74 (2)Proceduresforaparenttoreceiveinformationaboutsuchparent'sminor 75child'scourseofstudy; 76 (3)Proceduresforaparenttovoiceconcernsaboutinstructionalmaterialsor 77othermaterialsusedintheclassroombasedonsuchparent'sbeliefsregardingthe 78appropriatenessorveracityofsuchmaterials.Suchparentalconcernsmaybebasedon 79beliefsrelatedtomorality,sexuality,religion,orotherissuesrelatedtothewell-being, 80education,andupbringingofsuchparent'sminorchild; 81 (4)Proceduresforaparenttowithdrawsuchparent'sminorchildfromany 82portionoftheschooldistrict'shealtheducationrelatedtohumansexualityandsexually 83transmitteddiseases; 84 (5)Proceduresforaparenttolearnaboutthenatureandpurposeofclubsand 85otherextracurricularactivitiesofferedatsuchparent'sminorchild'sschool;and 86 (6)Proceduresforprovidingparentswithotherinformationtowhichsuch 87parentshavearightofaccessundersubsection4ofthissection. 88 6.Thedepartmentofelementaryandsecondaryeducationshalldevelopand 89everyschooldistrictshalluseaformthatauthorizesaparenttoobjecttoandoptoutof 90anyinstructionalmaterialsormaterialsusedintheminorchild'sclassroomasdescribed HCSHB1995&1474 3 91insubdivisions(3)and(4)ofsubsection5ofthissection.Suchformshallbemade 92availabletoeveryparentatthebeginningofaschoolyearbyeachschooldistrictand 93shallprovideparentstheopportunitytoexplainreasonsincluding,butnotlimitedto, 94moral,religious,scientific,orphilosophicalgroundsforoptingtheirminorchildoutof 95suchinstructionalmaterialsormaterialsusedintheminorchild'sclassroom. 96 7.Eachschooldistrictmayprovideanyinformationtowhichaparenthasa 97rightofaccessunderthissectionbypublishingsuchinformationelectronicallyina 98reasonablyaccessibleformat,excepttotheextentthatsuchpublicationwouldresultin 99thedisclosureofpersonallyidentifiableorconfidentialinformationinviolationoflaw. 100 8.Aparentmayfileaformalrequestinwritingwiththesuperintendentofthe 101schooldistrictforaccesstoanyinformationtowhichsuchparenthasarightofaccess 102underthissection.Thesuperintendentshallprovidesuchinformationtotheparent 103withintendaysandmaydosobyanyreasonablemeansincluding,butnotlimitedto,by 104directingtheparenttopubliclyavailableelectronicresourcestotheextentsuch 105resourcesareresponsivetotheparent'srequest.Ifthesuperintendentdeniessuch 106requestordoesnotrespondwithintendays,theparentmayfileanappealwiththe 107schoolboard.Theschoolboardshallplacetheparent'sappealontheagendaforthe 108nextpublicmeetingoftheboardoccurringnotlessthansevendaysafterthefilingof 109suchappealbyaparent. 110 9.Nopublicschoolorschooldistrictshallrequirenondisclosureagreementsor 111similarformsforaparent'sreviewofcurricula.Eachpublicschoolorschooldistrict 112shallallowparentstomakecopiesofcurriculumdocuments.Apublicschoolmay 113chargeareasonablefeeforsuchcopies. 114 10.Nopublicschoolorschooldistrictshallallowstudentinvolvementinfield 115tripsunlesstheminorchild'sparentsprovidewrittenauthorizationforsuchstudent 116involvement. 117 11.Eachschoolboardmeetingpertainingtocurriculashallbeheldinpublicand 118allowforpubliccomments. 119 12.Eachpublicschoolandschooldistrictshallnotifyparentsinatimelymanner 120ofallreportedincidentspertainingtostudentsafetyincluding,butnotlimitedto,any 121felonyormisdemeanorcommittedbyateacherorotherschoolemployee. 122 13.Noemployeeofanypublicschoolorschooldistrictshallencourage,coerce, 123orattempttocoerceaminorchildtowithholdinformationfromsuchminorchild's 124parents;provided,however,thatanysuchpersonrequiredtoreportsuspectedabuseor 125neglectundersections210.109to210.183mayencourageaminorchildtowithhold 126informationwheredisclosurecouldreasonablyresultinabuseorneglect. 127 14.Thissectionshallnotbeconstruedto: HCSHB1995&1474 4 128 (1)Authorizeaparenttoengageinunlawfulconduct,suchasabuseorneglect; 129 (2)Condone,authorize,approve,orapplytoanyparentalactionordecisionthat 130wouldendlife; 131 (3)Prohibitacourtofcompetentjurisdiction,alawenforcementofficer,or 132employeeofagovernmentalentityorotherpublicinstitutionresponsibleforchild 133welfarefromactingwithinthereasonableandprudentscopeofsuchcourtorperson's 134officialcapacityandauthorityinamannernototherwiseinconsistentwiththe 135provisionsofsections161.851to161.853; 136 (4)Modifythecommonlawdoctrineofinlocoparentisassuchdoctrineapplies 137totheoperationofpublicschoolsandtothedutiesofadministratorsandemployeesof 138suchschools;or 139 (5)Limittheinalienablerightsofaparent,regardlessofwhethersuchrightsare 140enumeratedintheprovisionsofthissection. 141 15.Thedepartmentofelementaryandsecondaryeducationmaypromulgate 142rulestoimplementtheprovisionsofthissection.Anyruleorportionofarule,asthat 143termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis 144sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 145provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 146536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 147pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 148arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 149andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid. 161.852.1.Thedepartmentofelementaryandsecondaryeducationshall 2developatoolwithinthedepartment'scomprehensivedatasystemthatprovidesaccess 3toeveryschooldistrict'scurriculumandprofessionaldevelopmentmaterials. 4 2.Thetoolshallconsistofaneasy-to-searchdatabaseincluding,butnotlimited 5to,thefollowing: 6 (1)Allcurriculumtaughtbytheschooldistrict; 7 (2)Alldocumentsusedbyaschooldistrictintheprofessionaldevelopmentofthe 8district'sfacultyandstaffincluding,butnotlimitedto,administrators,teachers, 9counselors,andclassroomsupportstaff; 10 (3)Thenamesofallspeakersandguestsusedbyaschooldistrictintheschool 11district'sprofessionaldevelopmentactivities;and 12 (4)Thecostsassociatedwithspeakersandguestsusedbyaschooldistrictinthe 13schooldistrict'sprofessionaldevelopmentactivities. HCSHB1995&1474 5 14 3.Thedepartmentofelementaryandsecondaryeducationshallestablishan 15onlineformthateachschooldistrictinthisstateshallcompletewithinformation 16requiredundersubsection2ofthissection. 17 4.Aschooldistrictshallsubmitanyupdatestotheinformationoutlinedin 18subsection2ofthissectioneverysixmonths.Apublicschoolorschooldistrictmay 19makegood-faithmodificationstocurriculaduringeachsix-monthperiodbetween 20updatesbutshallnotberequiredtosubmitanupdateofsuchmodificationsuntilthe 21nextsix-monthupdate. 22 5.Notlessthanmonthly,thedepartmentofelementaryandsecondaryeducation 23shallupdatethetoolwiththeinformationrequiredbythissectiontobesubmittedby 24eachschooldistrictandshallensurethatthetoolismaintainedastheprimary 25centralizedsourceofinformationaboutthecurriculumandinstructionalmaterialsused 26bypublicschooldistricts. 27 6.Thedepartmentofelementaryandsecondaryeducationmaypromulgate 28rulestoimplementthissection.Anyruleorportionofarule,asthattermisdefinedin 29section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 30becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 31536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable, 32andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 33review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 34heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 35adoptedafterAugust28,2022,shallbeinvalidandvoid. 161.853.1.Theattorneygeneralofthisstateoranyparentofaminorchild 2enrolledinapublicschoolinthisstatemaybringlegalactionagainsttheschooldistrict 3inwhichsuchparent'sminorchildisenrolledoranemployeeofsuchschooldistricton 4behalfofsuchminorchildwhoisharmedbysuchschooldistrict'soremployee's 5violationofsections161.851to161.852.Suchactionmaybebroughtinanycountyor 6anycitynotwithinacountyinwhichtheschooldistrictboundarieslieormaybe 7broughtintheColeCountycircuitcourt. 8 2.Ifacourtofcompetentjurisdictionfindsthataschooldistrictorschool 9districtemployeeviolatedtheprovisionsofsections161.851to161.852,theschool 10districtorschooldistrictemployeeshallbefinedonethousanddollarsforeachviolation 11ofsuchsectionsunlessthecourtfindsthattheschooldistrictorschooldistrictemployee 12knowinglyorpurposelyviolatedtheprovisionsofsuchsections,inwhichcasetheschool 13districtorschooldistrictemployeeshallbefinedtenthousanddollarsforeachviolation 14ofsuchsections. HCSHB1995&1474 6 15 3.(1)Ifaschooldistrictorschooldistrictemployeeisfinedbyacourtof 16competentjurisdictionforviolationsofsections161.851to161.852,theproceedsofsuch 17fineshallbedividedasfollows: 18 (a)Twentypercentshallbeawardedtotheparentwhobroughtthelegalaction. 19Ifparentsofmorethanoneminorchildbringsuit,thetwentypercentawardshallbe 20dividedequallyamongeachfamilyrepresented;and 21 (b)EightypercentshallbedepositedintotheMissouriempowerment 22scholarshipaccountsfundestablishedundersection135.716. 23 (2)Ifacourtofcompetentjurisdictionfindsthataschooldistrictorschool 24districtemployeeviolatedtheprovisionsofsections161.851to161.852,thecourtshall 25awardcourtcostsandreasonableattorney'sfeestotheprevailingpartyorparties. 26 4.Anyschooldistrictemployeewhodisclosesviolationsofsections161.851to 27161.852shallbeprotectedfromanymannerofretaliationassetforthinsection105.055. 170.355.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Parent",astudent'sparent,guardian,orotherpersonhavingcontrolor 3custodyofthestudent; 4 (2)"School",apublicschoolorschooldistrictassuchtermsaredefinedin 5section160.011. 6 2.Noschoolorschoolemployeeshallcompelateacherorstudenttodiscuss 7publicpolicyissuesofthedaywithoutsuchteacher'sorstudent'sconsent. 8 3.Noschoolorschoolemployeeshallcompelateacherorstudenttoadopt, 9affirm,adhereto,orprofessideasinviolationofTitleIVorTitleVIofthefederalCivil 10RightsActof1964,asamended,including,butnotlimitedto,thefollowing: 11 (1)Thatindividualsofanyrace,ethnicity,color,ornationaloriginareinherently 12superiororinferior; 13 (2)Thatindividualsshouldbeadverselyoradvantageouslytreatedonthebasis 14ofindividualrace,ethnicity,color,ornationalorigin;or 15 (3)Thatindividuals,byvirtueoftheirrace,ethnicity,color,ornationalorigin, 16bearcollectiveguiltandareinherentlyresponsibleforactionscommittedinthepastby 17othermembersofthesamerace,ethnicity,color,ornationalorigin. 18 4.Nocourseofinstructionorunitofstudyofferedbyanyschoolshalldirector 19otherwisecompelstudentstopersonallyaffirm,adopt,oradheretoanyoftheideas 20listedinsubsection3ofthissection. 21 5.Nocourseofinstruction,unitofstudy,professionaldevelopment,ortraining 22programshalldirectorotherwisecompelteacherstopersonallyaffirm,adopt,or 23adheretoanyoftheideaslistedinsubsection3ofthissection.
