2thereof,tobeknownassection161.214,toreadasfollows:
161.214.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Board",thestateboardofeducation;
3 (2)"Department",thedepartmentofelementaryandsecondaryeducation;
4 (3)"Schoolinnovationteam",agroupofnaturalpersonsrepresenting:
5 (a)Asingleelementaryorsecondaryschool;
6 (b)Agroupoftwoormoreelementaryorsecondaryschoolswithinthesame
7schooldistrictthatsharecommoninterests,suchasgeographicallocationoreducational
8focus,orthatsequentiallyserveclassesofstudentsastheyprogressthroughelementary
9andsecondaryeducation;
10 (c)Agroupoftwoormoreelementaryorsecondaryschoolsnotwithinthesame
11schooldistrictthatsharecommoninterests,suchasgeographicallocationoreducational
12focus,orthatsequentiallyserveclassesofstudentsastheyprogressthroughelementary

EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (4)"Schoolinnovationwaiver",awaivergrantedbytheboardtoasingleschool,
19groupofschools,singleschooldistrict,orgroupofschooldistrictsunderthissection,in
20whichtheschool,groupofschools,schooldistrict,orgroupofschooldistrictsisexempt
21fromaspecificrequirementimposedbychapter160,161,162,167,170,or171,orany
22regulationspromulgatedundersuchchaptersbytheboardorthedepartment.Any
23schoolinnovationwaivergrantedtoaschooldistrictorgroupofschooldistrictsshall
24applytoeveryelementaryandsecondaryschoolwithintheschooldistrictorgroupof
25schooldistrictsunlesstheplanspecificallyprovidesotherwise.
26 2.Anyschoolinnovationteamseekingaschoolinnovationwaivermaysubmita
27plantotheboardforoneormoreofthefollowingpurposes:
28 (1)Improvingstudentreadinessforemployment,highereducation,vocational
29training,technicaltraining,oranyotherformofcareerandjobtraining;
30 (2)Increasingthecompensationofteachers;or
31 (3)Improvingtherecruitment,retention,training,preparation,orprofessional
32developmentofteachers.
33 3.Anyplanforaschoolinnovationwaivershall:
34 (1)Identifythespecificprovisionoflawforwhichawaiverisbeingrequested
35andprovideanexplanationforwhythespecificprovisionoflawinhibitstheabilityof
36theschoolorschooldistricttoaccomplishthegoalstatedintheplan;
37 (2)Demonstratethattheintentofthespecificprovisionoflawcanbeaddressed
38inamoreeffective,efficient,oreconomicalmannerandthatthewaiverormodification
39isnecessarytoimplementtheplan;
40 (3)Includemeasurableannualperformancetargetsandgoalsforthe
41implementationoftheplan;
42 (4)Specifytheinnovationstobepursuedinmeetingoneormoreofthegoals
43listedinsubsection2ofthissection;
44 (5)Demonstrateparental,schoolemployee,andcommunityandbusiness
45supportfor,andengagementwith,theplan;and
46 (6)Beapprovedbyatleasttheminimumnumberofpeoplerequiredtobeonthe
47schoolinnovationteampriortosubmittingtheplanforapproval.
48 4.(1)Inevaluatingaplansubmittedbyaschoolinnovationteamunder
49subsection2ofthissection,theboardshallconsiderwhethertheplanwill:
50 (a)Improvethepreparation,counseling,andoverallreadinessofstudentsfor
51postsecondarylife;
52 (b)Increaseteachersalariesinafinanciallysustainableandprudentmanner;or
53 (c)Increasetheattractivenessoftheteachingprofessionforprospectiveteachers
54andactiveteachersalike.
HCSHB2152	2 55 (2)Theboardmayapproveanyplansubmittedundersubsection2ofthis
56sectioniftheboarddeterminesthat:
57 (a)Theplansuccessfullydemonstratestheabilitytoaddresstheintentofthe
58provisionoflawtobewaivedinamoreeffective,efficient,oreconomicalmanner;
59 (b)Thewaiversormodificationsaredemonstratedtobenecessarytostimulate
60orimprovestudentreadinessforpostsecondarylife,increaseteachersalaries,or
61increasetheattractivenessoftheteachingprofessionforprospectiveteachersandactive
62teachers;
63 (c)Theplanhasdemonstratedsufficientparticipationfromamongtheteachers,
64principal,superintendent,faculty,schoolboard,parents,andthecommunityatlarge;
65and
66 (d)Theplanisbaseduponsoundeducationalpractices,doesnotendangerthe
67healthandsafetyofstudentsorstaff,anddoesnotcompromiseequalopportunityfor
68learning.
69 (3)Theboardmayproposemodificationstotheplanincooperationwiththe
70schoolinnovationteam.
71 5.Anywaivergrantedunderthissectionshallbeeffectiveforaperiodofno
72longerthanthreeschoolyearsbeginningtheschoolyearfollowingtheschoolyearin
73whichthewaiverisapproved.Anywaivermayberenewed.Nomorethanoneschool
74innovationwaivershallbeineffectwithrespecttoanyoneelementaryorsecondary
75schoolatonetime.
76 6.Thissectionshallnotbeconstruedtoallowtheboardtoauthorizethewaiver
77ofanystatutoryrequirementsrelatingtoschoolstartdate,teachercertification,teacher
78tenure,oranyrequirementimposedbyfederallaw.
79 7.Thedepartmentshallpublishanannualreportbasedontheschoolinnovation
80waiversconsideredbythestateboard.Thereportshalldocumentthewaivers
81submittedandwaiversapproved,atthestatewide,district,andschoolbuildinglevels,
82andprovidedataatthestatewide,district,andschoolbuildinglevelsofsufficientdetail
83toallowanalysisoftrendsregardingthepurposesforwaiverrequests,thestatutes
84waivedorrequestedtobewaived,anymodificationsapprovedbythestateboardand
85thestateboard'sactionstoapproveordenywaiverrequests.
86 8.Theboardmaypromulgaterulesimplementingtheprovisionsofthissection.
87Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated
88undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
89withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section
90536.028.Thissectionandchapter536arenonseverable,andifanyofthepowersvested
91withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate,
HCSHB2152	3 92ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant
93ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shall
94beinvalidandvoid.
[161.210.1.Notwithstandinganyprovisionoflawtothecontrary,the
2 stateboardofeducationisherebygrantedauthoritytowaiveormodifyany
3 administrativeruleadoptedbythestateboardorpolicyimplementedbythe
4 departmentofelementaryandsecondaryeducation.Schooldistrictsmay
5 submitapplicationsforawaiverormodificationauthorizedpursuanttothis
6 section.Eachapplicationshallincludeawrittenrequestbytheschooldistrict
7 orschooldistrictsandshalldemonstratethattheintentoftheruleorpolicycan
8 beaddressedinamoreeffective,efficientoreconomicalmannerorthatthe
9 waiverormodificationisnecessarytoimplementaspecificplanforimproved
10 studentperformanceandschoolimprovement.Priortoanapplicationfor
11 waiver,theschooldistrictshallholdapublichearingregardingsuchwaiver.
12 2.Thestateboardofeducationmaygrantwaiversormodificationsfor
13 aschooldistrictorschooldistrictsthatsuccessfullydemonstratetheabilityto
14 addresstheintentoftheruleorpolicyinamoreeffective,efficientor
15 economicalmannerorwhenthewaiversormodificationsaredemonstratedto
16 benecessarytostimulateinnovationorimprovestudentperformance,
17 providedthatthewaiverormodificationisbaseduponsoundeducational
18 practices,doesnotendangerthehealthandsafetyofstudentsorstaff,anddoes
19 notcompromiseequalopportunityforlearning.Approvedwaiversor
20 modificationsshallremainineffectforaperiodnottoexceedthreeschool
21 yearsandmayberenewedbythestateboardofeducationuponapplicationby
22 theschooldistrictorschooldistricts.
23 3.Thissectionshallnotbeconstruedtoallowthestateboardof
24 educationtoauthorizethewaiverofanystatutoryrequirementsrelatingto
25 teachercertificationorteachertenure.]
