HCSSB984 9 33 4.InordertoincreasefloodresiliencyalongtheMissouriandMississippiRivers 34andtheirtributaries,andimprovestatewidefloodforecastingandmonitoringability, 35thereisherebyestablisheda"FloodResiliencyProgram".Theprogramshallbe 36administeredbythedepartmentofnaturalresources.Thestatemayparticipatewitha 37promoterinthedevelopment,construction,orrenovationofafloodresiliencyprojectif 38thepromoterhasaplanwhichhasbeensubmittedtoandapprovedbythedirector,or 39thestatemaypromoteafloodresiliencyprojectandinitiateaplanonitsownaccord. 40 5.Theplanshallincludeadescriptionofthefloodresiliencyproject,theneedfor 41theproject,thefloodresiliencymeasurestobeimplemented,thepartnerstobeinvolved 42intheproject,andothersuchinformationasthedirectormayrequiretoadequately 43evaluatethemeritoftheproject. 44 6.Thedirectorshallonlyapproveaplanuponadeterminationthatlong-term 45floodmitigationisneededinthatareaofthestate,andthatsuchaplanproposesflood 46resiliencymeasureswhichwillprovidelong-termfloodresiliency. 47 7.Promoterswithapprovedfloodresiliencyplansandprojectsshallbeeligible 48toreceiveanygifts,contributions,grants,orbequestsfromfederal,state,private,or 49othersourcesforengineering,constructionorrenovationcostsassociatedwithsuch 50projects. 51 8.Promoterswithapprovedfloodresiliencyprojectsmaybegrantedfundsfrom 52thefloodresiliencyimprovementfundpursuanttosubsection3ofthissection. 53 9.Thedepartmentofnaturalresourcesisherebygrantedauthorityto 54promulgaterulestoimplementthissection.Anyruleorportionofarule,asthattermis 55definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection 56shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof 57chapter536and,ifapplicable,section536.028.Thissectionandchapter536are 58nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 59chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 60subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule 61proposedoradoptedafterAugust28,2022,shallbeinvalidandvoid. 260.221.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Processedrecycledasphaltshingles",recycledasphaltshinglesthatdonot 3containextraneousmetals,glass,rubber,nails,soil,brick,tars,paper,wood,andplastics 4andthathavebeenreducedinsizetoproduceacommerciallyreasonableusable 5product."Processedrecycledasphaltshingles"shallalsobeconsideredcleanfill,as 6suchtermisdefinedinsection260.200; HCSSB984 10 7 (2)"Recycledasphaltshingles",manufacturewastescrapshinglesandpost- 8consumer,tear-offscrapshinglesthatareaccumulatedasproductsforcommercial 9purposesrelatedtorecyclingorreuseasprocessedrecycledasphaltshingles. 10 2.Processedrecycledasphaltshinglesmaybeusedforfill,reclamation,and 11otherbeneficialpurposeswithoutapermitundersections260.200to260.345ifsuch 12processedrecycledasphaltshinglesareinspectedfortoxicandhazardoussubstancesin 13accordancewithrequirementsestablishedbythedepartmentofnaturalresources, 14providedthatprocessedrecycledasphaltshinglesshallnotbeusedforsuchpurposes 15withinfivehundredfeetofanylake,river,sinkhole,perennialstream,orephemeral 16stream,orwithinfiftyfeetabovethewatertable,exceptwhen: 17 (1)Thewatertableisperched; 18 (2)Usedasfillinaroadorhighwayembankment,solongastheprocessed 19recycledshinglesarenotinstalledwithinfivefeetoftheaveragesurfacewaterelevation 20ofthestreamorthebasefloodelevationofthestream,asdefinedbytheNationalFlood 21InsuranceProgram,whicheverislower;or 22 (3)Usedasorcontainedinanysurfacingmaterialsforanyroadorhighway. 23 3.Thissectionshallnotbeconstruedtoauthorizetheabandonment, 24accumulation,placement,orstorageofrecycledasphaltshinglesorprocessed 25recycledasphaltshinglesonanyrealpropertywithouttheconsentofthereal 26propertyowner. 27 4.Allprocessorsoraccumulators,exceptanygovernmentalbody,of 28unprocessedasphaltshingles,recycledasphaltshingles,orprocessedrecycledasphalt 29shinglesshallconvertallprocessedmaterialintoabeneficialusewithinthreeyearsof 30preparingoraccumulatingthematerial. 31 5.Allprocessorsoraccumulators,exceptanygovernmentalbody,of 32unprocessedasphaltshingles,recycledasphaltshingles,orprocessedrecycledasphalt 33shinglesshallpostabondofonemilliondollarsinfavorofthelocalgovernmentalentity 34withjurisdictionoverthesiteforthepurposeoffundingcleanupofabandonedasphalt 35shingles.Intheeventthattheprocessorsoraccumulatorsuspendsoperationsor 36dissolvesthecompanypriortoprocessingtheaccumulatedshingles,thebondshallbe 37forfeited,exceptiftheprocessorsellsthepropertytoanotherentityforthepurposesof 38processingtheasphaltshinglesintoabeneficialuse. 260.295.Nobuildingcodeadoptedbyapoliticalsubdivisionshallprohibitthe 2useofrefrigerantsthatareapprovedforuseundertheprovisionsof42U.S.C.Section 37671kortheregulationspromulgatedthereunder,providedanyrelatedequipmentis 4installedinaccordancewiththeprovisionsof42U.S.C.Section7671kortheregulations HCSSB984 11 5promulgatedthereunder.Anyprovisionofabuildingcodethatviolatesthissection 6shallbenullandvoid. 644.060.1.Processedrecycledasphaltshingles,asdefinedinsection260.221, 2maybeusedforfill,reclamation,andotherbeneficialpurposeswithoutapermitunder 3sections644.006to644.141ifsuchprocessedrecycledasphaltshinglesareinspectedfor 4toxicandhazardoussubstancesinaccordancewithrequirementsestablishedbythe 5departmentofnaturalresources,providedthatprocessedrecycledasphaltshinglesshall 6notbeusedforsuchpurposeswithinfivehundredfeetofanylake,river,sinkhole, 7perennialstream,orephemeralstream,orwithinfiftyfeetabovethewatertable,except 8when: 9 (1)Thewatertableisperched;
