166.705.1.AparentofaqualifiedstudentmayestablishaMissouriempowerment
2scholarshipaccountforthestudentbyenteringintoawrittenagreementwithaneducational
3assistanceorganization.Theagreementshallprovidethat:
4 (1)Thequalifiedstudentshallenrollinaqualifiedschoolandreceiveaneducationin
5atleastthesubjectsofEnglishlanguagearts,mathematics,socialstudies,andscience;
6 (2)Exceptforaqualifiedstudentwhoisinthecustodyofthestate,thequalified
7studentshallnotbeenrolledinapublicschooloperatedby,oracharterschoollocatedwithin,
8thequalifiedstudent'sdistrictofresidenceandshallreleasethedistrictofresidencefromall
9obligationstoeducatethequalifiedstudentwhilethequalifiedstudentisenrolledinthe
10program.Thissubdivisionshallnotbeconstruedtorelievethestudent'sdistrictofresidence
11fromtheobligationtoconductanevaluationfordisabilities;
12 (3)Thequalifiedstudentshallreceiveagrant,intheformofmoneysdepositedin
13accordancewithsection135.714,inthequalifiedstudent'sMissouriempowerment
14scholarshipaccount;
15 (4)Themoneysdepositedinthequalifiedstudent'sMissouriempowerment
16scholarshipaccountshallbeusedonlyforthefollowingexpensesofthequalifiedstudent:
17 (a)Tuitionorfeesataqualifiedschool;
18 (b)Textbooksrequiredbyaqualifiedschool;
19 (c)Educationaltherapiesorservicesfromalicensedoraccreditedpractitioneror
20providerincluding,butnotlimitedto,licensedoraccreditedparaprofessionalsoreducational
21aides;
22 (d)Tutoringservices;
23 (e)Curriculum;

25 (g)Feesforanationallystandardizednorm-referencedachievementtest,advanced

33qualifiedstudent'seducationalneedsandthatareapprovedbyaneducationalassistance

35 (k)Feesforsummereducationprogramsandspecializedafter-schooleducation

37 (l)Transportationcostsformileagetoandfromaqualifiedschool;and
38 (5)Moneysdepositedinthequalifiedstudent'sMissouriempowermentscholarship
39accountshallnotbeusedforthefollowing:
40 (a)Consumableeducationalsuppliesincluding,butnotlimitedto,paper,pens,
41pencils,ormarkers;
42 (b)TuitionataprivateschoollocatedoutsideofthestateofMissouri;and
43 (c)Paymentsorreimbursementstoanypersonrelatedwithinthethirddegreeof
44consanguinityoraffinitytoaqualifiedstudent.
45 2.Missouriempowermentscholarshipaccountsarerenewableonanannualbasis
46uponrequestoftheparentofaqualifiedstudent.Notwithstandinganychangestothe
47qualifiedstudent'smultidisciplinaryevaluationteamplan,astudentwhohaspreviously
48qualifiedforaMissouriempowermentscholarshipaccountshallremaineligibletoapplyfor
49renewaluntilthestudentcompleteshighschoolandsubmitsscorestothestatetreasurerfrom
50anationallystandardizednorm-referencedachievementtest,advancedplacement
51examination,internationalbaccalaureateexamination,oranyexaminationrelatedtocollege
52oruniversityadmissionpurchasedwithMissouriempowermentscholarshipaccountfunds.
53 3.[Asignedagreementunderthissectionshallsatisfythecompulsoryschool
54attendancerequirementsofsection167.031.
55 4.]Aqualifiedschooloraproviderofservicespurchasedunderthissectionshallnot
56share,refund,orrebateanyMissouriempowermentscholarshipaccountmoneyswiththe
57parentorqualifiedstudentinanymanner.
58 [5.]4.Ifaqualifiedstudentwithdrawsfromtheprogrambyenrollinginaschool
59otherthanaqualifiedschoolorisdisqualifiedfromtheprogramundertheprovisionsof
60section166.710,thequalifiedstudent'sMissouriempowermentscholarshipaccountshallbe

62forredistributiontootherqualifiedstudents.Undersuchcircumstances,theobligationto
63provideaneducationforsuchstudentshalltransferbacktothestudent'sdistrictofresidence.
64 [6.]5.Anyfundsremaininginaqualifiedstudent'sMissouriempowerment
65scholarshipaccountattheendofaschoolyearshallremainintheaccountandshallnotbe
66returnedtotheeducationalassistanceorganization.Anyfundsremaininginaqualified
67student'sMissouriempowermentscholarshipaccountupongraduationfromaqualified
68schoolshallbereturnedtotheeducationalassistanceorganizationforredistributiontoother
