3agencyoftheexecutivebranchofstategovernmentsubjecttothissectionpursuanttosection 436.031,orbeforemakinganypermanentandsubstantialchangeoftheduties,authorityor 5responsibilitiesofanysuchposition,anappointingauthorityshallnotifythedirectorin 6writingoftheappointingauthority'sintentiontodoso,exceptwherethepositionsmaybe 7allocatedbytheappointingauthority. 8 2.Thedirectormayatanytimeallocateanynewpositiontoaclass,orchangethe 9allocationofanypositiontoaclass,or[recommendtotheboard] makechangesinthe 10classificationplan.[Anychangeintheclassificationplanrecommendedbythedirectorshall 11takeeffectwhenapprovedbytheboard,orontheninetiethdayafteritisrecommendedtothe 12recruitingforpositionsinthestateservice,theratesofpayprevailinginthestateforthe 13servicesperformed,andforcomparableservicesinpublicandprivateemployment,living 22arefundsappropriatedandavailabletopaytheadoptedpayplan.Thepayplanshallalsobe 23usedasthebasisforpreparingbudgetestimatesforsubmissiontothelegislatureinsofaras 24suchbudgetestimatesconcernpaymentforservicesperformedinpositionssubjecttothis 25chapterpursuanttosubsection1ofsection36.030andpositionssubjecttothissection 26pursuanttosection36.031.Amendmentstothepayplanmayberecommendedbythe 27directorfromtimetotimeascircumstancesrequireandsuchamendmentsshalltakeeffect 28whenapprovedasprovidedbythissection.Theconditionsunderwhichemployeesmaybe 29appointedatarateabovetheminimumprovidedfortheclass,oradvancefromonerateto 30anotherwithintheratesapplicabletotheirpositions,maybedeterminedbytheregulations. 31 2.Anychangeinthepayplanshallbemadeonauniformstatewidebasis.No 32employeeinapositionsubjecttothischaptershallreceivemoreorlesscompensationthan 33anotheremployeesolelybecauseofthegeographicalareainwhichtheemployeelivesor 34works. 36.250.1.Everypersonappointedtoapermanentpositiondescribedunder 2subdivision(2)ofsubsection1ofsection36.030shallberequiredtosuccessfullycompletea 3workingtestduringaprobationaryperiodwhichshallbeofsufficientlengthtoenablethe 4appointingauthoritytoobservetheemployee'sabilitytoperformthevariousdutiespertaining 5totheposition. 6 2.The[board] directorshallbyregulationestablishthestandardsgoverningnormal 7lengthoftheprobationaryperiodfordifferentclassesofpositions.Theregulationsshall 8specifythecriteriaforreducingorlengtheningtheprobationaryperiodforindividualswithin SCSHB2090 9 9thevariousclasses.Theminimumprobationaryperiodshallbethreemonths.Themaximum 10probationaryperiodshallbeeighteenmonthsfortopprofessionalpersonnelandpersonnel 11withsubstantialsupervisoryoradministrativeresponsibilities,andtwelvemonthsforall 12others.However,aprobationaryperiodshallnotberequiredforanemployeereinstated 13withintwoyearsafterlayoffordemotioninlieuoflayoffbythesamedivisionofservice. 14 3.Priortotheexpirationofanemployee'sprobationaryperiod,theappointing 15authorityshallnotifythedirectorandtheemployeeinwritingwhethertheservicesofthe 16employeehavebeensatisfactoryandwhethertheappointingauthoritywillcontinuethe 17employeeintheemployee'sposition. 18 4.Atanytimeduringtheprobationaryperiodtheappointingauthoritymayremove 19anemployeeif,intheopinionoftheappointingauthority,theworkingtestindicatesthatthe 20employeeisunableorunwillingtoperformthedutiesofthepositionsatisfactorily.Upon 21removal,theappointingauthorityshallforthwithreporttothedirectorandtotheemployee 22removed,inwriting,theappointingauthority'sactionandthereasonthereof.Anemployee 23whoisfoundbythedirectortohavebeenappointedthroughfraudshallberemovedwithin 24tendaysofnotificationoftheappointingauthority. 36.440.1.Allofficersandemployeesofthestatesubjecttoprovisionsofthis 2chapter,whetherpursuanttosubsection1ofsection36.030orpursuanttosection36.031, 3shallcomplywithandaidinallproperwaysincarryingouttheprovisionsofthischapter 4applicabletothemandtheregulationsadoptedthereunder.Allofficersandemployeesshall 5furnishanyrecordsorinformationwhichthedirector[ortheboard] mayrequestforany 6purposeofthislaw. 7 2.Astateofficeroremployeewhoshallfailtocomplywithanyprovisionofthis 8chapterorofanyregulationadoptedthereunderthatisapplicabletosuchpersonshallbe 9subjecttoallpenaltiesandremediesnoworhereafterprovidedbylawforthefailureofa 10publicofficeroremployeetodoanyactrequiredofhimorherbythischapter.Thedirector 11maymaintainsuchactionorproceedingatlaworinequityasheorsheconsidersnecessaryor 12appropriatetosecurecompliancewiththischapterandtheregulationsadoptedthereunder. 15coordinatelaborrelationsactivitiesinindividualstateagencies,includingparticipationin 16negotiationsandapprovalofagreementsrelatingtouniformwages,benefitsandthoseaspects 17ofemploymentwhichhavefiscalimpactonthestate;and 18 (7)[Formulate] Promulgaterules[forapprovaloftheboard] andestablish 19proceduresandstandardsrelatingtopositionclassificationandcompensationofemployees 20whicharedesignedtosecureessentialuniformityandcomparabilityamongstateagencies. 21 2.Anypersonwhoisemployedinapositionsubjecttothischapterwhoengagedina 22strikeorlaborstoppageshallbesubjecttothepenaltiesprovidedbylaw. 37.010.1.Thegovernor,byandwiththeadviceandconsentofthesenate,shall 2appointacommissionerofadministration,whoshallheadthe"OfficeofAdministration" 3whichisherebycreated.Thecommissionerofadministrationshallreceiveasalaryas 4providedbylawandshallalsoreceivehisorheractualandnecessaryexpensesincurredinthe 5dischargeofhisorherofficialduties.Beforetakingoffice,thecommissionerof 6administrationshalltakeandsubscribeanoathoraffirmationtosupporttheConstitutionof 7theUnitedStatesandofthisstate,andtodemeanhimselforherselffaithfullyinoffice.The 8commissionershallalsodepositwiththegovernorabond,withsuretiestobeapprovedbythe 9governor,intheamounttobedeterminedbythegovernorpayabletothestateofMissouri, 10conditionedonthefaithfulperformanceofthedutiesofhisorheroffice.Thepremiumofthis 11bondshallbepaidoutoftheappropriationfortheofficeofthegovernor. 12 2.Thegovernorshallappointthecommissionerofadministrationwiththeadviceand 13consentofthesenate.Thecommissionershallbeatleastthirtyyearsofageandmusthave 14beenaresidentandqualifiedvoterofthisstateforthefiveyearsnextprecedinghisorher 15appointment.Heorsheshallbequalifiedbytrainingandexperiencetoassumethe 16managerialandadministrativefunctionsoftheofficeofcommissionerofadministration. 17 3.Thecommissionerofadministrationshall,byvirtueofhisorheroffice,without 18additionalcompensation,headthedivisionofbudget,thedivisionofpurchasing,thedivision 19offacilitiesmanagement,designandconstruction,thedivisionofpersonnel,andthe 20informationtechnologyservicesdivision.Wheneverprovisionsoftheconstitutiongrant 21powers,imposedutiesormakeotherreferencetothecomptroller,theyshallbeconstruedas 22referringtothecommissionerofadministration. 23 4.Thecommissionerofadministrationshallprovidethegovernorwithsuch 24assistanceinthesupervisionoftheexecutivebranchofstategovernmentasthegovernor SCSHB2090 11 25requiresandshallperformsuchotherdutiesasareassignedtohimorherbythegovernoror 26bylaw.Thecommissionerofadministrationshallworkwithotherdepartmentsofthe 27executivebranchofstategovernmenttopromoteeconomy,efficiencyandimprovedservice 28inthetransactionofstatebusiness.Thecommissionerofadministration,withtheapprovalof 29thegovernor,shallorganizetheworkoftheofficeofadministrationinsuchmannerasto 30obtainmaximumeffectivenessofthepersonneloftheoffice.Heorshemayconsolidate, 31abolish, orreassigndutiesofpositionsordivisionscombinedwithintheofficeof 32administration[, exceptforthedivisionofpersonnel.Heorshemaydelegatespecific 33dutiestosubordinates]. Thesesubordinatesshalltakethesameoathasthecommissionerand 34shallbecoveredbythebondofthedirectororbyseparatebondasrequiredbythegovernor. 35 5.[Thepersonneldivision,personneldirectorandpersonneladvisoryboardas 36providedinchapter36shallbeintheofficeofadministration.] Thepersonneldirectorand 37employeesofthepersonneldivisionshallperformsuchdutiesasdirectedbythe 38commissionerofadministrationforpersonnelworkinagenciesanddepartmentsofstate 39governmenttoupgradestateemploymentandtoimprovetheuniformqualityofstate 40employment. 41 6.Thecommissionerofadministrationshallprepareacompleteinventoryofallreal 42estate,buildingsandfacilitiesofstategovernmentandananalysisoftheirutilization.Each 43yearheorsheshallformulateandsubmittothegovernoralong-rangeplanfortheensuing 44fiveyearsfortherepair,constructionandrehabilitationofallstateproperties.Theplanshall 45setforththeprojectsproposedtobeauthorizedineachofthefiveyearswitheachproject 46rankedintheorderofurgencyofneedfromthestandpointofthestateasawholeandshallbe 47upgradedeachyear.Projectproposalsshallbeaccompaniedbyworkloadandutilization 48informationexplainingtheneedandpurposeofeach.Departmentsshallsubmit 49recommendationsforcapitalimprovementprojectsandotherinformationinsuchformand 50atsuchtimesasrequiredbythecommissionerofadministrationtoenablehimorherto 51preparethelong-rangeplan.Thecommissionerofadministrationshallpreparethelong- 52rangeplantogetherwithanalysisoffinancingavailableandsuggestionsforfurtherfinancing 53forapprovalofthegovernorwhoshallsubmitittothegeneralassembly.Thelong-rangeplan 54shallincludecredibleestimatesforoperatingpurposesaswellascapitaloutlayandshall 55includeprogramdatatojustifyneedfortheexpendituresincluded.Thelong-rangeplanshall 56beextended,revisedandresubmittedinthesamemannertoaccompanyeachexecutive 57budget.Theappropriaterecommendationsfortheperiodforwhichappropriationsaretobe 58madeshallbeincorporatedintheexecutivebudgetforthatperiodtogetherwith 59recommendationsforfinancing.Eachrevisedlong-rangeplanshallprovideareporton 60progressintherepair,constructionandrehabilitationofstatepropertiesandoftheoperating SCSHB2090 12 61purposesprogramfortheprecedingfiscalperiodintermsofexpendituresandmeeting 62programgoals. 63 7.TheofficeofthecommissionerofadministrationshallbeinJeffersonCity. 64 8.Incaseofdeath,resignation,removalfromofficeorvacancyfromanycauseinthe 65officeofcommissionerofadministration,thegovernorshalltakechargeoftheofficeand 66superintendthebusinessthereofuntilasuccessorisappointed,commissionedandqualified. 105.950.1.UntilJune30,2000,thecommissionerofadministrationandthe 2directorsofthedepartmentsofrevenue,socialservices,agriculture,economicdevelopment, 3corrections,laborandindustrialrelations,naturalresources,andpublicsafetyshallcontinue 4toreceivethesalariestheyreceivedonAugust27,1999,subjecttoannualadjustmentsas 5providedinsection105.005. 6 2.OnandafterJuly1,2000,thesalaryofthedirectorsoftheabovedepartmentsshall 7besetbythegovernorwithinthelimitsofthesalaryrangesestablishedpursuanttothis 8sectionandtheappropriationforthatpurpose.Salaryrangesfordepartmentdirectorsand 9membersoftheparoleboardshallbesetbythepersonnel[advisoryboard] directorafter 10consideringtheresultsofastudyperiodicallyperformedoradministeredbytheofficeof 11administration.Suchsalaryrangesshallbepublishedyearlyinanappendixtotherevised 12statutesofMissouri. 13 3.Eachoftheabovesalariesshallbeincreasedbyanysalaryadjustmentprovided 14pursuanttotheprovisionsofsection105.005. 105.1114.Administrativeproceduresfortheimplementationofsections105.1100to 2105.1116shallbepromulgatedbythe[state] personnel[advisoryboard] directorforthose 3employeesclassifiedunderthestatepersonnellawandbyotherpublicemployersforthose 4employeesundertheirmanagementandcontrol.Noruleorportionofarulepromulgated 5undertheauthorityofsections105.1100to105.1116shallbecomeeffectiveunlessithasbeen 6promulgatedpursuanttotheprovisionsofsection536.024. 136.370.1.Pursuanttochapter143andchapter144,thedirectorshallwaiveany 2interestorpenaltyassessedagainstanytaxpayerwhenitisdeterminedbythedirector,the 3administrativehearingcommission,oracourtoflawthatthenegligenceofanemployeeof 4thedepartmentresultedinunduedelay,asdefinedbyruleorregulation,ineitherassessingtax 5ornotifyingthetaxpayeroftheliabilityowed.Suchwaiverofinterestorpenaltyshallbefor 6thatamountattributabletotheperiodofdelayandforanytimethatthepenaltyorinterestis 7underappeal. 8 2.Notwithstandinganyprovisionoflawtothecontrary,thedirectorshall 288.220.1.Subjecttothesupervisionofthedirectorofthedepartmentoflaborand 2industrialrelations,thedivisionofemploymentsecurityofthedepartmentoflaborand 3industrialrelationsshallbeunderthecontrol,managementandsupervisionofadirectorwho 4shallbeappointedbythegovernor,byandwiththeadviceandconsentofthesenate.The 5directorshallserveatthepleasureofthegovernor. 6 2.ThedivisionshallberesponsibleforadministeringtheMissouristate 7unemploymentinsuranceoperationandanyotheroperationsasarenecessarytoadminister 8thestate'semploymentsecuritylaw. 9 3.ThecentralofficeofthedivisionshallbemaintainedintheCityofJefferson. 10 4.Subjecttothesupervisionandapprovalofthedirectorofthedepartmentoflabor 11andindustrialrelations,itshallbethedutyofthedirectortoadministerthislaw;andthe 12directorshallhavepowerandauthoritytoadopt,amend,orrescindanyregulationsasthe 13directordeemsnecessarytotheefficientinternalmanagementofthedivision.Thedirector 14shalldeterminethedivision'sorganizationandmethodsofprocedure.Subjecttothe 15provisionsofthestate[meritsystem] personnellaw,chapter36,thedirectorshallemploy 16andprescribethedutiesandpowersofthepersonsasmaybenecessary.Thedirectorshall 17collaboratewiththepersonneldirector[andthepersonneladvisoryboard]
