HB2152 2 55 (2)Theboardmayapproveanyplansubmittedundersubsection2ofthis 56sectioniftheboarddeterminesthat: 57 (a)Theplansuccessfullydemonstratestheabilitytoaddresstheintentofthe 58provisionoflawtobewaivedinamoreeffective,efficient,oreconomicalmanner; 59 (b)Thewaiversormodificationsaredemonstratedtobenecessarytostimulate 60orimprovestudentreadinessforpostsecondarylife,increaseteachersalaries,or 61increasetheattractivenessoftheteachingprofessionforprospectiveteachersandactive 62teachers; 63 (c)Theplanhasdemonstratedsufficientparticipationfromamongtheteachers, 64principal,superintendent,faculty,schoolboard,parents,andthecommunityatlarge; 65and 66 (d)Theplanisbaseduponsoundeducationalpractices,doesnotendangerthe 67healthandsafetyofstudentsorstaff,anddoesnotcompromiseequalopportunityfor 68learning. 69 (3)Theboardmayproposemodificationstotheplanincooperationwiththe 70schoolinnovationteam. 71 5.Anywaivergrantedunderthissectionshallbeeffectiveforaperiodofno 72longerthanthreeschoolyearsbeginningtheschoolyearfollowingtheschoolyearin 73whichthewaiverisapproved.Anywaivermayberenewed.Nomorethanoneschool 74innovationwaivershallbeineffectwithrespecttoanyoneelementaryorsecondary 75schoolatonetime. 76 6.Thissectionshallnotbeconstruedtoallowtheboardtoauthorizethewaiver 77ofanystatutoryrequirementsrelatingtoschoolstartdate,teachercertification,teacher 78tenure,oranyrequirementimposedbyfederallaw. 79 7.Theboardmaypromulgaterulesimplementingtheprovisionsofthissection. 80Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated 81undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 82withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section 83536.028.Thissectionandchapter536arenonseverable,andifanyofthepowersvested 84withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate, 85ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 86ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shall 87beinvalidandvoid. ✔ HB2152 3
