection,unlessthevoterisaninterstateformerresident,[anintrastatenewresident,] a
8newresident,oracoveredvoter,asdefinedinsection115.275.[Exceptasprovidedin
9subsection4ofthissection,innocaseshallregistrationforanelectionextendbeyond10:00

20militaryservice,hasreturnedfromamilitarydeploymentoractivation,orhasseparatedfrom
