4plainbytheFederalEmergencyManagementAgencyandwhichislocatedinorpartlywithin
5acountywithacharterformofgovernmentwithgreaterthantwohundredfiftythousand
6inhabitantsbutfewerthanthreehundredthousandinhabitants,unlesstheredevelopmentarea

47thanfortypercentofsuchprojectoriginalprojectedcost,includingredevelopmentproject
48costs,assuchprojects,includingredevelopmentprojectcosts,existedasofJune30,2003,
49andshallallowsuchtaxincrementfinancingdistricttomodify,amend,orexpandsuch

33perbillioninsufficientamountstomeetthedrinkingwaterneedsofallstudentsand
34staffasprovidedinthissection.

36 (a)Conductaninventoryofalldrinkingwateroutletsandalloutletsthatare
37usedfordispensingwaterforcookingorforcleaningcookingandeatingutensilsineach
38oftheschool'sbuildings;
39 (b)Developaplanfortestingeachoutletinventoriedunderparagraph(a)ofthis
40subdivisionandmakesuchplanavailabletothepublic;and
41 (c)Uponrequest,providegeneralinformationonthehealtheffectsoflead
42contaminationandadditionalinformationalresourcesforemployeesandparentsof
43childrenateachschool.
44 (2)Eachschoolshallmakebuildingshousingearlychildhoodeducation
45programs,kindergartens,andelementaryschoolstheprioritywhencomplyingwith
46paragraphs(a)and(b)ofsubdivision(1)ofthissubsection.
47 (3)BeforeAugust1,2024,orthefirstdayonwhichstudentswillbepresentin
48thebuilding,whicheverislater,eachschoolshall:
49 (a)Performalltestingasrequiredbysubsection5ofthissectionandwithintwo
50weeksafterreceivingtestresults,makealltestingresultsandanyleadremediation
51plansavailableontheschool'swebsite;
52 (b)Removeandreplaceanydrinkingwatercoolersordrinkingwateroutlets
53thattheUnitedStatesEnvironmentalProtectionAgencyhasdeterminedarenotlead-
54freeunderthefederalLeadContaminationControlActof1988,asamended;exceptthe
55schoolshallnotberequiredtoreplacethosedrinkingwateroutletsorwatercoolersthat
56testedundertherequirementsofthissectionandhavebeendeterminedtobedispensing
57drinkingwaterwithaleadconcentrationlessthanfivepartperbillion;however,such
58drinkingwateroutletorwatercoolershallbesubjecttoalltestingrequirementsand
59shallnotbeexcludedfromtestingundersubsection10ofthissection.
60 (4)Iftestingindicatesthatthewatersourceiscausingthecontaminationand
61untilsuchtimethatthesourceofthecontaminationhasbeenremediated,theschool
62shall:
63 (a)Installafilterateachpointatwhichthewatersupplyentersthebuilding;
64 (b)Installafilterthatreducesleadindrinkingwateroneachwateroutlet
65inventoriedunderparagraph(a)ofsubdivision(1)ofthissubsectionofthissectionto
66ensureleadconcentrationsarebelowfivepartsperbillion;or
67 (c)Providepurifiedwaterateachwateroutletinventoriedunderparagraph(a)
68ofsubdivision(1)ofthissubsection.
69 (5)Iftestingindicatesthattheinternalbuildingpipingiscausingthe
70contaminationanduntilsuchtimethatthesourceofthecontaminationhasbeen
71remediated,theschoolshall:

88 (8)Schooldistrictsshallsubmitsuchannualtestingresultstothedepartment.
89 (9)Thissubsectionshallnotbeconstruedtopreventaschoolfromconducting
90morefrequenttestingthanrequiredunderthissection.
91 5.(1)BeforeAugust1,2024,orthefirstdayonwhichstudentswillbepresentin
92thebuilding,whicheverislater,andannuallythereafter,eachschoolshallconduct
93testingforleadbyfirst-drawandfollow-upflushsamplesofarandomsamplingofat
94leasttwenty-fivepercentofremediateddrinkingwateroutletsuntilallremediated
95sourceshavebeentestedasrecommendedbythe2018versionoftheUnitedStates
96EnvironmentalProtectionAgency's"Training,Testing,andTakingAction"program.
97Thetestingshallbeconductedandtheresultsanalyzedforbothtypesoftestsbyan
98entityorentitiesapprovedbythedepartment.
99 (2)If,inthetenyearspriortothe2023-24schoolyear,afixturetestedabovefive
100partsperbillionforlead,suchfixturedoesnotneedtoberepeattestedforlead,but
101insteadremediationshallbeginonsuchfixture.
102 6.(1)Inadditiontotheapportionmentspayabletoaschooldistrictunder

119 8.Forpublicschools,thedepartmentshallensurecompliancewiththissection.
120Eachschooldistrictshallberesponsibleforensuringcompliancewithineachschool
121withintheschooldistrict'sjurisdiction.
122 9.NoschoolbuildingconstructedafterJanuary4,2014,asprovidedinthe
123federalReductionofLeadinDrinkingWaterAct(42U.S.C.Section300g-6),as
124amended,shallberequiredtoinstall,maintain,orreplacefiltersunderparagraph(c)of
125subdivision(1)ofsubsection4ofthissection.
126 10.Aschoolthattestsanddoesnotfindadrinkingwatersourcewithalead
127concentrationabovetheacceptablelevelasdescribedinsubsection3ofthissectionshall
128berequiredtotestonlyeveryfiveyears.
129 11.Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe
130administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
131section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
132becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
133536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable,
134andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
135review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently

256.700.1.Anyoperatordesiringtoengageinsurfaceminingwhoappliesfora
2permitundersection444.772shall,inadditiontoallotherfeesauthorizedundersuchsection,
3annuallysubmitageologicresourcesfee.Suchfeeshallbedepositedinthegeologic
4resourcesfundestablishedandexpendedundersection256.705.Foranyoperatorofagravel
5miningoperationwheretheannualtonnageofgravelminedbysuchoperatorislessthanfive
6thousandtons,thereshallbenofeeunderthissection.

16 3.BeginningAugust28,2007,thegeologicresourcesfeeshallbesetatapermitfee
17offiftydollars,asitefeeoffiftydollars,andanacrefeeofsixdollars.Feesmayberaisedas
18allowedinthissubsectionbyaregulationchangepromulgatedbythedirectorofthe
19departmentofnaturalresources.Priortosucharegulationchange,thedirectorshallconsult
20theindustrialmineralsadvisorycouncilcreatedundersection256.710inordertodetermine
21theneedforsuchanincreaseinfees.
22 4.FeesimposedunderthissectionshallbecomeeffectiveAugust28,2007,andshall
23expireonDecember31,[2025] 2030. Nootherprovisionsofsections256.700to256.710
24shallexpire.
25 5.Thedepartmentofnaturalresourcesmaypromulgaterulestoimplementthe
26provisionsofsections256.700to256.710.Anyruleorportionofarule,asthattermis
27definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
28becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536
29and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany
30ofthepowersvestedwiththegeneralassemblyunderchapter536toreview,todelaythe
31effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then

6appointeesfromanyoneindustry,appointedbythedirectorofthedepartmentofnatural
7resources:limestonequarryoperators,granitemining,claymining,sandstonemining,
8baritemining,othernonmetallicsurfacemining,orsandandgravelmining
9 [(a)Threerepresentingthelimestonequarryoperators;
10 (b)Onerepresentingtheclayminingindustry;

26 (5)Serveinanadvisorycapacityinallmatterspertainingtotheadministrationofthis

28 (6)Serveinanadvisorycapacityinallothermattersbroughtbeforethecouncilbythe
29directorofthedepartmentofnaturalresources.
30 3.Allmembersoftheadvisorycouncil,withtheexceptionofthedirectorofthe

48departmentofnaturalresources.Thepersonselectedtofillanysuchvacancyshallpossess
49thesamequalificationsrequiredbythissectionasthememberheorshereplacesandshall
50serveuntiltheendoftheunexpiredtermofhisorherpredecessor.

20custodianofthefund.Inaccordancewithsections30.170and30.180,thestatetreasurer
21mayapprovedisbursements.Thefundshallbeadedicatedfundandmoneyinthefund
22shallbeusedsolelyforthepurposesofthissection.Notwithstandingtheprovisionsof
23section33.080tothecontrary,anymoneysremaininginthefundattheendofthe
24bienniumshallnotreverttothecreditofthegeneralrevenuefund.Thestatetreasurer
25shallinvestmoneysinthefundinthesamemannerasotherfundsareinvested.Any
26interestandothermoneysearnedonsuchinvestmentsshallbecreditedtothefund.
27 (2)Uponappropriation,thedepartmentofnaturalresourcesshallusemoneyin
28thefundcreatedbythissubsectionforthepurposesofcarryingouttheprovisionsofthis
29section,including,butnotlimitedto,theprovisionofgrantsorotherfinancial
30assistance,and,iflimitationsorconditionsareimposed,onlyuponsuchother
31limitationsorconditionsspecifiedintheinstrumentthatappropriates,grants,

34andtheirtributaries,andimprovestatewidefloodforecastingandmonitoringability,
35thereisherebyestablisheda"FloodResiliencyProgram".Theprogramshallbe
36administeredbythedepartmentofnaturalresources.Thestatemayparticipatewitha
37promoterinthedevelopment,construction,orrenovationofafloodresiliencyprojectif
38thepromoterhasaplanwhichhasbeensubmittedtoandapprovedbythedirector,or
39thestatemaypromoteafloodresiliencyprojectandinitiateaplanonitsownaccord.
40 5.Theplanshallincludeadescriptionofthefloodresiliencyproject,theneedfor
41theproject,thefloodresiliencymeasurestobeimplemented,thepartnerstobeinvolved
42intheproject,andothersuchinformationasthedirectormayrequiretoadequately
43evaluatethemeritoftheproject.
44 6.Thedirectorshallonlyapproveaplanuponadeterminationthatlong-term
45floodmitigationisneededinthatareaofthestate,andthatsuchaplanproposesflood
46resiliencymeasureswhichwillprovidelong-termfloodresiliency.
47 7.Promoterswithapprovedfloodresiliencyplansandprojectsshallbeeligible
48toreceiveanygifts,contributions,grants,orbequestsfromfederal,state,private,or
49othersourcesforengineering,constructionorrenovationcostsassociatedwithsuch
50projects.
51 8.Promoterswithapprovedfloodresiliencyprojectsmaybegrantedfundsfrom
52thefloodresiliencyimprovementfundpursuanttosubsection3ofthissection.
53 9.Thedepartmentofnaturalresourcesisherebygrantedauthorityto
54promulgaterulestoimplementthissection.Anyruleorportionofarule,asthattermis
55definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
56shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof
57chapter536and,ifapplicable,section536.028.Thissectionandchapter536are
58nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto
59chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare

11otherbeneficialpurposeswithoutapermitundersections260.200to260.345ifsuch
12processedrecycledasphaltshinglesareinspectedfortoxicandhazardoussubstancesin
13accordancewithrequirementsestablishedbythedepartmentofnaturalresources,
14providedthatprocessedrecycledasphaltshinglesshallnotbeusedforsuchpurposes
15withinfivehundredfeetofanylake,river,sinkhole,perennialstream,orephemeral
16stream,orwithinfiftyfeetabovethewatertable,exceptwhen:
17 (1)Thewatertableisperched;
18 (2)Usedasfillinaroadorhighwayembankment,solongastheprocessed
19recycledshinglesarenotinstalledwithinfivefeetoftheaveragesurfacewaterelevation
20ofthestreamorthebasefloodelevationofthestream,asdefinedbytheNationalFlood
