41-5appointedforatermoftwoyears;onecommissionershallbeappointedforatermofthree
42-6years;onecommissionershallbeappointedforatermoffouryears.Theirsuccessorsshall
43-7eachbeappointedforatermoffouryears,andsaidcommissionersshallholdofficefortheir
44-8termofappointmentanduntiltheirsuccessorsshallhavebeenappointedandqualified.In
45-9caseofavacancyinsaidboardforanycausewhatsoever,itshallbefilledbyappointmentfor
46-10theunexpiredterm,inthesamemannerasinthecaseoforiginalappointments.Thegovernor
47-11shallissuecommissionstothepersonssoappointed,designatingthetimeforwhichtheyare

54-84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare

87-84.150.Themaximumnumberofofficersofthepoliceforceineachrankineach
88-2suchcityshallbeasfollows:onechiefofpolicewiththerankofcolonel;oneassistantchief
89-3ofpolicewiththerankoflieutenantcolonel;fouradditionallieutenantcolonels[, notto
90-4exceedfiveinnumberandothersuchranksandnumberofmemberswithinsuchranksasthe
91-5boardfromtimetotimedeemsnecessary]; tencaptains;fifty-sevenlieutenants;andone
92-6hundredandeighty-eightsergeants.Nofurtherappointmentstotherankofmajorshall
93-7hereafterbemade,butallmembersoftheforcenowholdingtherankofmajorshall
94-8continueinsuchrankuntiltheirpromotion,demotion,removal,resignation,orother
95-9separationfromtheforce.Theofficersofthepoliceforceshallhavecommissionsissuedto

100-84.160.1.AsofAugust28,[2006] 2022, theboardofpolicecommissionersshall
101-2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice
102-3forcewithoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe
103-4lessthantheannualsalariespaidtoeachmemberatthetimeoftheenactmentofthis
104-HCSHB2432 3 5sectionandwhichannualsalaryshallincreasebynolessthanfourthousanddollarsas
105-6ofJuly1,2023.
106-7 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires
107-8nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed
108-9threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof
109-10subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime
110-11offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof
111-12therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe
112-13contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation
113-14pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat
114-15fundingforsuchcompensationshallnot:
115-16 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice
116-17commissionersofthecity;or
117-18 (2)Beviolativeofanyfederallaworotherstatelaw.
118-19 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake
119-20thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe
120-21mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal
121-22assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot
122-23limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof
123-24anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther,
124-25thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch
125-26limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe
126-27provisionsofthecharterofsuchcities.
127-28 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
128-29boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice
129-30renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe
130-31establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half
131-32timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except
132-33that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto
133-34whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade
134-35frompaymentsforovertimeforthepurposeofretirementbenefits.
135-36 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,
136-37probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional
137-38compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe
138-39totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas
139-40compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor.

253-25priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued

263-35entitledtothesamepensionbenefitsprovidedasemployeesofthemunicipalpolice

265-37 6.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand
