33.100.Thesalariesofallelectiveandappointiveofficersandemployeesofthestate
2shallbepaidoutofthestatetreasury,insemimonthlyormonthlyinstallmentsoronceevery

4theofficersandemployeesshallbepresentedtothecommissionerofadministrationanda

21becomeeffectiveunlessithasbeenpromulgatedpursuanttotheprovisionsofsection

36.070.1.The[board] commissionerofadministrationshallhavepowerto
2prescribesuchrulesandregulationsnotinconsistentwiththeprovisionsofthischapteras[it]
3heorshedeemssuitableandnecessarytocarryouttheprovisionsofthischapter.Suchrules
4andregulationsshallbeeffectivewhenfiledwiththesecretaryofstateasprovidedbylaw.
5 2.The[board] commissionerofadministrationshallprescribebyrulethe
6proceduresformeritselection,uniformclassificationandpay,andcoveredappealsin
7accordancewiththeprovisionsofthischapter.
8 3.AsofAugust28,2022,therulesofthepersonneladvisoryboardpreviously
9establishedbythischaptershallbecomerulesofthecommissionerofadministration.
36.080.1.Thedirectorshallbeaperson, appointedbythecommissionerof
2administration,whoisexperiencedintheprinciplesandmethodsofpersonnel
3administration,whoisfamiliarwithandinsympathywiththeapplicationofmerit

5appointedforatermoffouryearsbeginningonJulyfirstfollowingtheelectionofagovernor,
6whichtermmayberenewedatitsexpirationattheoptionofthegovernor.
7 2.Thepersonneldirectorshallnotduringhisorhertermofoffice,orforoneyear
8priorthereto:
9 (1)Beamemberofanylocal,stateornationalcommitteeofapoliticalparty;
10 (2)Beamemberofanypartisanpoliticalclubororganization;
11 (3)Activelyparticipateinanypartisanpoliticalcampaign;or
12 (4)Holdorbeacandidateforanypartisanpublicoffice.
13 3.[Uponanimpendingoractualvacancyinthepositionofdirector,theboardshall
14publiclysolicitapplicationsforthepositionandprepareandsubmittothegovernoralistof
15thefivemostqualifiedapplicants.Inthecourseofpreparingsuchalisttheboardmayengage
16theservicesofpersonsexperiencedinpersonneladministrationasconsultantstoassistitin
17examininganddeterminingthebestqualifiedavailablepersonsforappointmentasdirector.
18Theboardshallbeauthorizedtopay,outofthefundsappropriatedtoit,thenecessarytravel
19andotherexpensesofanyconsultantsengagedundertheprovisionsofthissection,andmay
20alsodefraythetravelexpensesofcandidatesforthepositionwhoarerequestedtoreportfor
21aninterview.Thedirectormayalsoassisttheboardwiththesearchprocessanddivisionof
22personnelresourcesmaybeusedtoadvancethesearchprocess.
23 4.Theprovisionsofsubdivision(2)ofsubsection5ofsection1oftheReorganization
24Actof1974notwithstanding,thetotalcompensationofanydirectorshallnotexceedthe
25statutorysalaryofdepartmentheads.
26 5.Theprovisionsofsubsection8ofsection15oftheReorganizationActof1974
27notwithstanding,thegovernorshallappointtothepositionofdirector,withoutregardtohisor
28herpoliticalaffiliationandsubjecttotheadviceandconsentofthesenate,oneofthepersons
29namedonthelistsubmittedbytheboard.
30 6.]Thedirectormayberemovedbythe[board] commissionerofadministrationfor
31noreasonorforanyreasonnotprohibitedbylaw.
36.090.1.Thedirector,asexecutiveheadofthepersonneldivision,shalldirectand
2superviseallitsadministrativeandtechnicalactivities.Inadditiontothedutiesimposed
3uponthedirectorelsewhereinthischapter,thedirectormaydevelopincooperationwith
4appointingauthoritiesamanagementtrainingprogram,arecruitingprogram,andasystemof
5performanceappraisals,and[to]mayassistappointingauthoritiesinthesettingof
6productivitygoals.
7 2.[Thedirectorshallassisttheboardintheperformanceofitsfunctionsandattend
8boardmeetings.
9 3.]Thedirectormay:

11chapterpursuanttosubsection1ofsection36.030orpursuanttosection36.031,inwhich
12thereshallbesetforth,astoeachemployee,arecordoftheclasstitleofthepositionheld;the
13salaryorpay;anychangeinclasstitle,payorstatus,andsuchotherdataasmaybedeemed
14desirabletoproducesignificantfactspertainingtopersonneladministration;
15 (2)Appointandfixthecompensationofsuchexpertsandspecialassistantsasmaybe
16necessarytocarryouteffectivelytheprovisionsofthischapter;
17 (3)Investigatetheeffectsofthischapterandtherulespromulgatedunderthischapter
18andreporthisorherfindingsandrecommendationstothe[board] commissionerof
19administrationandthegovernor;
20 (4)Makeannualreportsconcerningtheworkofthedivision,problemsinpersonnel
21management,andactionstakenortobetakenbythedivisiontoresolvethoseproblems;
22 (5)Performanyotherlawfulactwhichheorshemayconsidernecessaryordesirable
23tocarryoutthepurposesandprovisionsofthischapter.
24 [4.]3.Thedirectorshallappointadeputyordeputies.Incaseoftheabsenceofthe
25directororhisorherinabilityfromanycausetodischargethepowersanddutiesofhisorher
26office,suchpowersanddutiesshalldevolveuponhisorherdeputyordeputies.
36.100.1.Thedirectorshallascertaintheduties,authorityandresponsibilitiesofall
2positionssubjecttothischapterpursuanttosubsection1ofsection36.030,andallpositions
3subjecttothissectionpursuanttosection36.031.Afterconsultationwiththeappointing
4authorities,thedirectorshallprepare[andrecommendtotheboard], andmaintainona
5continuingbasis,apositionclassificationplan,whichshallgroupallpositionssubjecttothis
6chapterpursuanttosubsection1ofsection36.030,andallpositionssubjecttothissection
7pursuanttosection36.031inclasses,basedontheirduties,authorityandresponsibilities.
8Exceptasprovidedinsubsection2ofthissection,thepositionclassificationplanshallset
9forth,foreachclassofpositions,aclasstitleandastatementoftheduties,authorityand
10responsibilitiesthereof,andthequalificationsthatarenecessaryordesirableforthe
11satisfactoryperformanceofthedutiesoftheclass;provided,thatnoplanshallbeadopted
12whichprohibitsthesubstitutionofexperienceforeducationforeachclassofpositions,except
13that,the[board] directormaydeterminethatthereisnoequivalentsubstitutioninparticular
14cases.Classificationsshouldbesufficientlybroadinscopetoincludeasmanycomparable
15positionsaspossiblebothonanintra-andinter-departmentalbasis.
16 2.Theclassificationplanmaygrouppositionswithsimilarlevelsofresponsibilityor
17expertiseintobroadclassificationbands.
18 3.Thedirectorshall,inconsultationwiththeagencies,eliminateandcombineclasses
19whenpossible,takingintoconsiderationtherecruitment,selection,andcompensationof
20personnelinthevariousclasses.

2thischapterpursuanttosubsection1ofsection36.030oranynewpositioninadepartmentor
3agencyoftheexecutivebranchofstategovernmentsubjecttothissectionpursuanttosection
436.031,orbeforemakinganypermanentandsubstantialchangeoftheduties,authorityor
5responsibilitiesofanysuchposition,anappointingauthorityshallnotifythedirectorin
6writingoftheappointingauthority'sintentiontodoso,exceptwherethepositionsmaybe
7allocatedbytheappointingauthority.
8 2.Thedirectormayatanytimeallocateanynewpositiontoaclass,orchangethe
9allocationofanypositiontoaclass,or[recommendtotheboard] makechangesinthe
10classificationplan.[Anychangeintheclassificationplanrecommendedbythedirectorshall
11takeeffectwhenapprovedbytheboard,orontheninetiethdayafteritisrecommendedtothe
12boardifpriortheretotheboardhasnotapprovedit.Incaseofnecessityrequiringthe
13immediateestablishmentofanewclass,thedirectormayestablishsuchaclassonaninterim
14basispendingapprovaloftheclassbytheboardasrecommendedbythedirector.]
15 3.Whentheallocationofapositiontoaclassischanged,thedirectorshallnotifythe
16appointingauthority.Ifallocationauthorityisdelegated,theappointingauthorityshallnotify
17thedirectorofanychangesintheallocation.Ifthepositionisfilledatthetimeofreallocation
18toaclass,theappointingauthorityshallimmediatelynotifytheincumbentoftheposition
19regardingtheallocationchange.Iftheincumbentdoesnotagreewiththenewallocation,the
20incumbentmaysubmittothedirectorarequestforareviewoftheallocationoftheposition.
21 4.Ifanychangeismadeintheclassificationplanbywhichaclassofpositionsis
22divided,altered,orabolished,orclassesarecombined,thedirectorshallforthwithreallocate
23thepositionsaffectedtotheirappropriateclassesintheamendedclassificationplan.An
24employeewhoisoccupyingapositionreallocatedtoadifferentclassshall,subjecttothe
25regulations,begiventhesamestatusinthenewclassaspreviouslyheldintheclassfrom
26whichhisorherpositionisreallocated.
27 5.[Afteraclassofpositionshasbeenapprovedbytheboard,] Thedirectoris
28authorizedtomakesuchchangesintheclasstitleorinthestatementofdutiesand
29qualificationsfor[the]anewclassasthedirectorfindsnecessaryforcurrentmaintenanceof
30theclassificationplan[; provided,however,thatchangeswhichmateriallyaffectthenature
31andlevelofaclassorwhichinvolveachangeinsalaryrangefortheclassshallbeapproved
32bytheboard].
36.140.1.Afterconsultationwithappointingauthoritiesandthestatefiscalofficers,
2andafterapublichearingfollowingsuitablenotice,thedirectorshallprepare[and
3recommendtotheboard] apayplanforeachclassofpositionssubjecttothischapterpursuant
4tosubsection1ofsection36.030andeachclassofpositionssubjecttothissectionpursuantto
5section36.031.Thepayplanshallinclude,foreachclassofpositions,aminimumanda
SCSHB2090	8 6maximumrate,andsuchprovisionforintermediateratesasthedirectorconsidersnecessary
7orequitable.Thepayplanmayalsoprovidefortheuseofopen,orstepless,payranges.The
8payplanmayincludeprovisionforgroupingofpositionswithsimilarlevelsofresponsibility
9orexpertiseintobroadclassificationbandsforpurposesofdeterminingcompensationandfor
10suchsalarydifferentialsandotherpaystructuresasthedirectorconsidersnecessaryor
11equitable.Inestablishingtherates,thedirectorshallgiveconsiderationtotheexperiencein
12recruitingforpositionsinthestateservice,theratesofpayprevailinginthestateforthe
13servicesperformed,andforcomparableservicesinpublicandprivateemployment,living
14costs,maintenance,orotherbenefitsreceivedbyemployees,andthefinancialconditionand
15policiesofthestate.Theseconsiderationsshallbemadeonastatewidebasisandshallnot
16makeanydistinctionbasedongeographicalareasorurbanandruralconditions.Thepayplan
17shalltakeeffectwhenapprovedby[theboardand]thegovernor,andeachemployee
18appointedtoapositionsubjecttothischapterpursuanttosubsection1ofsection36.030and
19eachclassofpositionssubjecttothissectionpursuanttosection36.031,aftertheadoptionof
20thepayplanshallbepaidaccordingtotheprovisionsofthepayplanforthepositioninwhich
21heorsheisemployed;provided,thatthecommissionerofadministrationcertifiesthatthere
22arefundsappropriatedandavailabletopaytheadoptedpayplan.Thepayplanshallalsobe
23usedasthebasisforpreparingbudgetestimatesforsubmissiontothelegislatureinsofaras
24suchbudgetestimatesconcernpaymentforservicesperformedinpositionssubjecttothis
25chapterpursuanttosubsection1ofsection36.030andpositionssubjecttothissection
26pursuanttosection36.031.Amendmentstothepayplanmayberecommendedbythe
27directorfromtimetotimeascircumstancesrequireandsuchamendmentsshalltakeeffect
28whenapprovedasprovidedbythissection.Theconditionsunderwhichemployeesmaybe

4providedbylawandshallalsoreceivehisorheractualandnecessaryexpensesincurredinthe
5dischargeofhisorherofficialduties.Beforetakingoffice,thecommissionerof
6administrationshalltakeandsubscribeanoathoraffirmationtosupporttheConstitutionof
7theUnitedStatesandofthisstate,andtodemeanhimselforherselffaithfullyinoffice.The
8commissionershallalsodepositwiththegovernorabond,withsuretiestobeapprovedbythe
9governor,intheamounttobedeterminedbythegovernorpayabletothestateofMissouri,
10conditionedonthefaithfulperformanceofthedutiesofhisorheroffice.Thepremiumofthis
11bondshallbepaidoutoftheappropriationfortheofficeofthegovernor.
12 2.Thegovernorshallappointthecommissionerofadministrationwiththeadviceand
13consentofthesenate.Thecommissionershallbeatleastthirtyyearsofageandmusthave
14beenaresidentandqualifiedvoterofthisstateforthefiveyearsnextprecedinghisorher
15appointment.Heorsheshallbequalifiedbytrainingandexperiencetoassumethe
16managerialandadministrativefunctionsoftheofficeofcommissionerofadministration.
17 3.Thecommissionerofadministrationshall,byvirtueofhisorheroffice,without
18additionalcompensation,headthedivisionofbudget,thedivisionofpurchasing,thedivision
19offacilitiesmanagement,designandconstruction,thedivisionofpersonnel,andthe
20informationtechnologyservicesdivision.Wheneverprovisionsoftheconstitutiongrant
21powers,imposedutiesormakeotherreferencetothecomptroller,theyshallbeconstruedas
22referringtothecommissionerofadministration.
23 4.Thecommissionerofadministrationshallprovidethegovernorwithsuch
24assistanceinthesupervisionoftheexecutivebranchofstategovernmentasthegovernor

26bylaw.Thecommissionerofadministrationshallworkwithotherdepartmentsofthe
27executivebranchofstategovernmenttopromoteeconomy,efficiencyandimprovedservice
28inthetransactionofstatebusiness.Thecommissionerofadministration,withtheapprovalof
29thegovernor,shallorganizetheworkoftheofficeofadministrationinsuchmannerasto
30obtainmaximumeffectivenessofthepersonneloftheoffice.Heorshemayconsolidate,
31abolish, orreassigndutiesofpositionsordivisionscombinedwithintheofficeof
32administration[, exceptforthedivisionofpersonnel.Heorshemaydelegatespecific
33dutiestosubordinates]. Thesesubordinatesshalltakethesameoathasthecommissionerand
34shallbecoveredbythebondofthedirectororbyseparatebondasrequiredbythegovernor.
35 5.[Thepersonneldivision,personneldirectorandpersonneladvisoryboardas

51preparethelong-rangeplan.Thecommissionerofadministrationshallpreparethelong-
52rangeplantogetherwithanalysisoffinancingavailableandsuggestionsforfurtherfinancing
53forapprovalofthegovernorwhoshallsubmitittothegeneralassembly.Thelong-rangeplan
54shallincludecredibleestimatesforoperatingpurposesaswellascapitaloutlayandshall
55includeprogramdatatojustifyneedfortheexpendituresincluded.Thelong-rangeplanshall
56beextended,revisedandresubmittedinthesamemannertoaccompanyeachexecutive
57budget.Theappropriaterecommendationsfortheperiodforwhichappropriationsaretobe
58madeshallbeincorporatedintheexecutivebudgetforthatperiodtogetherwith
59recommendationsforfinancing.Eachrevisedlong-rangeplanshallprovideareporton
